CLARIFICATION ON CHARGING OF WITHOUT AND IMPROPER TICKET HOLDERS IN DIFFERENT TRAINS – INDIAN RAILWAYS

DRAFT FOR CLARIFICATION ON CHARGING OF WITHOUT AND IMPROPER TICKET HOLDERS IN DIFFERENT TRAINS

Rajdhani/ Shatabdi1st Class Ordy.1st class ordy.1) At Originating station-
i) If a passenger boards in the train without ticket & without permission of TTE-
He will be charge, Base Fare upto the destination of train (Catering, reservation, superfast & service tax charges will be included in base fare) with Excess Charge equal to Base Fare upto the destination of train, whether accommodation is available or not.
ii) If a passenger boards 1n the train with valid minimum class of ticket & permission of TTE –
a) If vacancy is available upto his destination
– He will be charge, difference between fare payable and paid upto the destination of his ticket. (Catering, reservation, superfast &service tax charges will be included in base fare) no Excess Charge is to be realized.
b) If vacancy is not available upto his destination
– He will be charge, Base Fare upto the destination of train (Catering, reservation, superfast & service tax charges will be included in base fare) with Excess Charge equal to Base Fare upto the destination of train. An endorsement should be made on the ticket that such passenger will be detained at first stoppage of the train.

2) At Intermediate station-
i) If a passenger boards in the train without ticket & without permission of TTE. He will be charge, Base Fare of TTE- He will be charge, Base lare from starting to the destination of train (Catering, reservation, superfast & service tax charges will be included in base fare) with Excess Charge equal to Base Fare upto – the destination of – train, = whether accommodation is available or not.
ii) If a passenger boards in the train with valid minimum class of ticket & permission of TTE –
a) If vacancy is available upto his destination- Ile will be charge, difference between fare payable and paid upto his destination (Catering, reservation, superfast & service tax charges will be included in base fare) no Excess Charge is to be realized.
b) If vacancy is not available upto his destination
– He will be charge, Base Fare from the boarding station upto the destination of train (Catering, reservation, superfast & service tax charges will be included in base fare) with Excess Charge equal to Base Fare upto the destination of train. An endorsement should be made on the ticket that such passenger will be detrained at first stoppage of the train.
3) In case of Suvidha trains- If a passenger boards in the train at starting or intermediate station without & improper ticket and without permission of TTE- He will be charge, as without ticket and base fare will be last price of ticket sold for that class on that day with other supplementary charges with Excess Charge equal to Base Fare.
4) Endorsement on the face of WL ticket and entry in working chart of train is must by TTE.
Sec.137 of IRA –
1) If any person, with intent to defraud the railway,
a) travels or remains in any carriage,
b) uses or attempt to use which has already been used, he shall be punishable with imprisonment,
2) The person shall also be liable to pay the excess charge In addition to single fare for the distance he has >travelled.
3) The excess charge Shall be a sum equal to single fare or Rs.250 whichever is more.
4) The court convicting an offender may direct that the person in default of payment of any fine inflicted by court shall suffer imprisonment.

Sec.138 of IRA-
1) If a passenger a)being in or having alighted from a train, fails or refuses to present for examination or _ to deliver up his pass or ticket immediately on demand being madeb) he shall be liable to pay the excess charge in addition to single fare for the distance which he has travelled.
ii) If a passenger
a) travels or attempts to travel by a train tn a higher class than that for which he _ has obtained ticket or pass or b) travels beyond theplace authorized, he shall be liable to pay difference between the fare paid and payable in respect of the journeyhe has made and the excess charge.
iii) The excess charge shall be a sum equal to amount payable as the case may be or Rs.250 whichever is more.
iv)If he refuses to pay the due charges he should be prosecuted to Railway Magistrate for recovery of due amount.
v)Any sum_ recovered under para iv shall be paid to the Railway administration. He has to be detrained with HOM = at next stoppage and prosecuted under 138(1)(4), 180 IR

Super Fast/ Mail Exp., Sampark KrantiIIM/ Ex. (with permission of TTE)501) If a passenger is detected travelling without ticket in any class of train. He will be charge, the fare from the station which he has travelled or from the station which the train originally started or from the last checking point upto the point of detection with equal amount of Excess Charge subject to a minimum of Rs. 250/- and If accommodation is available further single fare upto his destination. If accommodation is not available then he will be detrained at next stop.
Sec. 138 of IRA
i) If a passenger a being in or having alighted
-from a train, fails or refuses to present for examination or – to deliver up his pass or ticket immediately on demand being made
b) he shall be liable to pay the excess charge in addition to single fare for the distance which he has travelled.
Garib RathIIm/ Exp., (with permission of TTE)1002) If a passenger is detected travelling without ticket in restricted distance train
He will be charge, the fare minimum upto the first station after the restricted distance where train has its commercial halt, with equal amount of Excess Charge subject to a minimum of Rs.250 upto point of detection. If accommodation is available further single fare upto his destination. If accommodation 1s not available then he will be detrained at next stop.
ii) If a passenger
a) travels or attempts to travel by a train in a higher class than that for which he has obtained ticket or pass or
b) travels beyond the place authorized, he shall be liable to pay difference between the fare paid and payable in respect of the journey he has made and the excess charge.
Double Decker1st class ordinary, ACCC ticket issued throught UTS (with permission of TTE)NA3) If a passenger is detected travelling in higher class with improper ticket & vacancy is not available – He will be charge, the difference of fare between two classes will be collected upto point of detection with equal amount of Excess Charge subject to minimum of Rs.250. The passenger will be detrained at next stop from higher Class and will be directed to go to the class for which he originally holds the ticket.iii) The excess charge shall be a sum equal to amount payable as the case may be or Rs.250 whichever is more.
Special Train on Special chargesBase fare is 10% higher of basic M/ E fare for 2 nd class & 30% of other class. No concession and pre-bought booking allowed.1004) If a passenger is detected travelling with improper ticket & vacancy is available
He will be charge, the difference of fares payable and paid will be collected from the starting station of his ticket or point of detection or last checking point to the destination of the ticket and no Excess Charge is to be realized.
iv) If he refuses to pay the due charges he should be prosecuted to Railway Magistrate for recovery of due amount.
Special Train on normal fareIIM/ Exp. (With permission of TTE)NA5) If a passenger is detected travelling in Brake Van/ Generator car/ SLR/ AGC/ RMS/ Pantry car etc. will be charge as without ticket in 1st class or highest class available in that train from the starting station of his ticket upto point of detection with all usual charges, even though holding a ticket. He will be removed at next stop from that compartment.v) Any sum _ recovered under iv shall be paid to the Railway administration.
He has to be detrained with HOM at next stoppage and prosecuted under138(1)(4), 180 IRA
Yuva Exp.IIM/ Exp. (With permission of TTE)1006) If a passenger is detected travelling on a ticket without obtaining break journey endorsement when he availed/ unexchanged Jail requisition, Police warrant/ unexchanged PTO/ PVST in restricted hours/ ticket other than endorsed date will be charged as without ticket in that class.
Jan ShatabdiIIM/ Exp., (With permission of TTE)507) If any Season Ticket holder found travelling in reserved coach he will be treated as without ticket and charged according to class of train.
Mahamana Exp.IIM/ Exp. (With permission of TTE) Base fare is 15% higher than the normal SF M/ Exp base fare (except 2S)
Suburban/ Local, PassengerII Ordinary101) If a passenger is detected travelling without ticket- He will be charge, the minimum chargeable fare with Excess Charge subject to Min. Rs.250 as per rule in all cases with respect to point of detection.Sec.138 of IRA-
