No. II/2/Part VII

Dated: 24/07/2017

The Secretary (E),
Railway Board,
New Delhi

Dear Sir,

Sub: Record Note of Discussions held on 12th July 2017 at 15:00 hrs in the Chamber of AM (Staff) with both the Federations viz., AIRF and NFIR on the issue of:

(a) Change in staffing pattern of ASMs (G.P. Rs. 4200) in view of 7th CPC recommendations, and

(b) Change in’ staffing Pattern of TC, CC & ECRC consequent to abolition/upgradation and merger of categories in view of 7th CPC recommendations.

Ref: Railway Board’s letter No. E(NG)I-2016/PM1/12 dated 20/07/2017.

With reference to the record note of discussions, it is suggested that under the heading “NFIR” the name of the General Secretary be printed correctly.

Vide Para 4 of the enclosure to Board’s letter No. E(NG)I-2016/PM1/12 dated 20/07/2017, the Board sought suggestions on both the issues – (a) & (b) above.

Accordingly, the Federation gives its suggestions as below:-

Station Masters’ category:

 The DR quota should be limited to 50%, considering the fact that LDCE being held applying norms prescribed for DR Quota through which cream among the qualified candidates also would become Station Masters’ (GP 4200/Pay Level 6).

The Promotion quota shall be 35% to be filled by those staff mentioned in the Board’s proposal upto the age of 50 years. Those in GP 1800/Pay Level 1 also be made eligible for Promotion quota, however, panel needs to be drawn in the order of seniority among the qualified staff (not to be treated as General Selection).

Commercial:

The Federation confirms the contents of Para 3(a) (b) (c) & (d) while maintaining its stand that the Ticket Checking category should as a whole, remain as separate category.

With regard to Para 3, there are precedents wherein the recommendations of previous Pay Commissions accepted by the Government have not been adopted by the Railway Ministry on the ground that Railways working is different. Example:- when the Government had accepted 5th CPC recommendation for classifying the posts in Pay Scale maximum of which was 9000 or above as “Group B”, the Railway Ministry had taken a view that the said decision was not implementable and accordingly not adopted.

Record Note of Discussions held on 12th  july  2o17 at 15:00 hrs.. in the Chamber of AM(Staff) with both the Federations, viz., AIRF and NFIR on the issue of :

(a) Change in staffing pattern of ASMs (C.P.Rs: 4200) in view of 7th CPC recommendations, and;

(b) Change in staffing Pattern of TC, CC & ECRC consequent to abolition/upgradation and merger of categories in view of 7th CPC recommendations.The following officers and representatives of Federations (AIRF & NFIR) attended the meeting-:

AIRF-NFIR

2.Points emerged/observations made on the issue of Change in staffing Points emerged/observations made on the issue of Change in staffing pattern of ASMs (G.P.Rs.42oo) in view of 7th CPC recommendations :

(a) Federations suggested that DR Quota for Station Master should be 50% with the provision that 50% of DR vacancies can be earmarked for GDCE. Federations were advised of the merit of existing 60% DR quota and its applicability.

(b) Federations suggested that LDCE quota should be 15%.

(c) Federations suggested that General Selection Quota should be 35%;

(d) A decision has to be taken whether erstwhile G.P. Rs. 1800 should be included as eligible for LDCE and General Selection for the post of SMs or not.

(e) There was also a demand that age limit should be 50 years for all irrespective of whether candidates were General, SC/ST or OBC. The existing IREM provision contained in para 122 and implication of amending the same was advised to Federations.

3. Points emerged/observations made on the issue of Change in staffing Pattern of TC, CC & ECRC consequent to abolition/upgradation and merger of categories in view of 7th CPC recommendations; however the point needs attention as to whether we are competent to change the recommendations of 7th CPC suo-motu;

(a) The existing staff  working  in the cadres ECRCs and commercial Clerks/inspector may be merged with the option to inter-change them;

 (b) Ticket Checking category as a whole should continue as separate category for the present.

(c) The merger of TC, ECRC and CC may be only for future recruits from prospective effect for which modalities be discussed;

d) 10 +2 qualification proposed for TC and CC should not be insisted for existing staff, who do not have this qualification.

4. Both the Federations will revert back with their suggestions on both the issues.

OFFICE MEMORANDUM

Sub: Stepping up of pay of Senior Assistants of CSS drawing less pay on promotion in the Section Officers Grade than their juniors – clarifications regarding

The undersigned is directed to refer to this Department’s OM of even number dated 20.05.2014 and to state that there has been confusion regarding the interpretation of three OMs (OM No. 5/16/80-CS.l dated 13.4.1988, OM No. 5/21/92-CS.I dated 23.2.1994, OM No. 5/1/96-CS.I dated 8.10.96) vis-a-vis general instructions issued vide OM DOP&T OM No.4/7/92-Estt.(Pay-l) dated 04.11.1993. The matter was discussed in consultation with Estt.(Pay) Division of DOP&T once again and it has been clarified that-

(1) OMs dated 13.04.1988, 23.02.1994 and 08.10.1996 and general instructions issued vide OM dated 04.11.1993 are not exclusive of each other. Since the OM dated 04.11.1993 stipulates general conditions of stepping up of pay, this should be followed even in cases covered under OMs dated 13.04.1988, 23.02.1994 and 08.10.1996. All the three OMs are to be read with and subject to the general instructions in the matter issued vide DOP&T OM dated 04.11.1993, therefore, stepping up of pay is not (NOT) to be allowed where junior was drawing more pay than the senior in the lower grade.

(2) In a nutshell, as per OMs dated 13.04.1988, 23.02.1994 and 08.10.1996, stepping up of pay of senior Assistants of CSS on promotion as Section Officer may be allowed in the following cases subject to the general instructions in the matter issued vide DOP&T OM dated 04.11.1993:

(i) Stepping up of pay of Senior DR Assistant with reference to a Junior DR Assistant recruited through a later Assistant Grade Examination on promotion as Section Officer (OM dated 13.04.1988);

(ii) Stepping up of pay of Senior DR Assistant with reference to a Junior DR Assistant recruited through a later Assistant Grade Examination on promotion as Section Officer against LDCE Quota(OM dated 23.02.1994)

(iii) Stepping up of pay of Senior Promotee Assistant with reference to a Junior DR Assistant on promotion as Section Officer (OA No.365/90-Shri K.C. Sehgal vs. UOI) and Stepping up of pay of Senior DR Assistant with reference to a Junior DR Assistant of same Assistant Grade Examination on promotion as Section Officer (OA No.869/91-Shri L.K. Chawla vs. UOI) (OM dated 08.10.1996).

Dopt Orders – Relaxation in eligibility condition for Combined Section Officers/PS Grade Limited Departmental Competitive Examination-2012 & 2013

Dopt Orders – Relaxation in eligibility condition for Combined Section Officers/PS Grade Limited Departmental Competitive Examination-2012 & 2013

 No. 4/4/2012-CS-II(A)
Government of India
Ministry of Personnel, Public Grievances and Pensions
Department of Personnel & Training

Lok Nayak Bhawan, New Dethi-110003.
Date: 22nd November, 2013

ORDER

Whereas the Central Secretariat Stenographers Service Private Secretary Grade (Limited Departmental Competitive Examination) Regulations, 2010 provide that for being eligible to appear in the Private Secretary Grade (Limited Departmental Competitive Examination) any regular Personal Assistant of the Central Secretariat Stenographers’ Service (CSSS) possessing a Bachelor’s Degree from a recognized University, on the crucial date, inter-alia, should satisfy the following condition :-

He/She should have rendered not less than three years’ of approved and continuous service in the grade.

Provided that if he/she had been appointed to the Personal Assistant of the Central Secretariat Stenographers’ Service on the results of the competitive examination, including a Limited Departmental Competitive Examination, such an examination should have been held not Less than three years before the crucial date and he/she should have rendered not less than two years approved and continuous service in that grade.

2. And whereas, in pursuance to the notice for the Combined Section Officers/Stenographers’ (Grade- B/Grade-I) Limited Departmental Competitive Examination (LDCE) 2012 & 2013, representations from PAs of CSSS appointed to  the grade through LDCE mode were received in this Department seeking relaxation in the eligibility criteria to appear in the Private Secretary Grade Limited Departmental Competitive Examination, 2012 and 2013.

3. And whereas, on examination of the representations it was observed that the LDC Examination 2009 and 2010 for promotion to the grade of PAs were conducted by the Staff Selection Commission on 5th July, 2009 and 4th July, 2010 respectively. The crucial date for counting of three years of length of service for eligibility criterion for PS Grade LDCE, 2012 and 2013 being 1st JuLy, 2012 and 1st July, 2013 respectively, the PAs appointed through LDCE mode on the basis of the said examinations are thus not eligible for appearing in the PS Grade LDCE 2012 and 2013.

4. And whereas, it was further observed that the PAs appointed to the Grade through Seniority Quota for SL Years 2009 and 2010 are eligible as per the provision for appearing in the PS grade LDC Examination 2012 and 2013 whereas the PAs of 2009 and 2010 appointed through LDCE mode do not fulfill the said eligibility criteria despite some of them being placed higher in the ranking in the Select Lists, 2009 and 2010 of PA Grade.  It was noted that the said provision in eligibility criterion of the said examination unduly places the PAs who have been appointed as regular PAs through the mode of LDC Examination of 2009 and 2010 at disadvantage.

5. And Now, therefore, it has been decided in consultation with the UPSC, as provided under Rute 23 of the Central Secretariat Stenographers’ Service Rules 2010, to give one time relaxation in the condition relating to the eligibility criterion of regular Personal Assistants appointed through LDCE, contained in the Regulation 4 (i) of Central Secretariat Stenographers’ Service Private Secretary Grade (Limited Departmental Competitive Examination) Regulation, 2010, for appearing in the Private Secretary Grade LDCE, 2012 and 2013 of CSSS. Consequently regular PAs of CSSS appointed through the results of LDCE for the years 2009 and 2010 will be eligible to appear in the Combined Section Officers/Stenographers’ (Grade-B/Grade-I) Limited Departmental Competitive Examination 2012 & 2013 (Category —IV, PS Grade of CSSS) respectively to be conducted by UPSC.

Relaxation of requirement of 4 APARs for Section Officer LDCE 2012 & 2013

Relaxation of requirement of 4 APARs for Section Officer LDCE 2012 & 2013

No.6/1/2013-CS-1(P)
Government of India
Ministry of Personnel, Public Grievances and Pensions
(Department of Personnel & Training)

Lok Nayak Bhawan,
New Delhi October 23, 2013.

ORDER

Whereas the Central Secretariat Service Section Officers’ Grade (Limited Departmental Competitive Examination) Regulations, 2010 provide that for being eligible to appear in the Section Officers’ Grade (Limited Departmental Competitive Examination) (hereinafter referred to as ‘examination’) an officer of the Assistants’ Grade of the Central Secretariat Service (CSS) or of Personal Assistants’ Grade (Stenographer Grade ‘C’) of the Central Secretariat Stenographers’ Service (CSSS) possessing a Bachelor’s Degree of a recognised university or equivalent shall, inter-alia, satisfy the following condition on the crucial date:

“He shall have rendered not less than five years’ approved service and shall also have, earned at least four Annual Performance Appraisal Reports in .the Assistants’ Grade of the Central Secretariat Service or Personal Assistants’ Grade of Central Secretariat Stenographers’ Service.”

2. And whereas in response to the notice for the Combined Section Officers/Stenographers’(Grade-B/Grade-l) Limited Departmental Competitive Examination 2012 & 2013, representations from individuals were received stating that the condition of four Annual Performance Appraisal Reports (APAR) as on the crucial date for eligibility for the SO Grade 1DCE, was adversely affecting them as they would not be eligible for the forthcoming examination due to not having obtained the requisite number of APARs whereas many of their juniors appointed by the same mode of recruitment would be eligible.

3. And whereas the Government on consideration of the matter observed that introduction of the new condition of four APARs is creating incongruity in so far as many junior Assistants/PAs are eligible for taking the examination for the years 2012 and 2013 but the seniors are not, as they have not obtained four APARs in that grade as on the crucial date due to either late joining in the case of direct recruits on account of administrative delays or due to late finalisation of Select Lists in the case of promotes. As a result, an anomalous situation has arisen whereby officers senior in the Select List or in rank in the direct recruitment examination would not be eligible to sit for the forthcoming examination due to not obtaining the requisite APARs while their juniors would be eligible to take the examination.

4. And whereas the Government has on consideration decided that the condition of four APARs for the examination is causing undue hardship to those Assistants/PAs who have completed at least five years of approved service but are not eligible to appear in the examination for the years 2012 & 2013 as hey have not obtained four APARs due to administrative reasons, while their juniors are eligible for the examination.

5. And now, therefore, to bring about uniformity in the eligibility condition for all the candidates for the examination for the years 2012 & 2013 for category –I and to avoid undue hardship to many Assistants/PAs as an exception, and in  exercise of the powers conferred by Rule 23 of the Central Secretariat Service Rules, 2009, the competent authority has decided to relax the condition relating to the requirement of four APARs, on the crucial date, in the Assistants ‘Grade of CSS  or Personal Assistant Grade of CSSS contained in Regulation 4 of the Section Officers ‘Grade (Limited Department competitive Examination) Regulations, 2010. Consequently Assistants of CSS and Personal Assistants of CSSS who have rendered five years ‘Approved service in the respective grades as on the crucial date would be eligible to appear in the combined Section Officers’/Stenographers’(Grade-B/Grade-I) Limited Departmental Competitive Examination 2012 & 2013 for Category-I (Section Officer of CSS).

Ratio of Promotion in CSS

Ratio of Promotion in CSS

Is there any ratio in which the Promotee Assistants and Direct Recruit Assistants were being promoted to the Section Officer Grade prior to Cadre restructuring undertaken during early 1990s..? and Whether the Committee of Secretaries, while considering Cadre restructuring of CSS, had recommended promotion of Promotee Assistants and Direct Recruit Assistants to the Section Officer Grade in the ratio of 75:25..?

The Minister of State in the Ministry of Personnel, Public Grievances and Pensions Shri.V.Narayanasamy replied to the above questions in Lok Sabha on 13th March, 2013 as follows:

“No ratio has been prescribed for either Promotee or Direct Recruit category Assistants for promotion to the grade of Section Officer.

Promotions to the grade of Section Officer are made through two streams, viz.,

(i) by seniority and

(ii) by holding Limited Departmental Competitive Examination (LDCE). In both the streams, all eligible Assistants, whether direct recruit or promotee are participating.

No such recommendation has been made by Committee of Secretaries”.

(e) Appointments of the nature of deemed deputation or transfers to ex-cadre posts made in exigencies of service with the specific condition that no deputation (duty) allowance will be admissible – e.g. (ì) interim arrangements in the event of conversion of a Government office/organisation or a portion thereof into a PSU/ autonomous body or vice-versa; and (ii) appointments to the same post in another cadre.
3. Scope of Term deputation / foreign service’ – Restrictions on treating an appointment as on deputation / foreign service.
3.1 The terms deputation/foreign service will cover only those appointments that are made by transfer on a temporary basis provided the transfer is outside the normal field of deployment and is in public interest. The question whether the transfer is outside the normal field of deployment or not will be decided by the authority which controls the serve or post from which the employee is transferred.
3.2 The following types of appointments will not be treated as deputation / foreign service for the purposes of these orders:
(a) appointment of serving employees made either by promotion or by direct recruitment from amongst open market candidates whether on permanent or temporary basis.
(b) permanent appointment made by transfer.
(c)Temporary appointment made on the basis of personal requests of employees.
(d) Arrangements necessitated by staff imbalances arising on re-organisation of offices on the same or different stations, subject to the specific condition that no deputation (duty) allowance will be admissible in such cases.
3.3 A person in a higher Grade Pay/scale of pay shall not be appointed on deputation to a post in lower Grade Pay/scale of pay if the deputation is from Central Government to Central Government and also in cases where the scale of pay and dearness allowance in the parent cadre post and ex-cadre post are similar.
3.4 However, no appointment on deputation / foreign service shall be made from/to Central Government/ an organisation where the pay scale and DA in the parent cadre post and ex-cadre post are dissimilar, ¡f the basic pay in the parent cadre increased by one increment plus dearness allowance(s) including interim relief if any, admissible to a person in the parent cadre post exceeds the basic pay plus dearness allowance (s) including interim relief, if any, at the maximum of the pay scale of the ex-cadre post. In the revised pay structure, the maximum of the scale would mean the sum of the Grade Pay of the ex-cadre post and maximum of the Pay Band PB 4 i.e. Rs. 67000. For example, if the ex-cadre post is in the Grade Pay of Rs. 4200, then the maximum would be Rs. 71200 i.e. Rs. 4200 plus Rs. 67000 (maximum of PB 4).
4. Exercise of option
4.1 An employee appointed on deputation/foreign service, may elect to draw either the pay in the scale of pay of deputation/foreign service post or his/her basic pay in the parent cadre plus deputation (duty) allowance thereon plus personal pay. ¡f any. However, in case of Government employees on deputation/ foreign service to CPSEs, this option will not be allowed and their pay will be governed in  terms of the orders issued by Department of Public Enterprises vide OM dated 26.11.2008 and clarifications issued thereafter.
4.2 The borrowing authority shall obtain the option of the employee within one month from the date of joining the ex-cadre post unless the employee has himself furnished the option.
4.3 The option once exercised shall be final.
4.4 However, the employee may revise the option under the following circumstances which will be effective from the date of occurrence of the same:
(a) When he/she receives proforma promotion or is appointed to non-functional selection grade or up-gradation of scale in the parent cadre;
(b) When he/she is reverted to a lower grade in the parent cadre;
(c) When the scale of pay of the parent post on the basis of which his emoluments are regulated during deputation/foreign service or of the ex-cadre post held by the employee on deputation/foreign service is revised either prospectively or from a retrospective date.
(d) Based on the revised/same option of the employee, in the event of proforma promotion / appointment to non-functional Selection Grade / revision / upgradation of scales of pay in the parent cadre, his/her pay will be re-fixed with reference to the
revised entitlement of pay in the parent cadre. However, if the initial option was for the pay scale of the deputation post and no change in option already exercised is envisaged, the pay already drawn in deputation post will be protected if the pay re- fixed is less.
Note: Revision in the rates of DA, HRA or any other allowance either in the parent or borrowing organisation shall not be an occasion for revision of the earlier option.
4.5. If the pay of an employee in his cadre post undergoes downward revision, the pay in the ex-cadre post is also liable to be re-fixed on the basis of revised pay and in accordance with the revised option or existing option if the employee does not revise his option.
5. Pay fixation
5.1 When an employee on deputation/Foreign Service elects to draw pay in the scale of pay attached to the ex-cadre post, his/her pay may be fixed as under;
(i) Deputation from Central Government to Central Government
If the scale of pay/Grade Pay of the ex-cadre post is higher, the pay may be fixed after adding one increment to the existing pay in the Pay Band of the parent cadre post. The grade pay corresponding to the ex-cadre post would thereafter be granted in addition to this pay in the pay band. However, in cases where the fixation of pay in the ex-cadre post involves change of Pay Band also, if the pay in the pay band after adding the increment is less than the minimum of the pay band corresponding to the grade pay of the ex-cadre post, the pay in the pay band will be fixed at the minimum of the Pay Band .
In case the Grade Pay/scale of employee’s cadre post and the ex-cadre post are identical, the employee would continue to draw his/her existing basic pay.
In case the Grade pay of the ex-cadre post is upto Rs 10000, the Basic Pay, from time to time after pay fixation should not exceed the maximum of the pay band PB-4 (Rs.67000) plus the grade pay of the post held on deputation. In case the ex-cadre post is in the HAG or HAG+ pay scale, the Basic Pay, from time to time after pay fixation should not exceed Rs.79000 or Rs.80000 respectively.
(ii) In foreign service/ Reverse Foreign Service
(a) when the pay scale of the post in the parent cadre and that attached to ex-cadre post are based on the same index level and the DA pattern is also same, the pay may be fixed as under (i) above.
(b) If the appointment is made to a post whose pay structure and / or DA pattern is dissimilar to that in the parent organisation, pay may be fixed by adding one increment to the pay ¡n the parent cadre post in the scale of his regular parent post ( and if he/she was drawing pay at the maximum of the scale, by the increment last drawn) and equating the pay so raised plus dearness allowance (and additional or ad-hoc dearness allowance, interim relief etc., if any, with emoluments comprising of pay plus DA, ADA, interim relief etc., if any, admissible, in the borrowing organisation and the pay may be fixed at the stage in the pay scale of the ex-cadre post at which total emoluments admissible in the ex-cadre post as above equal the emoluments drawn in the cadre.
5.2 In cases of appointment from one ex-cadre post to another ex-cadre post where the employee opts to draw pay in the scale of the ex-cadre post, the pay in the second or subsequent ex-cadre post should be fixed under the normal rules with reference to the pay in the cadre post only. However, ¡n respect of appointments to ex-cadre posts carrying Grade Pay identical to that of the ex-cadre post(s) held on an earlier occasion(s), it may be ensured that the pay drawn in subsequent appointment should not be less than the pay drawn earlier.
5.3 In cases of appointments to a second or subsequent ex-cadre post(s) in a higher pay scale/grade pay than that of the previous ex-cadre post, the pay may be fixed with reference to the pay drawn in the cadre post and if the pay so fixed happens to be less than the pay drawn in the previous ex-cadre post, the difference may be allowed as personal pay to be absorbed in future increases in pay. This is subject to the condition that on both the occasions, the employee should have opted to draw pay in the scales of pay/Grade Pay attached to the ex-cadre posts.
Note-1: The term parent post and basic pay means the post held on regular basis in the parent organisation and pay drawn / admissible in such a post respectively.
Note-2: An officer who may be holding a higher post on adhoc basis in the cadre at the time of proceeding on deputation/foreign service would be considered to have vacated the post held on adhoc basis and proceeded on deputation / foreign service from his/her regular post. During the period of deputation / foreign service, he/she shall earn notional increments in the parent cadre post. On reversion, if he/she is re-appointed to the higher post on regular or adhoc basis his pay will get fixed with reference to the pay admissible in the lower post on the date of such re-appointment. In such cases, if his pay gets fixed at a stage lower than that of his junior(s) who continued to serve in the cadre, no stepping up will be admissible as per extant rules in so far as Central Government employees are concerned. However, if the pay so fixed is less than the pay drawn earlier while holding the post on ad-hoc basis the pay earlier drawn will be protected. Therefore, those Central Government employees who are already holding a higher post on ad-hoc basis or expecting it shortly in the parent cadre may weigh all relevant considerations before opting for deputation/foreign service. This note of caution will be applicable to employees of other organisations wishing to apply for posts on deputation in Central Government, if governed by similar rues in parent organisation.
Note-3: Pay of an officer appointed on deputation/foreign service on adhoc basis pending selection of a regular incumbent may also be regulated in accordance with provisions of Para 5.1 & 6.1 of this OM.
Note-4: The provisions of this Para as well as Para 6 will not apply to appointments on Personal Staff of Ministers. Such appointments will be regulated by separate specific orders issued by the Government in that behalf.
6. Deputation (duty) Allowance
6.1 The deputation (duty) allowance admissible shall be at the following rates:
(a) In case of deputation within the same station, the allowance will be paid at the rate of 5% of basic pay subject to a maximum of Rs.2000 p.m.; and
(b) In other cases, Deputation (Duty) Allowance will be payable at the rate of 10% of the employee’s basic pay subject to a maximum of Rs.4000/- p.m.
(C) The deputation (duty) allowance as above shall further be restricted as under:-
Basic Pay, from time to time, plus Deputation (Duty) Allowance shall not exceed the maximum of the pay band PB-4 (Rs.67000) plus the grade pay of the post held on deputation in case the Grade Pay of the post held on deputation is upto Rs 10000. Incase the post held on deputation is in the HAG or HAG+ pay scales, the Basic Pay, from time to time, plus Deputation (Duty) Allowance should not exceed Rs. 79000 and Rs.80000 respectively.
Note: Basic Pay in the revised pay structure means the pay drawn in the prescribed pay band plus the applicable grade pay but does not include any other type of pay like special pay/allowance etc.
The rates of deputation (duty) allowance as above shall take effect from 1.9.2008.
Note: 1 The term ‘same station’ for the purpose will be determined with reference to the station where the person was on duty before proceeding on deputation.
