Dopt Orders on Posting of Government employees who have differently abled dependents

Dopt Orders on Posting of Government employees who have differently abled dependents
No.42011/3/2014-Estt.(Res.)
Government of India
Ministry of Personnel, Public Grievances and Pensions
Department of Personnel and Training
North Block, New Delhi
Dated the 6th June, 2014
OFFICE MEMORANDUM
Sub: Posting of Government employees who have differently abled dependents – reg.
There has been demand that a Government employee who is a care giver of the disabled child may not have to suffer due to displacement by means of routine transfer/rotational transfers. This demand has been made on the ground that a Government employee raises a kind of support system for his/her disabled child over a period of time in the locality where he/she resides which helps them in the rehabilitation.
2. The matter has been examined. Rehabilitation is a process aimed at enabling persons with disabilities to reach and maintain their optimal physical, sensory, intellectual, and psychiatric or a social functional level. The support system comprises of preferred linguistic zone, school/academic level, administration, neighbours, tutors/special educators, friends, medical care including hospitals, therapists and doctors, etc. Thus, rehabilitation is a continuous process and creation of such support system takes years together.
3. Considering that the Government employee.who has disabled child serve as the main care giver of such child, any displacement of such Government employee will have a bearing on the systemic rehabilitation of the disabled child since the new environment/set up could prove to be a hindrance for the rehabilitation process of the child. Therefore, a Government servant who is also a care giver of disabled child may be exempted from the routine exercise of transfer/rotational transfer subject to the administrative constraints.
The word ‘disabled’ includes
(i) blindness or low vision
(ii) hearing impairment
(iii) locomotor disability or Cerebral Palsy
(iv) leprosy cured
(v) mental retardation
(vi) mental illness and
(vii) multiple disabilities.
4. Upbringing and rehabilitation of disabled child requires financial support. Making the Government employee to choose voluntary retirement on the pretext of routine transfer/rotation transfer would have adverse impact on the rehabilitation process of the disabled child.
5. This issues with the approval of MoS(PP).
6. All the Ministries/Departments, etc. are requested to bring these instructions to the notice of all concerned under their control.

CVC Orders – Rotation of officials working in sensitive posts – regarding.

CENTRAL VIGILANCE COMMISSION
Satarkta Bhawan, G.P.O. Complex,
Block A, INA, New Delhi 110023

No.004/VGL/090/225553
Dated 11.9.2013
Circular No. 03/09/13

Subject : Rotation of officials working in sensitive posts – regarding.

Central Vigilance Commission and the Department of Personnel and Training have issued instructions for effecting rotational transfers of officials posted on sensitive posts. As per Commission’s instructions issued vide letter Nos. 98.VGL/60 dated 15.4.1999, 02.11.2001 and 004/VGL/90 dated 01.5.2008 and 04.01.2012 (for public sector banks) on this issue, it was prescribed that Ministries/Departments/Organisations and CVOs are to identify the sensitive posts and staff working in these posts and also ensure that they are strictly rotated after every two/three years to avoid developing vested interests.

2. The Commission in the superintendence of vigilance administration over the years has observed that such rotational transfers are not effected in many organisations due to which officials continue to remain the same posts for long periods. Such overstay and continuous posting afford scope for indulging in corrupt activities, developing vested interests etc. which may not be in the interest of the organisation. The Commission would, therefore, emphasis that periodical rotation of officials holding sensitive posts/jobs needs to be ensured. As such, officials should not be retained in the same place/position for long by the Ministries/Departments/PSUs/Banks/Organisations etc.

3. Heads/CVOs of all Departments/Organisations are advised to ensure strict compliance of the Commission’s guidelines and implement the same in letter and spirit. Further, the CVOs should specifically report the action taken indicating the number of officials rotated/transferred in the respective organisations in the Monthly Report of CVOs submitted to the Commission.

The undersigned is directed to say that it is proposed to transfer Under Secretaries who have completed five years or more in the same Ministry / Department as on 1.1.2012 (Annexure-I refers). The list does not include officers due for superannuation upto 31.12.2014 as officers within two years of superannuation are excluded from the purview of Rotational Transfer Policy applicable to CSS officers.
2. Ministries/ Departments and officers concerned may check the information in Annexure-I and bring to the notice of this Department urgently if any other Under Secretary with more than five years of service as on 01.01.2012 has been left out or if there is any other error/ omission in the list.
3. The Officers indicated in the list are also requested to indicate their preferences for posting in the enclosed format (Annexure-II) which should reach CS.I Division by 26.12.2012 either as a hardcopy or through e-mail at uscs1-dopt@nic.in It may be noted that seeking option is only for the purpose of assisting this Department in deciding the posting and this should not in any way be construed as right for claiming posting of choice.
4. Web Based Cadre Management of CSS As Ministries/Departments are well aware, this Department is in the process of launching web based cadre management in respect of CSS Officers shortly. While data in respect of majority of CSS officers has already been received, some Ministries/Departments have not completed this task despite repeated reminders. They are advised to complete this task immediately, and while forwarding information of Under Secretaries who are covered in this round of rotational transfer, should confirm that data in respect of these officers has been furnished for the web based cadre management.
