References have been received from Department of Telecom, D/o Revenue and Central Secretariat (Promotee Assistants) Association seeking clarification regarding admissibility of DA on Transport Allowance at pre-revised rates from 01.07.2016 (@132%) and from 01.01.2017 @ 136%

2. As per recommendations of 7th CPC, rates of Transport Allowance had been revised w.e.f. 01.07.2017. Details of rates during 6th CPC and as prescribed by 7th CPC are given below:

3. It may be seen from the above table that rates of Transport Allowance as recommended by 7th CPC are inclusive of DA @ 125% as on 01.01.2016.

4. It is clearly mentioned in the Resolution dated 25.07.2016 that till a final decision on Allowances is taken based on the recommendations of this Committee, all Allowances will continue to be paid at existing rates in existing pay strucutre, as if the pay had not been revised with effect from 1st day of January, 2016.” Therefore, between 01.01.2016 and 30.06.2017, no DA had been allowed on any Allowance.

5. In case, if the enhanced rate of DA i.e. 132% w.e.f. 0.07.2016 & 136% w.e.f. 01.01.2017 given for pre-revised pay scale of 6th CPC, is allowed on Transport Allowance rates as per 6th CPC, it would exceed the rates of Transport Allowance as recommended by the 7th Central Pay Commission which is not permissible. Therefore, we may clarify to D/o Telecommunication, D/o Revenue and Central Secretariat Association (Promottee Assistants) that enhanced rate of DA on 6th CPC rates of Transport Allowance from 01.07.2016 to 30.06.2017, is not admissible. Kindly see for consideration.

Kind attention of Railway Board is invited to the references cited above.

NFIR reiterates that pursuant to issuance of instructions dated 17/08/2017, situation has arisent wherein the Railway employees in Pay Level 3, drawing pay Rs. 21,700/- and above and also upto Pay Level 8 hitherto entitled for Transport Allowance @ Rs. 3600 + DA thereon (in A1/A class cities and in other cities @ Rs 1800 + DA thereon) have been deprived of the said rate (due to the new norm for entitlement)

In this context, Federation furnishes below the rates granted pursuant to acceptance of the recommendations of the 5th CPC and 6th CPC:-
(a) Recommendations of 5th CPC – Transport Allowance
RBE No. 179/1997 (rates w.e.f 01/08/1997)

From the above, it could be seen that those in pay scale below Rs.6500-10500 i.e. upto Rs. 6000-9800 (S1 to S10A) were allowed Transport Allowance at the uniform rate of Rs. 100/- p.m. in A1/A class cities irrespective of their pay.
(b) After introduction of 6th CPC Pay Band/Grade Pay, the Railway Board vide circular (RBE No. 111/2008 – effective from 01/09/2008 and RBE No. 95/2015) had prescribed following rates for payment of Transport Allowance to the employees.

A comparison of two tables mentioned above, reveals that Railway employees were allowed higher rate of Transport Allowance on their drawing pay Rs. 7440/- irrespective of Grade Pay/Pay Band. However, the modified Board’s instructions issued vide letter dated 03/08/2017 and 17/08/2017,have deprived the Transport Allowance @ Rs. 3600+DA thereon to those in Pay Level 1 and 2 (7th CPC) due to imposition of restriction i.e. reaching the pay Rs. 24700/- Federation, therefore requests the Railway Ministry to kindly refer the matter to Ministry of Finance, for mitigating the problem.

Ref:

(i) Railway Board’s letter No.PC/V/2017/A/TA/1 dated 17/08/2017 (RBE No.9612017).
(ii) NFIR’s letter No.IV/NFIR/7CPC/Allowance/2016/Part I dated 28/08/2017.
(iii) Railway Board’s letter No.PC-V/2015/PNM/NFIR/4 dated 17/20-1l-2017.

Federation does not agree with the view taken by the Railway Ministry in this case as conveyed to NFIR vide Board’s letter dated 17/20-11-2017. Federation wants that the Railway Ministry should prepare proper case based on the facts and contentions of NFIR as explained in our letter dated 28/08/2017 tobe placed before DoP&T/MoF.

  1. Federation reiterates that as a result of issuance of instructions dated 17/08/2017, a situation has arisen wherein the Railway employees in Pay Level 3, drawing pay Rs. 21,700/- and above upto Level 8 hitherto entitled for Transport Allowance @ Rs. 3600 + DA thereon (in A1/A class cities and in other cities @ Rs.1800 + DA thereon) have been deprived of the said rate due to the new norm for entitlement only when their pay reaches Rs.24,2001/-.

III. Further it is relevant to take note that pursuant to acceptance of the recommendations of 5th CPC and 6th CPC, the rates revised as follows:-

(a) Recommendations of 5th CPC – Transport Allowance RBE No. 179/1997 (rates w.e.f. 01/08/1997)

Above position reveals that all the employees working in pay scale below Rs. 6500-10500 i.e. upto Rs. 6000-9800 (S1 to S10A) were allowed Transport Allowance at the uniform rate of Rs. 100/- p.m. in A1/A class cities irespective of their pay.

(b) The Railway Board vide circular (RBE No.111/2008 – effective from 01/09/2008 and RBE No.95/2015) had prescribed following rates for payment of Transport Allowance to the  Railway employees.

  1. From the comparison of two tables mentioned above, it could be seen that the Railway employees were allowed higher rate of Transport Allowance on drawing pay Rs. 7440/- irrespective of Grade Pay/Pay Band. The modified Board’s instructions issued vide letter dated 03/08/2017 and I7/08/2017, have deprived the Transport Allowance @ Rs. 3600+DA thereon to those in Pay Level 1 and 2 (7th CPC) due to imposition of restriction i.e. reaching the pay Rs.24700/- ignoring the fact that the staff were already drawing pay @ Rs.7440 in 6th CPC Pay Band/Grade Pay.

Federation, therefore requests the Railway Ministry to kindly anange to make out case in the light of NFIR’s contentions for rendering justice to those staff of Pay Level 1 & 2 for granting Transport Allowance at rate i.e. 3600/- + DA thereon when they reach the corresponding pay @ Rs.21700/- and not 24200/- to meet the ends of justice and refer to MoF.

A copy of the reference made to the MoF may be endorsed to the Federation for taking follow up action.

Sub: Government’s decision on recommendation of the 7th Central Pay Commission -Transport Allowance to the Railway employees – Deprivel of higher rate to those working in pay Level 1 & 2-reg.

Ref: Railway Board’s letter No. PC-V/2017/A/TA/1 dated 17/08/2017 (RBE No.96/2017).

NFIR invites kind attention of the Railway Board to the modified instructions issued vide Board’s letter dated 17/08/2017 on payment of Transport Allowance at revised rates, stating that the Railway employees who are drawing pay of Rs.24,200/- & above in Pay Level 1 & 2 of the 7th CPC Pay Matrix are entitled for Transport Allowance @ Rs.3600 plus DA thereon in cities mentioned in the Annexure to Board’s letter dated 03/08/2017 and @ Rs.1800 plus DA thereon at all other places.

In this connection, Federation desires to state that with the issuance of instructions dated 17/08/2017, an anomalous situation has arisen wherein the Railway employees in Pay Level 3, drawing pay Rs. 21,700/- and above upto Level 8 are entitled for Transport Allowance @ Rs. 3600 + DA thereon (in Al/A class cities and in other cities @ Rs. 1800 + DA thereon), while those in Pay Level 1 & 2 are made eligible for the Transport Allowance at the said rate (i.e. Rs. 3600/- + DA thereon) on reaching the Pay of Rs. 24,200/- and above.

Federation further desires to state that pursuant to the recommendations of 5th CPC and 6th CPC, the following instructions were issued:-

From the above, it could be seen that the employees were allowed higher rate of Transport Allowance on reaching the pay @ Rs.7440/- irrespective of their Grade Pay (PB-) viz., GP 1800,1900,2000,2400,2800.

The above position shows that the Board’s instructions dated 03-08-2017 and 17-08-2017 have deprived the Transport Allowance at Rs.3600/- + Da thereon to the staff working in pay Level 1 & 2 of 7th CPC Pay Matrix due to the restriction that such higher rate of Transport Allowance is allowed on reaching the pay of Rs.24,200, inspite of the fact that they were already drawing higher rate when their pay was Rs.7,440/- in 6th CPC Grade Pay 1800,1900,2000,2400 and 2800.

Federation contends that the ends of justice would be met if the Railway employees working in Pay Level 1 & 2 are also allowed payment of Transport Allowance at higher rate i.e.Rs.3600/- + DA thereon when their pay is Rs.21,700/- instead Rs.24,200/-.

NFIR, therefore, requests the Railway Board to make out a case and refer the matter to the Ministry of Finance for removal of aberration for ensuring justice to lower level staff (i.e.Pay level 1 and 2 also). A Copy of the reference made to the Ministry of Finance, may be provided to the Federation for follow up action.

7th CPC Transport Allowance 7440 issue settled

7th CPC Transport Allowance 7440 issue settled for Matrix Level 1 and 2 (Grade Pay 1800 and 1900)

Department of Expenditure issued an important amendment order regarding Transport Allowance on 2nd August, 2017. Central Government employees who are drawing pay of 24200 and above in Pay Level 1 and 2 of the Pay Matrix, shall be eligible for grant of Transport Allowance 3600 for TPTA Cities and 1800 for all Other Places.

The Central Government employees those who were in Grade Pay 1800 and 1900 and their pay in the pay band equivalent to 7440 and above eligible for higher Transport Allowance.

So, 7440 is now changed as 24200

 OFFICE MEMORANDUM

Subject:- Implementation of the recommendations of the 7th Central Pay Commission relating to grant of Transport Allowance to Central Government employees.

 In partial modification of this Department’s OM. of even number dated 07.07.2017 regarding implementation of the recommendations of the Seventh Central Pay Commission relating to grant of Transport Allowance to Central Government employees, the President is pleased to decide that Central Government employees who are drawing pay of Rs.24200/- & above in Pay Level 1 & 2 of the Pay Matrix, shall be eligible for grant of Transport Allowance @ Rs.3600/- plus D.A. thereon at the cities mentioned in the Annexure to the above cited OM. and @ Rs.1800/- plus D.A. thereon at all Other Places.

2. All other contents of the above cited OM. dated 07.07.2017 shall remain unchanged.

3. These orders shall be effective from 1st July, 2017.

4. These orders will apply to all civilian employees of the Central Government. The orders will also apply to the civilian employees paid from the Defence Service Estimates. In respect of the Armed Forces Personnel and Railway employees, separate orders will be issued by the Ministry of Defence and Ministry of Railways, respectively.

5. In so far as the persons serving in the Indian Audit and Accounts Department are concerned, these orders issue in consultation with the Comptroller & Auditor General of India.

Hence, it is enjoined upon all concerned that, claim of the Govt. servant, who commence journey on or after 1st July 2017, may invariably to be indicated with Pay Levels of the Pay Matrix positively, to process the same as per entitlement at this end.

1 , Attention is invited to this Directorate OM of even number dated 26.04.2017 vide which rate of remuneration of the Gramin Dak Sevaks engaged as substitutes in short term department vacancies of Postmen, Mail Guards and MTS was issued. In this context, references are being received from Service Unions that the words “In future” and “with effect from 01.01.2016″ in the Para 3 of the said OM dated 26.04.2017 give different impression over date of implementation of the instructions and has requested to issue clarification.

2. The matter has, further, been examined in this Directorate in the light of the approval of Department of Expenditure, Ministry of Finance and it is clarified that the orders contained in the ibid OM dated 26.04.2017 (copy attached) are to be implemented w.e.f. 01.01.2016.

Subject: Remuneration to be paid to the Gramin Dak Sevaks engaged as substitutes in short term vacancies of Postmen/Mail Guards and MTS.

Consequent upon the implementation of the Seventh Pay Commission’s recommendations, the matter regarding the rates of remuneration payable to Gramin Dak Sevaks engaged as substitutes in short term departmental vacancies of Postmen/Mail Guards and MTS has been reviewed.

2. It has now been decided that the remuneration of the Gramin Dak Sevaks engaged as substitutes in short term departmental vacancies of Postmen, Mail Guards and MTS may be calculated on the basis of the minimum pay of the respective levels of the pay matrix in whiCh the substitute is engaged as defined in the CCS (Revised Pay) Rules 2016 and as mentioned in Table below:

Subject:- Implementation of the recommendations of the 7th Central Pay Commission relating to grant of Transport Allowance to Central Government employees.

Consequent upon the decision taken by the Government on the recommendations of the Seventh Central Pay Commission, the President, is pleased to decide that Transport Allowance shall be admissible to Central Government employees at the following rates:-

2. The grant of Transport Allowance shall be subject to the following conditions:-

(ii) In respect of those employees who opt to continue in their pre-revised Pay-structure/Pay Scales, the corresponding Level in the Pay Matrix of the post occupied on 01.01.2016 as indicated in CCS (Revised Pay) Rules, 2016 would determine the allowance under these orders.

(iii) Physically disabled employees as mentioned in DoE O.M. No. 19029/1/78-E.IV(B) dated 31.08.1978 and subsequent orders in respect of the categories viz. visually impaired, orthopaedically handicapped, deaf and dumb/hearing impaired, spinal deformity, shall continue to be paid Transport Allowance at double the normal rates, subject to fulfilment of the stipulated conditions, which shall, in no case, be less than Rs.2250/- p.m. plus applicable rates of Dearness Allowance

(iv) Officers drawing pay in Levels 14 and above in the Pay Matrix, who are entitled to the use of official car in terms of Department of Expenditure’s O.M. No.20(5)-E.II(A)/93 dated 28.01.1994, shall be given the option to avail the official car facility or to draw Transport Allowance at the rates of Rs.15,750/- p.m. plus Dearness Allowance thereon. Before, allowing Transport Allowance @ Rs.15,750/- plus D.A. thereon, the option exercised by an officer will be examined by the administrative Ministry and his/her entitlement to the use of official car in terms of the OM. dated 28.01.1994 ibid will require to be certified by the competent authority. In case, an officer opts to draw Transport Allowance @ Rs.15,750/- p.m. plus D.A. thereon, he/she will not be allowed to change his/her option during the remaining period of his/her current assignment.

3. Admissibility of Transport Allowance during the following circumstances:-

(a) During leave: The allowance will not be admissible for the calendar month(s) wholly covered by leave.

(b) During deputation abroad: The allowance will not be admissible during the period of deputation abroad.

(c) During tour: If an employee is absent from the Headquarters/Place of Posting for full calendar month(s) due to tour, he/she will not be entitled to Transport Allowance dun’ng that/those calendar month/months. However, If the absence does not cover any calendar month(s) in full, Transport Allowance will be admissible for full month.

(d) During training treated as duty: The allowance may be granted during such training, if no Transport Facility/Travelling Allowance/Daily Allowance is provided for attending the training institute. During official tour in the training course, the allowance will not be admissible when the period of the tour covers the whole calendar month. Also, during training abroad, no Transport Allowance will be admissible when the period of such training covers the whole calendar month.

(e) During inspection/survey duty by Members of Special Parties within the city but exceeding 8 kms. from the Headguarters OR during continuous field duty either in or outside the Headquarters: Transport Allowance is given to compensate for the expenditure incurred for commuting for both to and fro between the place of duty and residence. in case when one gets Road Mileage/Daily Allowance or free transportation for field/inspection/survey duty or tour for a period covering the whole calendar month, he/she will not be entitled to Transport Allowance during that calendar month.

(f) To vacation staff : Vacation staff is entitled to Transport Allowance provided no free transport facility is given to such staff. However, the allowance shall not be admissible when such vacation spell, including all kinds of leave, cover the whole calendar month(s).

(g) During suspension: As a Government employee under suspension is not required to attend office, he/she is not entitled to Transport Allowance during suspension where suspension covers full calendar month(s). This position will hold good even if the suspension period is finally treated as duty. Where suspension period covers a calendar month partially, Transport Allowance payable for that month shall be reduced proportionately.

4. These orders shall be effective from 1st July, 2017.

5. These orders will apply to all civilian employees of the Central Government. The orders will also apply to the civilian employees paid from the Defence Service Estimates. In respect of the Armed Forces Personnel and Railway employees, separate orders will be issued by the Ministry of Defence and Ministry of Railways, respectively.

6. in so far as the persons serving in the Indian Audit and Accounts Department are concerned, these orders issue in consultation with the Comptroller & Auditor General of India.

Sub: Implementation of recommendations of the Committee on Allowances

We are quite thankful that after a long wait the Union Cabinet has given its approval for implementation of recommendations of the Committee on Allowances(Ashok Lavasa Committee) as recommended by the VII CPC.

As you are aware that, during the meeting of the Empowered Committee, held under your Chairmanship, we had requested for its early implementation, but unfortunately a long time has been taken by the said committee for finalizing the allowances.

We are thankful to the Government of India for agreeing in principle for House Rent Allowance @ 10%,20% and 30% to the Central Government Employees working in levels 1 to 3, but depriving other staff, particularly Group ‘C’ staff, which has resulted in lot of discontentment among the Central Government Employees. Staff Side(JCM) is also thankful to the government for reducing 50% Dearness Allowance barrier to 25% for future enhancement of HRA to 09,18 and 27% and restoring 10,20 and 30% on 50% Dearness Allowance, but at the same time would have appreciated if the same formula should have been envisaged for other allowances which are DA indexed.

We are also thankful to the Central Government for revising various allowances, including Breakdown Allowance, Nursing Allowance, Trip Allowance, Additional Allowance, Cycle Allowance, Cash Handling Allowance etc. as also Special Allowance to Trackmen, Section Controllers and Loco Pilot (Goods) and Sr. Passenger Guards and extending Patient Care Allowance to Ministerial Staff working in the hospitals. We also appreciate the government for enhancing the rate of Fixed Medical Allowance from Rs.500 p.m. to Rs.1000 p.m. for the Pensioners. Though it is meager to old-aged pensioners, healthcare and at least Rs.2500 should have been granted.

The date of implementation of the allowances, as announced, w.e.f. 01.07.2017, has created lot of anguish and serious discontentment in the Central Government Employees. We will appreciate if the government considers its implementation w.e.f. 01.01.2016, i.e. date of implementation of VII CPC.

Minimum Wage and Fitment Formula was one of the major demands in our Strike Notice, for which government formed a committee, unfortunately, up-till now nothing substantial has been done in this regard. Staff Side(JCM), therefore, requests that, a meeting should be called and the matter be resolved at an earliest.

The government has also constituted a Committee on National Pension System(NPS) and it was assured to us that, decision in the matter would be taken within four months. Unfortunately, up-till now, this issue remains unresolved. We earnestly hope that, the government will definitely consider the demand of the Staff Side – Guaranteed Minimum Pension for new Pensioners (appointed on or after 01.01.2004) as well as Family Pension at par with Old Pensioners/Family Pensioners.

We always believe in best industrial relations, but to keep industrial peace, we hope, the government will take appropriate steps to resolve the long pending demands of the Central Government Employees at an
earliest.

Transport Allowance Ready Reckoner – To know the Difference between 6th CPC and 7th CPC

We are in the process of Preparing Transport Allowance Ready Reckoner to know the amount of TA to be paid in 7th pay Commission.

We have brought one issue to the light that the Government Servants placed in Level 1 and Level 2 and Pay in PB equivalent to 7440 and above in Sixth CPC will be getting less amount of Transport Allowance in 7th CPC than 6th CPC.

Transport Allowance Rates in Sixth CPC

There were Five Grade pay Levels in PB-I ie Rs.1800, Rs.1900, Rs.2000 and Rs.2400 and Rs.2800 All these GPs were brought under one Group for Transport Allowance at Lower rate, subject to not exceeding Rs.7440 Pay in the Pay band

In Sixth CPC those who were in the category of GP below 4200 and Pay band below 7440 were entitled for TA only at the Rate of Rs.600+DA for A1/A cities and Rs.300+DA for other cities. But The sixth CPC had relaxed the condition for this Group to get Transport Allowance at the next higher rate of Rs.1600 for A1/A cities and Rs.800 for other cities. Those who Reached the Rs.7440 PB level and above were entitled for the above-mentioned rates.

Groups realigned for Higher TA rates

Now, the 7th CPC might have thought that there is no point in Keeping the GP 2000, GP 2400, GP 2800 Levels at Lower TA rate, as they would become entitled for next higher rate of Transport Allowance at the initial stage itself. So it was a wise decision to bring them into the Group that is eligible for Transport Allowance at the rate of Rs.3600 +DA [Higher TPTA Cities] and Rs.1800+DA [other Places] in 7th CPC.

But, though the lowest Two Grade Pay Levels (Pre-Revised Rs.1800 GP and 1900 GP) are made eligible for TA @ Rs.1350+DA [ Higher TPTA Cities] and Rs.900+DA [Other Places] in 7th CPC, there are cases that some Govt Servants those were in 1900 GP and crossed 7440 were drawing TA at the rate of 1600+DA in Sixth CPC. Now they will be entitled for TA at the rate of Rs.1350+DA in Seventh CPC.

Transport Allowance Ready Reckoner Coming soon

So it will be useful, if Transport Allowance Ready Reckoner for both Sixth CPC and 7th CPC for Pay in the Pay Band upto 7440 is available. So that we can find the difference between amount of TA in Revised and Pre-Revised Rates for this category. We are currently in the process of finalising Transport Allowance Ready Reckoner. We will publish the 7th CPC TA Ready Reckoner as soon as possible.

Cabinet Committee has decided to implement the recommendations of 7th CPC on Transport Allowance without any change.

In its official report, “For most of the allowances that were retained, the 7th CPC recommended a raise commensurate with inflation as reflected in the rates of Dearness Allowance (DA). Accordingly, fully DA-indexed allowances such as Transport Allowance were not given any raise. Allowances not indexed to DA were raised by a factor of 2.25 and the partially indexed ones by a factor of 1.5. The quantum of allowances paid as a percentage of pay was rationalised by a factor of 0.8.”

New Delhi: The Transport Allowance for central government employees will not be hiked and remain the same as 6th Pay Commission recommendations including Dearness Allowance(DA).
The Finance Ministry today informed about the report of the ‘Committee on Allowances’, headed by Finance Secretary Ashok Lavasa and said no hike in Transport Allowance (TPTA) for central government employees in its report. The committee accepted the 7th Pay Commission recommendation in this regard, which was announced earlier.

The Pay Commission has revised the Transport allowance (TPTA), which is given below:

The Pay Commission made report, assuming that the rate of Dearness Allowance 125 percent at the time of implementation of the pay commission recommendation, i.e. on January 1 next year.
Accordingly, the employees will not get any hike in Transport allowance on the time of implementation of the pay commission recommendation as the existing Transport allowance figure automatically reached the Pay Commission revised Transport allowance figure after adding 125 percent DA.

“In partial modification, the committee has further decided that the current HRA slab, which is 30 per cent of basic pay, for metros would continue,” according to the sources.

However, the pay commission had recommended reducing the house rent allowance (HRA) to 24 per cent of basic pay as against the 30 per cent of basic pay employees were drawing under the Sixth Pay Commission.

The government has given higher basic pay with arrears, effective from January 1, 2016 in August 2016 to its employees on the recommendations of the 7th pay commission but referred hike in allowances to the Committee on Allowances.

Usually, once the recommendations of the pay commission are approved, the increase in basic pay is followed by an increase in allowances.

The hike in allowances, most probably to implement from the month of April and the Finance Minister Arun Jaitley may announce it after ending the model code of conduct on March 8.

One of the NJCA leader, On Condition of Anonymity, told that the committee constituted to examine the allowance has finalized its reports and submitted it to the Government on 22nd February 2017.

On asking whether the NJCA knew the details of the committee report, he said that they were not provided with the committee report. But the committee has informed them that their demand on allowance would be considered favorably.

Hence it is expected the HRA will be retained in old rates (Sixth CPC rates) from the beginning itself and will be paid in 7th CPC Pay Scale when revised allowances come into effect. However, the news of revised allowances would be implemented with effect from 1.4.2017 is not reliable. NJCA will not accept this and clearly said that it should be implemented with effect from 1.1.2016 retrospectively.

Transport Allowance may be split into two elements as CCA and TA as it was paid in fifth CPC. The Rates will be delinked from DA and will Fixed in slab rates.

ARREARS ON ALLOWANCES INCLUDING HRA AND TRANSPORT ALLOWANCE IS GOING TO BE REJECTED:

Now it has become clear that the Government has constituted the Allowance Committee headed by Finance Secretary, mainly to delay the implementation of enhanced allowances and finally deny the arrears by implementing the revised allowance either from 01-01-2017 or from 01-04-2017. The four months time fixed for the Allowance Committee is already extended to six months upto 22-02-2017. Reserve Bank Governor, Dr. Urjit Patel had hinted to the media that the burden of payment of arrears during this financial year will not be there, meaning that Government may not give retrospective effect to the revised allowances. The RBI Governor, Dr. Urjit Patel made the following observations, which is published in the RBI website.

“The extension of two months given to the Ministry of Finance to receive the notification on higher allowances under the Pay Commission’s award could push its fuller effect into the next financial year rather than this financial year”.

Further, the Allowance Committee has not held any negotiation with the JCM Staff Side. It just heard the views of the staff side. The request of the JCM staff side to hold one more meeting with staff side NJCM was not favourably considered by the Finance Secretary, who is the Chairman of the Allowance Committee. No indication is given as to whether the percentage of HRA recommended by 7th CPC will be enhanced to 30%, 20% and 10%. The fate of other allowances are also the same. Unless NJCA take a firm stand and negotiate with the Government by reviving the indefinite strike, the employees will be placed in a desperate and helpless situation, if Government is allowed to unilaterally declare the HRA and other allowances, without retrospective effect from 01-01-2016, and also without much modification, thereby denying crores of rupees as arrears.

Subject: Grant of Transport Allowance at double the normal rates to deaf and dumb employees of Central Government.

In supersession of this Department 0.M.No.21(2)/2011-E-11(B) dated 19.02.2014 regarding admissibility of Transport Allowance at double the normal rates to employees who are deaf and dumb, the undersigned is directed to say that the matter has been re-examined and it has been decided with the approval of Competent Authority that Transport Allowance at double the normal rates is admissible to Hearing Impaired employees also in addition to employees who are both deaf and dumb.

2. Transport Allowance at double the normal rates would be admissible to the ‘Hearing Impaired employees having loss of sixty decibels or more in the better ear in the conversation range of frequencies’ as per Persons With Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995.

3. The admissibility of Transport Allowance at double the normal rates to above categories of employees is subject to recommendation of the Head of ENT Department of a Government Civil Hospital and fulfilment of other conditions applicable in respect of other disabilities mentioned in D/o Expenditure’s O.M. No. 19029/1/78-E-IV (B) dated 31st August, 1978 read with 0.M.No.21(2)/2008-E.11(B) dated 29.08.2008.

Sub: Brief of the second meeting of the Committee on Allowances held today under the chairmanship of Secretary, Finance(Expenditure), Government of India

To obtain the views of the National Council(Staff Side)(JCM) on the recommendations of 7th CPC relating to Allowances, the second meeting of the Committee on Allowances held today under the chairmanship of Secretary, Finance(Expenditure), Government of India, with the National Council(Staff Side) JCM.

From the Official Side, Secretary(Defence), Home, DoP&T, Postal, Chairman Railway Board, J.S.(Estt.), J.S.(Pers.) and J.S.(IC), and from Staff Side(JCM), all the Standing Committee Members were present in the meeting.

At the outset, Secretary(Staff Side)(JCM) as well as Leader(Staff Side)(JCM) and other Standing Committee Member of the NC/JCM(Staff Side) expressed their anguish for non-formation of High Level Committee as was agreed to by the Group of Ministers(Government of India) for settling the issue of Minimum Wage and Multiplying Factor.

The Secretary, Finance(Expenditure) told that, the committee constituted under the chairmanship of Addl. Secretary(Exp.) with J.S.(Pers.), JS(Estt.) and JS(Imp.) as Members has been made only for this purpose. Let us believe that, after the meeting, report of the said committee would be sent to the Government of India for its acceptance.

The Secretary, Finance(Expenditure) asked the Staff Side(JCM) to give their viewpoint in a Note on the Common Demands to implement these, and the Departmental grievances to their respective departments, and after that, a meeting will again be called.

Staff Side(JCM) strongly demanded that, date of effect of Allowance should be 01.01.2016. The Staff Side(JCM) explained its position as well about its demand that, House Rent Allowance should be 10%, 20% and 30% and Transport Allowance must be rationalized and exempted from the Income Tax, Children Education Allowance should be Rs.3,000 and Hostel Subsidy should be Rs.10,000 and these should also be exempted from the Income Tax.

Staff Side demanded that, Post Graduate and Professional Courses should also be covered in Children Education Allowance. The issue of Special Duty Allowance was also raised for N.E. Region by the Standing Committee Members of JCM(Staff Side). Fixed Medical Allowance should be Rs.2,000 with Dearness Allowance Indexation, Over Time Allowance must be given, Small Family Allowance should be continued and Dress Allowance needs to be reviewed. Various Departmental Allowances, which have been abolished, should be allowed to continue, like Breakdown Allowance in the Railways and Fixed Conveyance Allowance to Postal Department employees. All the Standing Committee Members raised various issues related to Allowances.

Subject:- Clarification on admissibility of Transport Allowance in the eases where the officers are drawing Grade Pay of Rs.10,000/- in PB-4 – regarding.

Reference is invited to this Department’s Office Memorandum No.21(2)/2008-E.11(B) dated 29.08.2008. Para `3? of the O.M. stipulates that Officers drawing Grade Pay of Rs.10,000/- & above and those in the HAG+ Scale, who are entitled to the use of official car in terms of Department of Expenditure (DoE) O.M. No. 20(5)/E.II(A)/93 dated 28.01.1994, shall be given the option to avail themselves of the existing facility or to draw the Transport Allowance at the rate of Rs.7,000/- p.m. plus Dearness Allowance thereon.

2. Several references have been received in this Department seeking clarification on the admissibility of Transport Allowance to officers drawing Grade Pay Rs.10,000/- under Dynamic ACP Scheme or NFU Scheme. A few cases have also been filed in the Courts in this regard. Hon’ble Central Administrative Tribunal (CAT), Principal Bench, New Delhi, in Order dated 13.05.2014 in U.A. No.4062/2013 filed by Shri Radhacharan Shakiya & Others V/s Union of India & Others, held that the Applicants were not entitled to draw Transport Allowance @ Rs.7,000/- pm. plus DA thereon. The said order of the Tribunal has also been upheld by Hon’ble High Court of Delhi in their Order dated 03.09.2014 passed in Writ Petition (Civil) No. 3445/2014, filed by Shri Radhacharan Shakiya & Others,

3. Accordingly, it is clarified that the officers, who are not entitled for the use of official car for commuting between residence to office and back, in terms of DoE’s OM 20(5)/E-II(A)193 dated 28.01.1994, are not eligible to opt for drawal of Transport Allowance @ Rs.7000/- p.m. + DA thereon, in terms of DoE O.M. No.21(2)/2008-E.II(B) dated 29.08.2008, even though they are drawing Grade Pay of Rs.10,000/- in PB-4 under Dynamic ACP Scheme or under the scheme of Non-Functional Upgradation (NFU).

Budget 2016: Assocham demands income tax exemption to Rs 2.5 lakh, re-introduce standard deduction

 

New Delhi: Industry body Assocham demanded an increase in income tax exemption ceiling for salaried people to Rs 2.5 lakh and and re-introduce standard deduction for salaried employees to boost consumption in the upcoming Budget.

 

The income tax exemption ceiling at present is Rs 1.5 lakh.

 

“And re-introduce the concept of standard deduction for salaried employees who can then give a boost to consumption demand and boost economic growth,” Assocham said in a release.

 

Besides, Assocham has also pitched for revision of the deduction of interest on housing loans to at least Rs 3 lakh from the existing Rs 2 lakh and a similar limit be set for principal loan repayment from Rs 1 lakh at present.

 

Explaining the rationale for its demand for standard deduction, it said the salary of the employees has gone up moving along with inflation and other cost factors.

 

“So in order to benefit the salaried employees, the standard deduction should be reintroduced as one-third of salary or Rs 2,00,000 whichever is less”.

 

It has also suggested a depreciation allowance for salaried tax-payers in line with professionals.

 

Assocham said the deduction of depreciation is allowed under the head ‘Business and Profession’. No tax benefit is accrued to the salaried employees when they add assets. Though the assets get depreciated when owned by an employee, tax laws do not recognise this.

 

Moreover, to help salaried employees, it has suggested for leave encashment exemption limit for tax calculation to be raised to Rs 10 lakh.

 

“The current limit of Rs 3 lakh was notified by the CBDT way back in 1998 and needs to be raised substantially,” Assocham President Sunil Kanoria said.

 

Further, it has also asked for re-fixing of monetary limits under HRA/transport allowance and children education.

 

For the salaried employees, transport allowance is presently exempt from tax up to Rs 800 per month which should be raised to Rs 3,000 per month, it added.

 

Assocham pre-Budget memorandum to the Finance Ministry Arun Jaitley also suggested that a provision may be made in the Income Tax Act that any expenditure incurred by an employee for education of under-privileged children by making payment directly to a recognised school should be allowed as deduction from salary income up to Rs 1,000 per month for maximum of two children.
