Issue of Pension Slip to Defence Pensioners/family pensioners: PCDA

Issue of Pension Slip to Defence Pensioners/family pensioners: PCDA

Office of the Principal Controller of Defence Accounts (Pension),

Draupadi Ghat, Allahabad-211014

Circular No. 184

No. AT/Tech/70-XXIV

Dated: 06.06.2016

Sub: Issue of Pension Slip to Defence Pensioners/family pensioners.

Attention is drawn to RBI letter No. DGBA.GAD. N o. H-10975/45.05.031/2006-07 dated January 9, 2007 instructing all the agencies banks to issue pension slip to all the Armed Forces Personnel/Defence Civilian Pensioners including family pensioners at the commencement of pension and thereafter whenever there is a change in the quantum of pension. RBI’s above instruction was also forwarded by this office to all banks vide this office circular N o. 128 dt. 13.07.2007.

Besides above, whenever any circular was issued by this office after 6th CPC implementation, Pension Disbursing Agencies were requested to send intimation regarding disbursement of revised pension to this office in the format prescribed with the circular concerned. Pension Disbursing Agencies were simultaneously requested to provide invariably a copy of the said format to the pensioner concerned. A brief details of circulars issued and format prescribed for intimation of revision to be carried out by PDA to this office as well as pensioners is given below.

Sl.No. Circular No. & date Proforma
1.  397 dt.18.11.2008  Annexure –IV
2. 430 dt.10.03.2010 Annexure C
3. 501 dt. 17.01.2013  Annexure D
4. 502 dt. 17.01.2013 Annexure C
5. 555 dt. 04.02.2016 Annexure B
6. 57 dt. 17.09.2008  Annexure-II

However, it has been brought to the notice of this office that Pension Disbursing Agencies are not providing the details of revised pension/family pension to the pensioners/family pensioners. Thereby due to lack of knowledge pensioners are not sure about correctness of the amount of the arrears being paid to them and most of them have a sense of suspicion against the revision.

To overcome above suspicion, it is requested that an explanatory sheet as per the enclosed format may be provided to all defence pensioners/family pensioners invariably.

Relief to lakhs of pre-2006 retirees of the Armed Forces and Central Government

Relief to lakhs of pre-2006 retirees of the Armed Forces and Central Government

Pre-2006 retirees get pension relief

Finally, after many twists and turns, it has arrived! In a relief to lakhs of pre-2006 retirees of the armed forces and central government, their pension has been revised with effect from January 1, 2006, rather than from September 24, 2012.

The department of pension and pensioners’ welfare (DoPPW) issued the universal orders regarding this revision on Thursday. Anomalies in the fixation of the pension of the pre-2006 central government retirees had come to light after the implementation of the recommendations of the sixth Pay Commission. The issue was whether pension was to be calculated based on the minimum of pay for each rank/grade within the newly introduced bands or on the minimum of the pay-band itself.

The Central Administrative Tribunal (CAT) and Armed Forces Tribunal (AFT) then corrected it and ruled that the pension would be calculated on the basis of the minimum of pay for each rank/grade within a particular band, which gives the retirees a higher pension.

PCDA Clarification on Dearness Relief to re-employed Ex-servicemen

PCDA Clarification on Dearness Relief to re-employed Ex-servicemen

Office of the Principal Controller of Defence Accounts (Pension),

Draupadi Ghat, Allahabad-211014

Date:12.05.2015

Sub: Payment of Dearness Relief to re employed pensioner: Clarification thereof.

As per para l(a) of MOD letter No. 7(1)/95/D(Pen/Services) dated 28.8.2000, entire pension admissible to ex-servicemen who held post below commissioned officers (PBOR) at the time of retirement, is ignored and their pay on re-employment is to be fixed at the minimum of the pay scale of the post in which they are re-employed. Such pensioners will consequently be entitled to dearness relief on their pension.
Deptt. of Pension and Pensioners Welfare, vide their UO No.41/42/2007/P&PW(G) dt. 03.04.2008, reproduced under this office circular No. 386 dt. 19.06.2008, further clarified that if the pay is fixed at a higher stage because of advance increments and no protection of last pay drawn is given, the pay should be treated as fixed at a minimum only for the purpose of ignoring the entire pension and allowing dearness relief on pension. For availing this benefit the ex-servicemen would have retired at post below commissioned officers Rank (PBOR) before attaining the age of 55 years.

Now representations from the banks, where number of ex-clarify the elements to be taken into account for assessing the last pay drawn by the ex-servicemen for the purpose of last pay protection.

The dearness relief on re-employment should be regulated by the Pension Disbursing Agencies on the basis of certificate issued by re-employer, clearly stating whether benefit of last pay protection has been given or not. However, on examination of cases submitted by the banks it has been found that pay scale in banks are still on old pattern, whereas ex-servicemen have been retired with Pay in Pay Band, Grade Pay, MSP, Group Pay etc. In such cases it is clarified that for the purpose of assessing the last pay drawn for last pay protection, the elements to be taken into account should be last pay in pay band i.e. Band Pay plus Grade Pay, last drawn before retirement as envisaged vide MOP, PG & P, DOPT OM NO. 3/19/2009 Estt. Pay II dt. 8th Nov 2010 and no other elements should be taken for this purpose.

In view of the above, it is advised that all the cases of dearness relief where pay of ex-servicemen has been fixed at a higher stage because of advance increments may be reviewed and regulated accordingly.

PCDA CLARIFICATION on Circular 501 & 502 – OROP: Pension / Family Pension of JCO/ORs prior 01st Jan 2006

PCDA CLARIFICATION on Circular 501 & 502 – OROP: Pension / Family Pension of JCO/ORs prior 01st Jan 2006

One Rank One Pension Circular No. 512 by PCDA – Implementation of Government decision on the recommendations of the Committee Secretaries 2012 on the issues related to Defence Service Personnel and Ex-Servicemen- Improvement in Pension of JCO/ ORs Armed Forces retired/ discharged/ invalided out of service prior to 01.01.2006.

OFFICE OF THE PR. CONTROLLER OF DEFENCE ACCOUNTS (PENSION)
DRAUPADI GHAT, ALLAHABAD- 211014

Circular No. 512

Dated: 26.06.2013

Subject: Implementation of Government decision on the recommendations of the Committee Secretaries 2012 on the issues related to Defence Service Personnel and Ex-Servicemen- Improvement in Pension of JCO/ ORs Armed Forces retired/ discharged/ invalided out of service prior to 01.01.2006.

Reference: This office Circular No. 501 and 502 dated 17.01.2013.

PDAs are aware that as per this Office circular cited under reference, service pension in respect of JCOs/ORs discharged with qualifying service of 15 years and more will be revised by PDAs with reference to qualifying service, rank and group last held by the individuals as per tables attached with above cited circular.

It has been observed that various PDAs feel difficulties while revising pension w.e.f 24.09.2012 .Accordingly clarification on some of major problems are given as under -

1. Terms of engagement -

The Maximum terms of engagement of various rank of all services are prescribed as Appendix X to the above cited circular. The term of engagement of various ranks have been changed from 1.12.76 and 30.05.1998.  Due to clerical mistake “from 01/12/1976″ has been mentioned as “from 1.1.73″ in above cited circular which should be amended to that extends i.e. in place of 1.1.73 read 1.12.76. Further, Terms of engagement of Seamen I and Leading Seamen as shown “from 1.04.85″ will be “from 01.06.1953″. Exception periods are “emergency period” and applicable to those armed Force personnel who were retained in service compulsory beyond their terms of engagement during emergency.

2. Re-grouping of Group-

Groups for all ranks of PBOR have been introduced w.e.f. 01/06/1953. Initially there were 8 groups i.e. A, B, C, D, E, F,G and H. These pay groups were regrouped in 5 (i.e. A, B, C, D,E) w.e.f. 01/01/1973 which was further regrouped in 3 groups (X, Y & Z) w.e.f. 10/10/1997. It has been clarified that eight groups have been regrouped in five groups from 1.1.73 and further reduced to three groups from 10.10.1997 are as follows-

GROUP
PRE-1973 “A “ “B” TO “F” and Gunner GD “G” & “H”
POST -1973 “A “ “B” TO “D” “E”
POST 10.10.97 “X “ “Y “ “Z”

Similarly for Navy and Air force it is also clarified that Special Group in Navy between 01/01/1996 to 09/10/1997 is equivalent to group ‘B’. Therefore, the pension of special group is to be also revised according to group ‘B’ of the same rank.

    3. Equivalent rank of three Armed Force-

The Equivalent rank of three services are shown Appendix Y to the circular no 501 dated 17.01.2013.some of PDAs queried about equivalent rank of Atrificer III -I in Navy It is hereby clarified that Atrificer III -I rank have Grade pay of 3400/- ,therefore, no equivalent rank in Army/Air Force exists.

It is also clarified that Mechnician and Artificer are equivalent rank in Navy. In this office circular No. 501 only Art III to I and Chief Art has been mentioned in table No. 13 (Navy). The Service pension of Mech III-I and Chief mechnician may also to be revised as for Art III-I and Chief Artificer respectively.

    4. Rounding of Qualifying Service -

while calculating the length of qualifying service for the pensionary benefits, a fraction of a year equal to 3 months and above is treated as one half (1/2) year period and nine months or more but less than a year is treated as a completed one year for determining the amount of pension w.e.f. 28/06/1983. Prior to 28/06/1983 the broken period of service of 180 days or more was treated as ½ years w.e.f. 22/04/1960. In view of above, if Q.S has been mentioned as 17 years 10 months in PPO/ Corr PPO then it should be rounded upto 18 year, 17.5 years and 17 years for post 28.06.1983 retirees, pre-28.6.83 but post 22.04.60 retirees and pre-22.04.60 retirees respectively.

    5. Seeking Information:

It is also informed that all Annexure ‘A’ of circular 501 may send to OI/C Sangam Cell through E-mail address cda_albd@nic.in of this office on soft copy in single excel sheet along with hard copy and Annexure ‘B’ of circular No. 501 only beneficial case as per this office circular No. 509 dated 16/04/2013 sent to OI/C RP Cell in Hard copy. It is also intimated that if corr. PPO has been issued wef 1.7.2009 then need not to refer such case to this office on Annexure ‘B’ as this office issues suo-moto corr. PPO in these cases.

6. Revision of Family Pension:

It is also come to notice that during revision of family pension in terms of this office circular No. 502 dt. 17.01.2013, there may be some cases where some information regarding Q.S. and group is not available at your end. These cases may be referred to this office on all Annexure ‘B’ for wanting information. It is also informed that Annexure ‘B’ may be sent to OIC of Sangam Cell through E-mail address cda_alda@nic.in of this office on Soft copy in single excel sheet along with hard copy. It is hereby also clarified that pending receipt of clarification/ information from this office family pension may be received as an interim measure at the rate of minimum guaranteed rate prescribed under this office circular No. 510 dt. 16.04.2013 and if group is also not available then family pension may be revised for lowest group for the rank.

It is therefore, advised that above points may be kept in mind while regulating cases. The payment of pension may be regulated at the existing rates earliest if the same has not been done earlier.

Model Calculations – FAQ of CSC-2012

FAQ of CSC-2012 : The department of Principal Controller of Defence Accounts (Pensions) has issued illustrations to calculate the pension at revised rates for OROP Pensioners and family pensioners…

Some model Calculations are done here

Being a commissioned officer of Regular Army, the revision is to be done as per Annexure –A (table No 1) annexed to PCDA (P) Circular No 500. Look in relevant column for the rank and relevant row for qualifying service.

The revised pension w.e.f. 24.9.2012 comes out to 27795/- P.M.

Case – I
Name of Pensioner     J.S. Bala
Name of Bank     SBI Chandigarh
Existing Pension    26050/- ( Circular No. 397 )
Rank    Colonel
Qualifying Service    26 Years 05 Months
Date of Commencement    07/06/1990

Being the family of a commissioned officer of Army, the revision is to be done as per annexure –A (table No -2) annexed to PCDA (P) Circular No 500. The revised pension w.e.f. 24.9.2012 comes out to 10923/- p.m.

Case – II
Name of Pensioner     Smt. Amarjit Kaur
Name of Bank    SBI Mohali
Existing Pension    8679/- ( Circular No. 397 )
Rank    Major
Date of Commencement    19/07/1990

Case – III
Name of Pensioner     Sukhvinder Singh
Name of Bank    SBI Ropar
Existing Pension    13500/- ( Circular No. 397 )
Rank    MWO-Hony.Flying Officer
Qualifying Service    34 Years
Date of Commencement    01/01/1985
Date of Birth     08/12/1929

The existing pension of the pensioner is not in order. Firstly, it needs to be raised to 13590/- from 13500/- P.M. wef 01/07/2009 as per PCDA (P) Circular No 482 dt 19/04/02012. Then look for revised pension for the Rank and QS in Table -20 (Air Force) annexed to Circular NO 501. The revised pension should be 15465/- wef 24/09/12.

Moreover, as the pensioner is more than 80 years old, he is also entitled to additional pension corresponding to revised pension.

ONE RANK ONE PENSION – FAQ of CSC 2012

FAQ in relation to One Rank One Pension:

FAQ of CSC – 2012 : The department of Principal Controller of Defence Accounts (Pensions) has issued clarifications as Frequently Asked Questions on implementation of One Rank One Pension to pensioners / family pensioners…

FAQs on Implementation of OROP vide Govt. Order dated 17.01.2013

Q: 1 Are these orders applicable to those pensioners also whose date of commencement of pension is exactly 01.01.2006 ?
A: Yes, these orders are applicable to all the pensioners/family pensioners whose date of commencement of pension is on or before 01.01.2006.

Q: 2 The date of commencement of family pension in respect of a family pensioner is 01.04.2006 whose late husband had retired from the service on 31.08.1999. Will the family pension of the family be revised under these orders?
A: Yes, the family pension will be revised under these orders because the deceased soldier was a pre-2006 retiree.

Q: 3 It is being contended by some pensioners/their associations that the arrears on account of this revision should be paid w.e.f. 01.01.2006 as the orders are merely an amendment to GOI, MoD letter dated 11.11.2008. Please clarify?
A: As the provision of these orders are effective from 24the September 2012. Hence no arrears shall be allowed for the past period.

Q:4 Will the additional pension also be revised accordingly ?
A: The improved pension will be the basic pension from 24.09.2012 and hence additional pension payable will also be revised accordingly by the PDA.

Q:5 The basic pension of a pre-2006 pensioner (Rank – Havildar , Group ‘D’) of Army having total qualifying service of 15 years is slated to be increased from 3500/- p.m. to 5301/- P.M. Is such a high increase in Basic Pension is in order?
A: The increase in BP from 3500/- to 5301/- P.M for the pensioner with particulars as mentioned above is in order. It is evident from the existing basic pension of 3500/-PM and the particulars given above that the PDA has not revised pension of the individual correctly w.e.f. 01.07.2009. The correct entitlement of the individual is as under:

Basic Pension w.e.f. :

Date Amount (Rs.)PM Ciruclar No.
01.01.2006 3500/- 397
01.07.2009 4635/- 430
24.09.2012 5301/- 501
Q:6 In most of the cases neither the pensioner has applied to the PDA for revision of their pension nor any Corr PPO or instructions have been received by the PDA from the PSA. Please supply the proforma of application in this regard?
A: It has been clearly mentioned in the orders that the revision of pension by PDAs has to be made with reference to Pension Tables annexed to the orders. No further authorization from the PSA or any application from the affected pensioner is required to carry out the revision.

Q:7 The tables annexed to circular No 501 & Circular No. 502 start from QS of 15 years onwards. How to revise the pension of a pensioner having less than 15 years if qualifying years?
A: Following elements of pension / type of pension are to be revised by PSA.

Special Pension
Invalid pension
Service element of disability pension in respect of PBOR discharged with less than 15 years qualifying service
Service pension of TA personnel irrespective of their QS service and
Service element of War Injury Pension and Liberalized Disability Pension

Q:8 Mr. ‘X’ who is a Hony Nb Sub, Gp ‘D’ pensioner having total QS of 24 years is already drawing a basic pension of 7750/- PM. However as per table – 4 (Army) annexued to Cir No 501, his basic pension w.e.f. 24.9.12 should be 7601/- PM. Please advise how to regulate such cases.
A: The existing pension of the pensioner in such cases might have been revised by PCDA (P) by issuing Corr PPO (s) based on some courts orders etc. No action by PDA is required in such cases.

Q:9 Mr ‘X’ is a DSC pensioner in receipt of two pensions, one for regular Army service, and another for DSC service. Are both these pensions to be revised by PDAs?
A: The pension for regular Army service will only be revised under these orders by the PDA. A reference for revision of pension for DSC service will be sent to PCDA (P).

Q:10 The tables annexed to Circular No 501, in respect of DSC pensioner seem to be incomplete e.g. the table in respect of Sep of DSC are only up to QS of 23 years. How to revise pension of a sep of DSC who has total QS of 24 years or above?
A: Sepoy in DSC have maximum engagement period up to 20 years only with the exception that the maximum term of engagement can be up to 23 years in case of pensioner retired on or 30.5.98. Hence QS in such type of cases may be restricted to the maximum permissible and pension revised accordingly. Period-wise complete list of maximum terms of engagement for JCOs/ORs is enclosed in Appendix-X to Cir No 501.

Q:11 There is no table annexed to Cir No 502 to revise Ordinary Family Pension for NOKs of DSC Personnel. Please advise how to revise such cases ?
A: The family pension in respect of DSC personnel who are in receipt of family pension for only DSC service are to be revised at the same rates as given for family pensioners of Regular Army. DSC personnel on “clerical duty” and “other duty” are entitled for family pension of regular Army personnel of group “Y” and “Z” respectively.

Q:12 What are the basic fields/data required to revise pension under these order?
A: The basic fields/data required to revise pension under these orders are as follows:

Type of pension viz Retiring pension/service pension/ Ordinary Family Pension/ Special Family Pension/ War 1. Injury Pension/ Dependant Pension
2. Rank of the pensioner
3. Group of the pensioner (only for JCOs / PBORs)
4. Qualifying service (without weightage)
5. Record Office
6. Date of commencement
7. Date of Retirement

Q :13 How to look for the above information in the PPO or related record ?
A: In case of Post -86 retires all the information is generally available in the original PPO of the Pensioner. In cases where the required information is not available in the PPO or other record of the PDA, the missing information may be called for from the PSA concerned.

Q:14 In case of Pre-86 retires Qualifying service is generally not available in the PPO of the pensioner. Pl. advise the way out to regulate such cases.
A: The qualifying service in such type of cases can be looked for in the original Descriptive Roll of the pensioner or in the Corrigendum PPO(s). Original discharge book/certificate issued to the pensioner by the Record office is also an authentic source of such information.

Q: 15 Is capturing of information about Record office financially importance or can be done away with?
A: Following are the 4 major categories of JCOs/PBORs based on Record office.

Naval Record Office
Air Force Record Office
DSC Cannanore Record Office
All other Record offices except those mentioned above.

Different tables are available to cater to these categories and hence the importance of information about Record Office can’t be done away with.
