Sub: Waiver of requirement of producing two pensioners drawing pension from same PDA to identify the pensioner.

During various Defence Pension Adalats, representations are being received against the requirement of producing two pensioners drawing pension from same PDA to identify pensioner.

The issue has been examined and it is noticed that various checks to be observed by the Pension Disbursing Authorities (PDAs) before making payment for first time on new Pension Payment Orders (PPOs)/transferred PPOs are provided in para 584 of DPPI-2005 & 2013. Similarly, these checks were circulated to the PDAs as Annexure-A to important Circular No.113 dt 27/05/2005. Item No. 7 and No. 15 of DPPI and Annexure-A to above mentioned circular respectively states that two defence pensioners should identify a new pensioners (except officer).

Now a days, requirement of producing two pensioners drawing pension from same PDA to identify the pensioner which is applicable to the pensioners below officer ranks does not seem correct, as PDAs are required to identify the pensioner based on marks of identification furnished in Descriptive Rolls/Descriptive Particulars and photographs provided to them.

Accordingly PDAs are requested to refer this office circular No. 197 dt 10/01/2018, and follow the guidelines issued there under for identification by additional documents produced by defence pensioners in absence of Aadhaar Number as indicated in Notification No. S.0 747(E) dt 03/03/2017 issued by Ministry of Defence, Deptt. of ESW rather than insisting the pensioner to produce two pensioners drawing pension from same PDA to identify him/her.

Sub: Transfer of pension account from one Pension Disbursing Authority (PDA) to another PDA.

Provisions for Transfer of pension account from one Pension Disbursing Authority (PDA) to another PDA has been provided in the Defence Pension Payment Instructions (DPPI) as well as Scheme for Payment of Defence Pensions by Public Sector Banks. But, it has been observed that the PDAs are not following laid down procedure in the matter. Hence, the competent authority has decided that following procedure is required to be adopted in the matter.

(i) Pensioner shall submit a simple application (in Part-I of the enclosed formats) along with Pension Certificate (where issued to him) to the PDA from where he is drawing pension at present. A copy of application may be returned to the pensioner duly giving the receipt of the application by the PDA for the records of the pensioner.

(ii) The following documents are required to be forwarded by the existing PDA to the new PDA by registered post.

(a) PPO (including all Corrigendum PPOs) and Payment Authority (if any issued)

(b) Descriptive Roll/Identification Documents with Photographs.

(c) Extract of Payment Register with a certificate thereon indicating the rate of Pension and Dearness relief and date upto and for which last paid. Where the pensioner has been allowed commutation of pension, the PDA should also indicate prominently in the Last Pension Certificate, the date of payment of capitalized value of pension, the date of reduction of pension on account of commutation and the date on which he would complete 15 Years for restoration of his commuted portion of pension.

(d) Nomination to receive arrears of pension

(e) Option 85 undertaking furnished by the pensioner for Medical Allowance

(f) Pension Certificate (where issued)

(iii) In the current scenario, most of the PPOs are issued e-PPO form. Hence, it has been decided that transferor PDA will forward the documents mentioned above as well as copy of e-PPO received through SFTP from this office duly countersigned by him to the new PDA as per existing system.

(iv) Further payments in continuation of the date upto and for which the pensioner is shown as paid on the Extract of Payment Register, will be arranged by the new PDA.

(v) An intimation regarding the transfer of pension papers should invariably be sent both by the transferor/ transferee PDA to the Pr. CDA (Pensions) Allahabad through Form-I/IMP-5(A)/D-II by the transferor PDA (under Part-II of the enclosed format) and Form­II/IMP-5/D-I by the transferee PDA (under Part-III of the enclosed format) as per prevailing procedure by registered post as well as on e-mail ID: dad@hub.nic.in

(2) While forwarding Form-I/IMP-5(A)/D-II to this office by the transferor PDA, following documents are also required to be attached with Form­I/IMP-5(A)/D-II:

(i)  A consent (in Part-IV of the enclosed format) from the new PDA that after receipt of documents from the existing PDA, his/her pension will be paid after taking on the payment strength of the new PDA.

(ii) A leaf of cheque issued by the new PDA duly cancelled in the case of new PDA is Bank.

(3) In the case of change of PDA from Indian Embassy, Nepal to other PDA and vice-versa, existing system for pension file routed through this office and issuance of corrigendum PPO before change of PDA will follow.

Reference:- Circular No. 546 dated 10.09.2015.

Reference is invited to para-3 of GoI, MoD letter NO. 3(1)/2015-D(Pen/Pol) dated 25.08.2015 under which it has been decided by the Government that the required undertaking /status of non re-employment /employment after retirement may be obtained by the Record Offices/Head of Offices from the retiring Defence Personnel along with other documents before his retirement.

2. The undertaking regarding recovery of overpayment, non re-employment/ employment certificate alongwith the Descriptive Roll of the retiring JCO/OR or family pensioner in case of death, shall be forwarded to the Pension Disbursing Agencies along with Pension Payment Order by the Record Office concerned following the laid down procedure. In case of pensioner drawing Pension from agencies other than bank viz Defence Pension Disbursing Office/Treasury Office etc. a copy of cancelled cheque obtained from retiring personnel shall also be forwarded by the Record Office along with Pension Payment Order to the Pension Disbursing Agencies to ensure payment of pension into the pensioners’ account.

3. Of late, it has been brought to the notice of competent authority by the banking authorities that required undertaking regarding recovery of overpayment/ non re-employment/employment certificates are not being forwarded to the banks/ PDAs along with Descriptive Roll & PPO for payment of first pension as stated above, resulting in undue delay in first payment of pensionary award.

4. Therefore, it is advised that, to ensure the prompt and timely payment of pension, required undertaking regarding recovery of overpayment and non re­employment/employment certificates after retirement along with Descriptive Roll and PPO may be forwarded to Banks/PDAs for payment of first pension. Specimen copy of undertaking regarding recovery of overpayment & non re-employment/employment certificates are enclosed for reference.

Subject:- Enhancement of Ex. Gratia ad-hoc allowance to Burma Army pensioners/family pensioners and pensioners/families of displaced Army pensioners from Pakistan who are Indian National but receiving pension on behalf of Government of Pakistan.

Reference:- This office Circular No.419 dated 06.10.2009.

A Copy of Govt. of India, Ministry of Defence, Deptt of ESW letter No. 1(5)/2017/D(Pen/Policy) dated 11.04.2018 on the above subject, which is self explanatory, is forwarded herewith for your information, guidance and necessary action.

2. Consequent upon receipt of Govt. of India, Ministry of Defence, New Delhi letter No. 1(5)/2017/D(Pen/Policy) dated 11.04.2018 ex-gratia adhoc allowance has been sanctioned on compassionate ground @ Rs. 9000/- p.m. w.e.f. 01.01.2016 to the following categories of pensioners/family pensioners:-

(a) Armed forces pensioners/family pensioners migrated from Pakistan.

(b) Burma Army pensioners/ family pensioners who are Indian national and drawing their pension in India.

(c) Burma army pensioners of Nepalese origin who are drawing pension in India and Indian Embassy, Pension Paying Offices in Nepal.

3. The categories of pensioners/family pensioners mentioned in para 2 above will also be eligible to dearness relief on the ex-gratia ad-hoc allowance at the enhanced rate under the Govt. of India, Ministry of Defence, Deptt. of ESW letter No.1(5)/2017/D(Pen/Policy) dated 11.04.2018 at the retes admissible to Central Govt. pensioners from time to time.

4. The ex-gratia ad-hoc allowance on the authority of the Govt. of India, Ministry of Defence, Deptt. of ESW letter No.1(5)/2017/D(Pen/Policy) dated 11.04.2018 will be paid by you to the categories of pensioners mentioned at para 2 above carefylly. No further authorization on this account should be awaited from this office. Further, it is stated that the para 4 of this office Circular No.419 dated 06.10.2009 will be operative. The extra liability on account to Ex-gratia adhoc allowance to Burma defence family pensioners will be borne by the Government of India.

5. The pre-revised Ex-gratia ad-hoc Allowance (including DR etc) already drawn by the above pensioners from 1.1.2016 onward shall be adjusted from the enhanced Ex-gratia Ad-hoc Allowance which shall become payable w.e.f. 1.1.2016 under these orders. Policy and procedure regarding payment of Ex-gratia Ad-hoc Allowance shall continue to be governed by the existing instructions issued in the matter so far. It may be ensured that the payment to pensioners/family pensioners indicated in para 2 above, is made into the Aadhaar linked Bank Accounts.

6. Any overpayment due for recovery may please be adjusted against the arrears now payable.

7. All other terms and conditions shall remain unchanged.

8. All PDAs are requested to identify the effective cases and revise the rate of Ex-gratia Ad-hoc allowance and render report of revision to Shri K.K.Pant, Sr.AO(P), the OI/C, Audit (Tech) Section of this office for onward submission to higher authorities.

Subject : Restoration of pension in respect of Defence Service Personnel who had drawn lump sum payment on absorption in Public Sector Undertakings/ Autonomous Bodies-delinking of qualifying service of 33 years for revised pension with effect from 01.01.2006.

Reference:- This office Circular No. 568 dated 13.10.2016 and Circular No. 592 dated 05.12.2017.

A Copy of Govt. of India, Ministry of Defence, Deptt of ESW letter No. 1(04)/2007/D(Pen/Pol) dated 20.06.2018 on the above subject, which is self explanatory, is forwarded herewith for your information, guidance and necessary action.

2. In terms of GoI, MoD letter No. 1(2)/2016-D(Pen/Pol) dated 30.09.2016, revised consolidated pension and family pension of pre-2006 Armed Forces pensioners w.e.f. 1.1.2006 shall not be lower than 50 % and 30% respectively of the minimum of the pay in the pay band plus grade pay corresponding to the pre-revised scale from which the pensioner had retired/ discharged/ invalided out/ died including Military Service Pay and “X” Group pay, if any, without pro rata reduction of pension even if they had rendered qualifying service of less than 33 years at the time of retirement.

3. Now it has been decided by the Government that while determining the revised pension of above said category of absorbe pensioners/family pensioners with effect from 1.1.2006, the pension/ family pension shall also be revised in accordance with the provisions contained in the GoI, MoD letter No. 1(2)/2016-D(Pen/Pol) dated 30.09.2016 referred above.

4. The pension in terms of this order will be revised by the respective Pension Sanctioning Authorities Suo-moto by issuing Corrigendum PPOs in all affected cases. No application in this regard shall be called for either from the pensioners or from the PDAs concerned. Further, PDAs would also brought into notice of PSAs, such left out cases, if any, for revision of pension.

5. All other terms and conditions shall remain unchanged.

Subject:- Non receipt of e-PPOs – reg.

Reference:- This office Circular No. 588 dated 20.10.2017, Circular No. 590 dated 06.11.2017 and Circular No. 595 dated 25.01.2018.

Office of the PCDA(P) Allahabad has started issuing e-PPOs for all categories of pensioners. A new PPO series was also introduced for various types of e-PPOs and subsequently range of modifications took place while adopting the process.

2. Copies of digitally signed e-PPOs are being sent electronically to PDAs and to Record Offices (ROs) concerned in case of JCOs/ORs . The RO, after scrutinising and checking the e-PPO, is required to forward a hard copy of the e-PPO (after printing from the PDF file) along with Descriptive Roll of the pensioners to PDA concerned. Record Offices (ROs) are also required to provide a copy of the e-PPO to the Armed Forces Pensioners/ Family Pensioners for their record either as a hard copy or through an e-mail as deemed fit.

3. After issuance of e-PPOs by this office, the e-PPOs are immediately forwarded to Record Offices concerned through DPCC (Defence Pension Contact Centre) functioning in the office premises of the PCDA (Pensions) Allahabad.

4. However, it has been noticed that the Record Offices (ROs) and the pensioners/family pensioners are not receiving e-PPO on time thereby causing delay in receipt of pension and other pensionary benefits.

5. In view of the above, all Record Offices are requested to instruct their representative/s to contact the DPCC (Defence Pension Contact Centre) functioning in the office premises of the PCDA(Pension) Allahabad for collection of e-PPOs issued by this office in soft copy viz. Compact Disk (CD) or in Pen Drive. Discrepancy observed in the e-PPO, if any, may be immediately brought to the notice of this office for necessary action at this end. For any query regarding collection of e-PPO, please contact Lt. Col. Palani S, Officer I/C, DPCC (E-Mail ID : dplc1pcdap@gmail.com, Phone: 0532- 2423486, Army Line : 6219).

6. Further, Record Offices are requested to ensure that e-PPOs are collected and despatched timely to PDAs alongwith Descriptive Roll so that payment of pensionary benefits are made to the pensioners/family pensioners in time.

Subject: Implementation of Government decision on the recommendations of the 7th Central Pay Commission (CPC)- Revision of Disability/ War Injury pension for Pre-01.01.2016 Defence Forces pensioners reg.

Reference: This office Circular No. 570 dated 31.10.2016, Circular No. 582 dated 05.09.2017 and Circular No. 585 dated 21.09.2017.

Copy of GOI, MOD letter No. 17(01)/2017(01)/D(Pen/Policy) dated 23rd January, 2018 on the above subject, which is self-explanatory, is forwarded herewith for further necessary action at your end.

2. In terms of Para-2 of GOI, MOD letter No. 17(01)/2017(01)/D(Pension/ Policy) dated 04th September,2017, Disability Element of Disability Pension to Armed Forces Pensioners has to be revised by multiplying the existing rate of Disability Element as had been drawn on 31.12.2015 by factor of 2.57 to arrive at revised rate of Disability Element as on 01.01.2016. Further, in terms of Para-5.2 & 5.3 of GOI, MOD letter No. 17(01)/2017(02)/D(Pension/Policy) dated 05th September’ 2017, Disability Pensionary awards has to be revised on notional pay fixation method and benefits of broad banding will be given to discharge cases also as in invalided out cases and these will be done by issuing Corrigendum Pension Payment Order (PPO).

3. Now, consequent upon the issue of GOI, MOD letter dated 23rd January, 2018, the cases where Armed Forces Pensioners who were retired/ discharged voluntary or otherwise with disability and they were in receipt of Disability/ War Injury Element as on 31.12.2015, their extent of disability/ War Injury Element shall be re-computed in the following manner given below, before applying the multiplication factor of 2.57 on existing disability/ war injury element as on 31.12.2015 for getting the revised disability/ war injury element as on 01.01.2016 in accordance to Para-2 of GOI, MOD letter No. 17(01)/2017(01)/D(Pension/ Policy) dated 04th September’ 2017.

4. The Note below Para-12 of GOI, MOD letter No. 17(01)/2016-D(Pen/Pol) dated 29th October, 2016 (circulated vide Circular No. 570 dated 31.10.2016) stands deleted. In other words, quantum of additional pension available to old age pensioners after attaining the age of 80 years and above shall also be admissible on revised disability/ war injury element.

5. It is also stated that PDAs may take utmost care during revision of Disability/War Injury Element as per this order in those cases where the pensioners who are in receipt of 50% of Disability/ War Injury Element of Disability/ War Injury Pension. If the individual has already been given rounding of benefit through PPO (in invalided out cases) then rounding of benefit in such cases should not be given. However, where his disability was assessed as 50% in discharge cases then it will be rounded to 75% as mentioned in Para-3 above. If the PDAs found any problem regarding identification of such cases the same may please be forwarded to Audit Section of this office.

6. All Pension Disbursing Agencies handling disbursement of pension to the Defence Pensioner are hereby authorized to pay benefit of rounding off disability/ war injury and additional pension as per Para 3 & 5 above without any further authorization from the concerned Pension Sanctioning Authorities.

Consequent upon introduction of Aadhaar Act, 2016, an individual eligible to receive the pension benefits is required to furnish proof of possession of Aadhaar number or undergo Aadhaar authentication.

However, Ministry of Defence, Department of Ex-Servicemen Welfare Notification No. 14(2)/2014/D (P/P)(Part-I)(copy enclosed) published in Gazette of India in 03.03.2017 vide No. S.O.747(e), provides that, till the Aadhaar is assigned to the beneficiary of pension benefits, benefits shall be given to such individuals subject to the production of certain identification documents as indicated in Notification No. S.O. 747(E).

In view of above, all the Pension Disbursing Authorities are advised to check the identification documents, as mentioned in above Notification No. S.O. 747(E), produced by defence pensioners, till Aadhaar is assigned to the pension beneficiaries. Especially as per clause b(i) and (ii) of notification No. S.O. 747(E).

New Delhi, the 3rd March, 2017

S.O. 747(E).—Whereas, the use of Aadhaar as identity document for delivery of services or benefits or subsidies simplifies the Government delivery processes, brings in transparency and efficiency, and enables beneficiaries to get their entitlements directly in a convenient and seamless manner and Aadhaar obviates the need for producing multiple documents to prove one’s identity;

And, whereas, the payment of pension is given to retired Defence Forces pensioners/ Family Pensioners (hereinafter referred to as beneficiaries) by the Department of Ex-Servicemen Welfare, Ministry of Defence in the Government of India under the Pension Regulations for Army, 1961, the Pension Regulations for Air Force, 1961, and the Pension Regulations for Navy 1964 and the pension is disbursed to beneficiaries through Pension Disbursement Agencies;

And, whereas, the aforesaid benefit of pension involves recurring expenditure from the Consolidated

Fund of India;

Now, therefore, in pursuance of the provisions of the section 7 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016) (hereinafter referred to the said Act), the Central Government hereby notifies the following, namely: —

(1) An individual eligible to receive the pension benefits is hereby required to furnish proof of possession of Aadhaar number or undergo Aadhaar authentication.

(2)  Any eligible beneficiary entitled to receive pension benefits, who does not possess the Aadhaar Number or, not yet enrolled for Aadhaar, but desirous of availing pension benefits is hereby required to make application for Aadhaar enrolment by 30th June, 2017, provided he or she is entitled to obtain Aadhaar as per section 3 of the said Act and such individuals shall visit any Aadhaar enrolment centre (list available at UIDAI website www.uidai.gov.in) to get enrolled for Aadhaar.

(3)          As per regulation 12 of the Aadhaar (Enrolment and Update) Regulations, 2016, the Ministry of Defence through Pension Disbursement Agencies or other means which requires an individual to furnish Aadhaar is required to offer Aadhaar enrolment facilities for the beneficiaries who are not yet enrolled for Aadhaar and in case there is no Aadhaar enrolment centre located in the respective Block or Taluka or Tehsil, the Ministry of Defence through Pension Disbursement Agencies or other means is required to provide Aadhaar enrolment facilities at convenient locations in coordination with the existing Registrars of Unique Identification Authority of India or by becoming Unique Identification Authority of India registrar:

Provided that, till the Aadhaar is assigned to the beneficiary of pension benefits, benefits shall be given to such individuals subject to the production of the following identification documents, namely:

(a)          Ex-servicemen Card issued by the concerned authorities; and

(b)  (i) If he or she has enrolled, his or her Aadhaar Enrolment ID slip; or

(ii) a copy of his or her request made for Aadhaar enrolment, as specified in sub-paragraph (2) of paragraph 2 below; and

any of the following documents, namely :-

(i)            Voter ID card issued by the Election Commission of India; or

(ii)           Permanent Account Number Card issued by Income Tax Department; or

(iii)          Passport; or

(iv)         Driving License issued by Licensing authority under the Motor Vehicles Act, 1988 (59 of 1988); or

(v)          Certificate of Identity having photo issued by a Gazetted officer or Tehsildar on an official letter head; or

(vi)         Address card having Name and Photo issued by Department of Posts; or

(vii)        Kisan Photo Passbook; or

(viii)       any other document as specified by the Ministry of Defence:

Provided further that the above documents shall be checked by an officer specifically designated by the Ministry of Defence for that purpose.

2. In order to provide convenient and hassle free pension benefits to the beneficiaries, the Ministry of Defence through Pension Disbursement Agencies or other means shall make all the required arrangements including following; namely:-

(1)  Wide publicity through media and individual notices shall be given to beneficiaries of pension benefits to make them aware of the requirement of Aadhaar under the scheme and they may be advised to get themselves enrolled at the nearest Aadhaar enrolment centres available in their areas by 30th June, 2017 in case they are not already enrolled and the list of locally available enrolment centres shall be made available to them.

(2)          In case, beneficiaries of pension benefits are not able to enrol due to non-availability of enrolment centres in the near vicinity such as in the block or tehsil or taluka, the Ministry through Pension Disbursement Agencies or other means is required to create Aadhaar enrolment facilities at convenient locations and the beneficiaries of pension benefits may register their request for Aadhaar enrolment by giving their name, address, mobile number with Ex-Servicemen Card and other details specified in the proviso to clause (b) sub¬paragraph (3) of paragraph 1 with their Pension Disbursement Agencies or other means or through the web portal provided for the purpose.

3. This notification shall come into effect from the date of its publication in the Official Gazette in all States and Union Territories except the States of Assam, Meghalaya and Jammu and Kashmir. Provided that this notification shall not be applicable for following categories of Pensioners or Family Pensioners, namely:—

(i)            NRI who resides in other or foreign country,

(ii)           Overseas settled Indian who is citizen of other or foreign country,

(iii)    Nepal Domiciled, Burmese and similar categories of defence pensioners.

After 1.1.2018, all PPO series except numeric PPO’s no. affixed on e-PPO’s will no longer remain in use.

Subject: Implementation of Government decision on the recommendations of the Cabinet Secretary’s Committee- Revision of pension in respect of Personnel below Officer Rank (PBOR) discharge prior to 01.01.2006.

Reference: This office Circular No. 430 dated 10.03.2010 and Circular No. 501 dated 17.01 2013.

Copy of GOI, MOD letter No. 1(8)/2015/D(Pen/Pol) dated 1st August 2016 is forwarded herewith for further necessary action at your end.

2.Table No. 59 and 60 of GOI, MOD letter No. PC10(1)/2009-D(Pen/Pol) dated 8th March 2010 indicating revised rates of pension up to 26 years in respect of ‘Naib Subedar, DSC- on clerical duties’ and ‘Naib Subedar, DSC- on other duties’ respectively, have been extended up to 28 years vide Para-1 of GOI, MOD letter dated 1st August 2016.

3.Similarly, pension rates w.e.f. 01.07.2009 in respect of ‘Naib Subedar, DSC- on clerical duties’ shown up to 26 years in Table No. 10 (DSC) of GOI, MOD letter No. 1(13)/2012/D(Pen/Policy) dated 17th January 2013, have also been extended up to 28 years as amended vide Para-2 of ibid GOI, MOD letter dated 1st August 2016.

4.All other subsidiary payment instructions will be same as already circulated vide this office Circular No. 430 dated 10.03.2010 and Circular No. 501 dated 17.01.2013.

5.It is requested that all affected cases may please be reviewed at your end and revision may be done accordingly.

6.It is also requested that a copy of these orders/ instructions may please be circulated to all Pension Disbursing Authorities (DPDOs/ Paying Branches/ Treasuries/PAOs etc.) under your jurisdiction to ensure the revision at the earliest.

7.All other terms and conditions shall remain unchanged.

Sub: Exemption of Pension/ Family Pension received with Gallantry Award.

This office is receiving representations from various agencies stating that PDAs are deducting the Income Tax on pension/family pension of the Defence Pensioners/Family Pensioners who have been granted with Gallantry Awards

2.The issue has been examined and it is found that Chapter-III of Income Tax Act-1961, which provides, vide section 10 (18) inserted by the Finance Act-1999 we. f. 01.04.2000 that incomes which do not form part of total income for the purpose of Income Tax includes the following

(i) pension received by an individual who has been in the service of the Central Government or State Government and has been awarded “Param Vir Chakra” or “Maha Vir Chakra” or “Vir Chakra” or such other gallantry award as the Central Government may, by notification in the Official Gazette, specify in this behalf:

(ii) family pension received by any member of the family of an individual referred to in sub-clause (i).

3.In view of the above all Pension Disbursing Authorities are advised to allow the benefit of exemption of Income Tax to the pensioners/family pensioners mentioned at 2(i) & (ii) above.
