Sub: Payment of dearness relief to re-employed pensioners and employed family pensioners: Clarification thereof.

Ref: This office Circular No. 166 dated 07/03/2013, Circular No. 173 dated 07/04/2014 and Circular No. 179 dated 12/05/2015.

Provisions for payment of dearness relief to re-employed pensioners and employed family pensioners is laid down in Ministry of Personnel, Public Grievances & Pensions (Deptt. of Pension & Pensioners Welfare) OM No. 45/73/97-P&PW(G) dated 02/07/1999 issued under this office Important Circular No. 07 dated 13/08/1999. As per the ibid OM, before 18/07/1997, in terms of the existing orders, Dearness Relief to pensioners and family pensioners is to remain suspended during the period a pensioner/family pensioner is re-employed/employed under the Central or State Govt. or in a Statutory Corporation/Company/Body/Bank under them in India or abroad. The above facts are also applicable to the pensioners and family pensioners permanently absorbed in Statutory Corporation/Company/Body/Bank under the Central or State Government.

2. Representations from various agencies as well as pensioners/family pensioners including Pension Disbursing Agencies are being received for clarification on Payment of dearness relief to re-employed pensioners and employed family pensioners. The matter has been examined in this office and following points are clarified.

3. However, w.e.f. 18/07/1997, it has been decided by the Govt that: (i) In so far as re-employed pensioners are concerned, the entire pension admissible is to be ignored at present only in the case of those civilian pensioners who held post below Group ‘A’ and those ex-servicemen who held post below the ranks of Commissioned Officers at the time of their retirement. Their pay, on re-employment, is to be fixed at the minimum of the pay scale of the post in which they are re-employed. Such pensioners will consequently be entitled to Dearness Relief on their pension. (A) For this purpose, the Central Government Departments concerned, including subordinate organizations. State Government, Corporation/Company/Body/Bank etc. employing a Central Government pensioner shall be required to issue of certificate indicating the following:

(a) The re-employed pensioner retired from a civil or military post in the Central Government and was holding a post not included in classified as group ‘A’ or a post below the rank of commissioned officer in the armed forces;

(b) The entire amount of pension sanctioned by the Central Government was ignored in fixation of the pay on re-employment i.e. no part of the pension was taken into account in such fixation of pay in the pay scale of the post in which the Central government retired/retiree was re-employed/absorbed; and

(c) The pay of the re-employed/absorbee was/is fixed at the minimum of the pay scale of the post in which he had/has been initially re-employed after his retirement from the Central Government.

(d) If the pay fixed at a higher stage because of advance increments and no protection of the last pay drawn is being given.

(B) In the cases where PBOR (below Commissioned Officer) retired before attaining the age of 55 years and re-employed thereafter and their pay fixed at a higher stage because of advance increments and no protection of the last pay drawn were given, the pay should be treated as fixed at a minimum for the purpose of ignoring the entire pension and allowing Dearness Relief on pension. For benefit of advance increments, the policy for the same should exist in the re-employing department and a copy of such policy matter should be enclosed with the required certificate. But, after granting benefit of advance increments, the last pay drawn by the pensioner is protected, the pensioner in such case will not be entitled for dearness relief on pension.

Subject : Implementation of Government decision on the recommendations of the 7th Central Pay Commission (CPC)-Revision of Disability / War Injury Pension for Pre 01.01.2006 Deference Forces Pensioners : Clarification Regarding.

Reference : This office Circular No. 582 dated 05.09.2017, Circular No. 585 dated 21.09.2017 and Circular No. 596 dated 09.02.2018.

Of late complaints are being received from the pensioners that PDAs are not revising the pension of Pre-01.01.2006 retiree Armed Forces Pensioners in terms of Got, MoD letter No. 17(01)/2017(01)/D(Pen/Policy) dated 23.01.2018 (circulated vide this office Circular No. 596 dated 09.02.2018) under which method of re-computation of Disability/War Injury Element before applying the multiplication factor of 2.57 has been provided.

In view of the above, PDAs are requested to revise the Disability/War Injury Pension of Pre-01.01.2006 retired Armed Forces Personnel strictly in terms of GoI, MoD letter dated 23.01.2018 till receipt of Corr. PPO based on Notional Pay Fixation method. Cases in which PDAs are facing any difficulty to identify the pensioner, if any, as mentioned at Para 5 of Circular No. 596 dated 09.02.2018, the case may be forwarded to Audit Section of this office. The revision of such cases may be done on priority basis.

It is reiterated that where the disability of the pensioner was assessed as 50% in discharge cases, then it will be rounded to 75% as mentioned in Para -3 of the Circular No. 596. However, if the individual has already been given rounding off benefit through PPO (in invalid out cases) then rounding off benefit in such cases should not be given.

Sub: Payment of enhanced Monetary Allowance attached to pre and post independence Gallantry Awards.

Ref: This office Circular No. 9 dated 10/06/2011 and Circular No. 30 dated 22/12/2017.
The rates of Monetary Allowance attached to pre and post independence Gallantary Awards have been revised by the Govt w.e.f. 30/03/2011 and 01/08/2017 and the same have been issued to all the Pension Disbursing Agencies (PDAs) vide this office Circular No. 9 dated 10/06/2011 and Circular No. 30 dated 22/12/2017 respectively. These circulars are also available on this office web site www.pcdapension.nic.in.

However, complaints from various agencies as well as the pensioners/family pensioners & Pensioners’ Associations are being received at various levels including Ministry of Defence (MoD) stating that PDAs are not making payment of enhanced rate of Monetary Allowance attached to pre and post independence Gallantry Awards.

On examining the cases, it has been noticed that monetary allowance of Gallantry award has neither been revised as per this office Circular No. 9 dated 10/06/2011 nor Circular No. 30 dated 22/12/2017. Non-revision of monetary allowance of Gallantry Awards by the PDAs has resulted in huge arrears. Non-payment of dues to the pensioners/family pensioners as well as accumulation of such cases has been viewed seriously by the MoD. The MoD has further directed to ensure that such incidents do not recur.

Therefore, PDAs are requested to review all cases of monetary allowance attached to pre and post independence Gallantry Awards and ensure that revision as per circulars mentioned above has been carried out by them and payment is being made at correct rates. The Pension Disbursing Agencies are also requested to submit detailed status report on payment of correct rate of Monetary Allowance attached to pre and post independence Gallantry Awardees.

Details of Gallantry awardees extracted from pension payment scrolls for the month of January, 2018 received from the Banks in respect of whom monetary allowances are still awaiting for revision in terms of the above circulars is being forwarded separately to each CPPC for immediate revision of the same and to ensure credit the payments along with arrears in pensioners/family pensioners Bank Account. PDAs other than Banks are requested to review all cases of Gallantry awardees and confirm to this office that payment is being made as per the above quoted circulars.

Consequent upon issue of letters bearing No. 7(62)/20014-D (AG) dated 4th Dec, 2017 by Govt. of India, Ministry of Defence(reproduced as Annexure ‘A’ and ‘B’ respectively to this circular), the rates of Pre- Independence Gallantry Awards and Post-Independence Gallantry Awards have been revised w.e.f. 01st August, 2017.

2. The revised rate of monetary allowance attached with Gallantry Awards may please be paid to all recipients at revised rate, irrespective of rank and income.

3. The terms and condition for payment of monetary allowance on the authority of Pension Payment Order (PPO) notified by this office in above categories of cases is stated in brief in following Paras

i. The allowance will be admissible to the recipient of the award and on his death to his widow lawfully married by a valid ceremony. The widow will continue to receive the allowance until her death. Ordinarily, the widow who was first married shall receive the allowance, but with the special sanction of the Government, the allowance may be divided equally between the lawfully married widows of recipients.

ii. When the award has been made posthumously to a bachelor, the monetary allowance shall be paid to his father or mother, and in case the posthumous awardee was a widower, the allowance shall be paid to his son below 18 years or unmarried daughter as the case may be.

iii. Each bar to the decoration will carry the same amount of monetary allowance as admissible to the original award.

iv. The monthly monetary allowance will be paid in respect of all gallantry awards received by an individual.

v. The monetary allowance will not be taken into account for computing dearness relief.

For CMDs/Chief Managers of Link Bank/CPPCs/Director of Treasuries/ all other PDA’s

It is requested that a copy of these orders / instructions may be provided to all Paying Branches/ Treasuries under your jurisdiction for making payment of the monetary allowance at the enhanced rate.

Copy of GOI, MoD letter No. 1(10)/2009-D(Pen/Policy) dated 29th August, 2017 on the above subject, which is self-explanatory, is forwarded herewith as annexure to this circular for further necessary action at your end.

2. In terms of Para-1 of GOI, MOD letter dated 29th August’ 2017, the fixed medical allowance has been enhanced from Rs.500/- pm to Rs. 1000/- pm with effect from 01.07.2017. Ex-Servicemen who retired after 01.04.2003 have to become member of ECHS compulsorily and are not eligible to draw Fixed Medical Allowance. However, Pre-01.04.2003 retirees have the option of either joining the Scheme or draw Fixed Medical Allowance as per the extant rates.

3.The other conditions for grant of Fixed Medical Allowance as brought out in this Office Circular No. 208 dated 27.07.1998 quoted under reference shall continue to be in force. PDAs are requested to please review the cases and revise the Fixed Medical Allowance in all the affected cases accordingly.

Subject: Implementation of the Government decision on the recommendations of the Seventh Central Pay Commission in respect of Commissioned Officers, Retiring or dying in harness on or after 1.1.2016 (Post-2016).

Reference: GoI, MoD letter No.17(02)/2016-D(Pen/Pol) dated :04.09.2017.

Consequent upon issue of GoI, MoD letter No. 17(02)/2016-D(Pen/Pol) dated 04.09.2017 (Annexure A), pensionary awards of Commissioned Officers (including MNS and Territorial officers) of three Services who retired/ discharged/ released/ invalided out or died in harness on or after 01.01.2016 are to be sanctioned under orders contained therein.

2. It is therefore, requested to initiate claim/revision claim as detailed below along with the enclosed LPC-cum-Data Sheet for initial/revised pension claims, as the case may be, so that initial PPO/Corrigendum PPO may be issued in affected cases by this Office:

(a) Initial Claims for Retiring Pension, Invalid Pension, Service Element as well as Disability Element of Disability/ Liberalised Disability/ War Injury Pension:

Initial Claims for Retiring Pension, Invalid Pension, Service element as well as Disability Element of Disability/ Liberalised Disability/War Injury Pension in respect of Commissioned officers of Indian Army who retired/discharged/released/invalided out on or after 01.01.2016 and who are in receipt of pay & allowance under respective Army Officers Pay Rules 2017 shall be preferred in usual manner on revised LPC-Cum-Data Sheet No. PHP-G1M-01/2017(7th CPC) as per specimen enclosed (Annexure B) and submitted as usual along with data in electronic form. The instructions for the filling up LPC cum Data Sheet are enclosed as Annexure E.

(b) Claim for revision of retiring pension – commissioned officers, retired/discharged on or after 01.01.2016.

Data Sheet PHP-G1M-03/2017(7th CPC) (Enclosed as Annexure C) will be used for revision of pensionary awards as per 7th CPC in those cases where Pension has already been notified as per 6th CPC . This data sheet will be used only once for revision of Pensionary awards already notified from 01.01.2006 to 30.09.2017, thereafter, any amendment/ revision will be done through Data Sheet (Rev) PHP-G1M-02/2017(7th CPC) (Enclosed as Annexure D) for corrigendum of pensionary awards.

(c) Claim For Corrigendum of Pensionary Awards (PHP-G1M-02/2017(7th CPC)) :

Data Sheet (Rev) PHP-G1M-02/2017(7th CPC) (Enclosed as Annexure D) for corrigendum of pensionary awards in respect of commissioned officers will be used for amendment /revision of 7th CPC pensionary awards i.e. pensionary awards already notified as per VI CPC and subsequently revised as per 7th CPC through data sheet PHP-G1M-03/2017(7th CPC).

NOTE : Old Data sheet (Rev) for corrigendum of pensionary awards will continue to be used for revision/amendments of pensionary awards of officers retired/discharged/invalided out prior to 01.01.2016.

3. COMMUTATION OF ADDITIONAL PENSION IN REVISION CASE:

Pensioners who have retired between 1.1.2016 and date of issue of orders for revised pay/ pension based on the recommendations of the 7th CPC, shall have an option, in relaxation of provisions of relevant Pension Regulations, not to commute the pension which has become additionally commutable on retrospective revision of pay / pension on implementation of recommendations of the 7th CPC. Option form is enclosed as Appendix ‘A’ to be used for this purpose.

Option for commutation of additionally commutable amount will required to be submitted within 4 months from the issue of the Govt. letter by the Armed Forces officers. Option exercised after expiry of 4 months from the issue of the Govt. letter will not be entertained. The claim submitted without exercising said option or if no option for commutation of additionally commutable amount of pension is received within stipulated time period as mentioned above, it will be presumed that pensioner is not willing to commute additionally commutable amount.

4. DISABILITY PENSION/WAR INJURY PENSION

4.1 There shall be no change in existing provisions regulating the Disability Pension/War Injury Pension under casualty pensionary award so.

4.2 The amount of all kind of pension shall be subject to a minimum of Rs. 9,000/-. The maximum amount of normal rate, enhanced rate of ordinary family pension and retiring pension shall be 30%, 50% and 50% respectively, of the highest pay in the Government which is Rs. 2,50,000/- with effect from 1.1.2016. The maximum ceiling is, however, not applicable in the cases of Disability Pension/War Injury Pension etc., applicable under casualty pensionary awards.

5. Ex-GRATIA LUMP SUM COMPENSATION IN CASES OF INVALIDMENT :

Ex-gratia lump sum compensation to Defence Service Personnel who are boarded out of service on account of disability/ war injury attributable to or aggravated by military service, shall be paid @ Rs. 20 lakh for 100% disability subject to provisions as stipulated in MoD letter No. 2(2)/2011/D(Pen/Policy) dated 26.12.2011. For disability/ war injury less than 100% but not less than 20%, the amount of Ex-gratia compensation shall be proportionately reduced. No Ex-gratia compensation shall be payable for disability/war injury less than 20%. The proportionate compensation would be based on actual percentage of disability as certified by the Invaliding Medical Board, without applying broad banding provisions as contained in Para 7.2 of MoD letter No. 1(2)/97/D(Pen-C) dated 31.01.2001.

6. DISABILITY/WAR INJURY ON DISCHARGE /INVALIDMENT:

6.1 BROAD-BANDING OF PERCENTAGE OF DISABILITY/WAR INJURY ON DISCHARGE:

In cases where Armed Forces personnel are discharged/retired on or after 1.1.2016 under the circumstances mentioned in Para 4.1 of MoD letter No. 1(2)/97/D (Pen-C) dated 31.1.2001 with disability including cases covered under MoD letter No. 16(5)/2008/D(Pen/Policy) dated 29.9.2009 and the disability/war injury has been accepted as 20% and more, the extent of disability or functional incapacity shall be determined in the manner prescribed in Para 7.2 of said letter dated 31.1.2001 for the purpose of computing disability/ war injury.

6.2 BROAD-BANDING OF PERCENTAGE OF DISABILITY/WAR INJURY ON INVALIDMENT:

Existing provisions for broad banding of invalidment cases of Disability and War Injury Pension shall remain unchanged.

6.3 Rates for calculation of disability where composite assessment is made due to existence of disability, as well as war injury, shall be determined in terms of provision contained in Para 3(b) of MoD letter No. 16(02)/2015-D(Pen/Pol) dated 08.08.2016.

6.4 CONSTANT ATTENDANT ALLOWANCE (CAA)

Constant Attendant Allowance shall continue to be admissible under the condition as hithertofore at the existing rate from 1.1.2016 to 30.06.2017. However, with effect from 01.07.2017 it shall be admissible at the uniform rate of Rs. 6750/- per month, irrespective of the rank.

7. All out efforts may be made to submit affected cases for revision of pension duly completed in all respect (along with option for commutation, if any) to avoid correspondence and back references.

8. The Software Programme for Data entry and validation check may be collected from EDP Centre of this Office.

9. Various Orders on the subject are available on the website of this Office i.e. www.pcdapension.nic.in.

10. As far as possible, all fresh claims for grant of retiring pension should be submitted only on revised LPC-cum Data Sheet. After 01.10.2017, no fresh cases for notification of Pension will be entertained on old LPC-cum Data Sheet. However, cases on the new LPC-cum-Data Sheet received before 01.10.2017 will also be accepted if revised pay details are available. It may please be ensured that Seal of LPC cum data sheet signing officer is affixed and name of all officials signing LPC cum data sheet are clearly and legibly mentioned.

Sub: Non transfer of Pension files from banks to other PDAs.

This office is receiving representations from pensioners/family pensioners stating that they have submitted applications to their banks for transfer of their pension account to other PDA, however, banks are not transferring their pension account to the new PDAs.

In this regards, attention is drawn to para 3 of “Scheme for Payment of Pension of Defence Pension’ by Public Sector Banks” which clearly provides that pensioner will have the choice to draw their pension from any PDA. Further in para 7 of above scheme, procedure for transfer of pension account from one PDA to another PDA has been laid down. Similar provisions for transfer of pension account alongwith necessary supporting documents from one PDA to another PDAs are available in para 93.1, 93.3 and 94 of Defence Pension Payment Instruction 2013.

Non-transfer of pension account of pensioner/family pensioners, if opting, is not only a violation of provisions laid down but also reason of cause of dissent in pensioner/family pensioner. It is, therefore, requested to transfer pension account of pensioners/family pensioners to the new PDA on priority as and when pensioner/family pensioner opts for the same.

Profile of Defence Pensioners as on April 2015

As on 01.04.2015 the Defence Accounts Department is servicing 24.61 lakhs pensioners, spread across the country.

The category wise details of pensioners is as under:

On an average 45,000 Defence Forces personnel and Defence civilians retire every year and become part of pensioners’ strength. While working out the data‐base of pensioners as on a given date, average wastages out of the pensioners’ data base are worked out to arrive at the number of Defence pensioners on a particular date.

The Defence pensioners are spread over the length and breadth of the country. The major pockets having concentration of Defence pensioners are states of Himachal Pradesh, Haryana, Punjab, Uttar Pradesh, Bihar, Maharashtra, Tamil Nadu and Kerala among others.

The Zone/State wise details of pensioners is enclosed in the accompanying Annexure – ‘A’.

Further, around 4.60 lakhs pensioners drawing pension from 63 Defence Pension Disbursement offices, which are also mapped in the accompanying Annexure – ‘B’.

Subject :- Revision of pension in r/o pre-2006 Commissioned Officers/JCOs/ORs pensioners/ Family pensioners.

Reference:- This office Circular No. 547 dated 11.09.2015.

Pension Disbursing Agencies are aware that as per this office Circular No. 547 dt.- 11.09.2015, Service/Family Pension in respect of JCOs/ORs are to be revised w.e.f. 01.01.2006 by the Pension Disbursing Agencies as per tables attached with circular. Specific tables for revision of Special Pension/Invalid Pension/ Service Element of Disability Pension in respect of Pre- 01.01.2006 PBORs retirees discharged with less than 15 years of qualifying service and Service Pension of TA personnel irrespective of their qualifying service have not been prepared as the Pension Disbursing Agencies would not be in a position to revise such cases. Hence, such cases shall be referred to the Pension Sanctioning Authorities by Pension Disbursing Agencies on enclosed Annexure to issue corrigendum PPOs in affected cases.

2. Similarly the DSC personnel who are receiving two pensions, one for regular Army Service and other for DSC Service, their pension for DSC Service shall not be revised. The pension for regular Army service shall be revised under these orders by the Pension Disbursing Agencies. A reference for revision of pension for DSC service will be sent to PCDA (P) on attached Annexure for issue of Corr. PPO. However, Pension of DSC pensioners receiving only one pension for DSC service shall be revised under these orders from attached Table of the Army personnel. DSC pensioners who were on clerical duty and other duty, their pension shall be revised by the attached table for group ‘Y’ and group ‘2’ respectively.

3. Maximum term of engagement for various ranks is mentioned in Appendix ‘X’ of this office important Circular No. 501 dated 17.01.2013. To maintain the uniformity in the tables, the rates have been shown up to the qualifying service of 28 years for each rank. The Service Pension may be revised only up to maximum term of engagement.

4. In Annexure ‘C’ for Navy attached with GOI, MOD letter dated 03.09.2015 circulated vide Circular No. 547, the Column Nos. have been typed erroneously as 2, 3, 5……, same may be treated as re-numbered from ‘1’ upward accordingly. Column No. 21 of Annexure ‘B’ (Air Force) of GOI, MOD letter dated 03.09.2015 circulated vide this office Circular No. 547 has erroneously been typed as ‘2021’, the same may be read as Column No. ‘21’ instead of ‘2021’. Further, in column 9 of Annexure ‘B’, the rate shown for the rank of CPL ‘Z’ against the qualifying service of 25.5 years has erroneously been typed as ‘Rs. 5151’, the same may be read as Rs. 4922 instead of Rs. 5151.

5. Similarly, equivalence of ranks across the three services has also been provided in Circular No. 501 dt- 17.01.2013 and Circular No. 512 dt- 26.06.2013. The rank of Chief Mechanician is equivalent to Chief Artificer. Therefore, the pension of Chief Mechanician shall be revised according to Chief Artificer. As per this office ibid circular, the rank of Mechanician IV is equivalent to Artificer IV. Therefore, the pension of Mechanician lV shall be revised equivalent to Artificer- IV.

6. Further, revision under these order may be done on the basis of rank last held and not for the rank for which pensioned as the same has already been clarified in Note below Annexure-Ill of Gol, MoD letter dated 11.11.2008 circulated vide this office Circular No. 397 dated 18.11.2008 (as amended from time to time).

7. All other terms and conditions shall remain unchanged.

Sub: Instruction regarding simplified procedure for claiming Children Education Allowance: Revised Procedure: JCOS/ OR (the involvement of LAOS in the Revised audit procedure for CEA claims).

Ref: This office letter No. even dated 10.06.15 (copy enclosed).

Please take the reference of above mentioned letter which has been forwarded to your office alongwith HQrs office letter No.AT/16/Appex-J/Revised 2011/VI dated 27.05.2015 (copy enclosed), stating that after implementation of HRMS 2.0, audit procedure of payment of CEA will undergo substantial change. These instructions, inter-aha, stipulate involvement of LAOS in carring out audit of CEA claims.

2. The HRMS 2.0 has since been implemented in PAO (OR) AMC and PAO(OR) 11 GRRC, Lucknow w.e.f. November 2015. It is, therefore, requested that JCOs ORS of the units whose Pay & allowances are maintained by PAO(AMC), PAO 11 GRRC and also fall under your audit jurisdiction, the CEA claims of JCOs/ OR of the those units will be post audited by your office.

3. Further, a meeting on monthly pay system for Pay and Allowances of JCOs/ OR and Dolphin security was held on 26th October, 2015 at HQrs office. It has been decided during the conference that LAOS should also be involved, may be once in a month, to find out the ground reality and to take up the matter with Unit authority to reduce percentage of DOS-II rejection.

4. It is, therefore, directed by the Competent Authority that LAOS will provide the list of units under their jurisdiction in r/o each of the six PAOS to the respective PAO I / Cs. PAOS will provide a list of rejected DOS II along with reasons of these units to LAOS to take up the matter with Unit authority to check whether action on rejection of DOs II is being taken by unit authorities to reduce percentage of DOS-II rejection. In case of NCC units, if the DOs II of ABF are being published at higher rate vis & vis the stipulated rates, LAOs may also test check the amount from original tickets kept in units.

It may please be noted for strict compliance. Compliance report may be communicated to this office.

Sub: Non compliance of instructions for payment of Defence Pension.

Guidelines/instructions for payment of Defence Pension are provided in “Scheme for payment of pension of Defence Pensioners by Public Sector Banks”. This scheme helps the banks in discharging their duties of payment to defence pensioner especially with respect to obtaining necessary certificates from pensioners/ family pensioners before continuing payment after due date as well as maintenance of pension account and submission of paid scrolls alongwith necessary enclosures/certificates to this office. Besides this, circulars on pensionary matter are also issued by this office from time to time.

2. However, it is observed that Banks are not adhering to above said guidelines/instructions resulting in increase in complaints from pensioners due to incorrect / under payment and also loss to exchequer due to overpayment. In this regard, two major irregularities noticed where banks failed to comply with the guidelines/instructions stated in para 1 above are elaborated below:-

(i) In a particular case, after the death of pensioner on 10.12.2001 which was intimated to the pension paying bank by the son of pensioner. However, the bank continuously credited the pension in pensioner’s account till 2007.The account of pensioner was having a balance of Rs 6,17,628 as on 15.04.2015.

 

3. Thus, in this case the bank failed to adhere to the following guidelines:-

(a) Bank failed to comply with the provisions of para 8.4 of “Scheme for Payment of Pension of Defence Pensioners by Public Sector Banks” which states that where pensioner ceases to draw pension due to death, disqualification, expiry of award, transfer to another Pension Disbursing Agency, the details of such pensioner will be extracted monthly by the bank and forwarded to this office on the format prescribed in Annexure D-I & D-II by 10th of the following month under the Registered Cover Superscribed as “Annexure D-I, & D-II”.

(b) Bank has failed to take action, as per Para 29 of Annexure-H of “Scheme for payment of pension of Defence Pensioners by Public Sector Banks” for stoppage/discontinuance of the payment immediately after receipt of intimation of demise of pensioner.

(c) Bank has further failed to take action for stoppage/discontinuance of pension after 31.10.2002 i.e. in the month of November, as after death of pensioner, life certificate/identification could not be obtained/carried out. Clear instruction for obtaining life certificate and identification is laid down in Para 12 of “Scheme for Payment of Pension of Defence Pensioners by Public Sector Banks” and Para 4 of Annexure-H of “Scheme for Payment of Pension of Defence Pensioners by Public Sector Banks”.

(d) Bank has failed even to follow their own guidelines to close the account if no transaction took place for six months.

(ii) In another case, a pensioner was granted basic pension amounting Rs 8000/- pm. However, bank credited his account @ Rs 80,000/- of basic pension plus dearness relief. Here bank has overlooked the upper ceiling of pension of Rs 45,000/- as stated vide Para 9 of this office circular No. 397 dt-18.l 1.2008.

4. Such incorrect payments have been viewed seriously by Ministry of Defence and directed to establish the mechanism to stop the payment of such nature.

In view of the above, it is requested that all paying branches/CPPC under your jurisdictions dealing with defence pension may be instructed to adhere strictly to the guidelines/instructions specifically with respect to showing the causalities affecting the entitlement or admissibility of pension/family pension in change statement and enclosing the various certificates with Bank Scrolls. A copy of Annexure D-I, & D-II is enclosed for providing the details concerned in digital mode with the e-scrolls, as this office is moving ahead with e-auditing.

In addition, the banks are required to introduce the “Range Check” in all the categories of Pension so as to ensure that the amount of pension does not fall below the minimum range and does not go beyond the maximum range introduced in the system.

Please take cognizance of above cited circular dated 19.01.2015, under which a list of common errors/ mistakes found in pension/family pension (copy enclosed), was circulated with a request to ensure that said errors/mistakes may be avoided while initiating/ forwarding the pension/family pension claim to this office. But; it is being observed that, in spite of these instructions the same errors/ mistakes are being repeated while initiating/ forwarding the pension /family pension claims, resulting into avoidable delays.

2. Therefore, it is, once again requested that suitable instructions along with copy of this circular may be issued to all the Head of Offices under your administrative control for strict compliance in this regard.

Annexure-A

  1. Common Errors Relating to Superannuation Cases

    It has been observed that in several cases only pay particulars of LPC-Cum-Data Sheet are being verified by LAO/PAO, while as per instructions issued by this office time to time “All columns of LPC-Cum-Data Sheet should be verified by the LAO/PAO.”

  2. Organization Code & Organization name should be correctly filled in Col. 1 & 2 of the Data Sheet respectively.
  3. GPF Statement (CC0-9) having clear and full GPF A/C No. should be enclosed with pension claim.
  4. Complete address with PIN Code of office/Unit and HOO should be filled in Col. 4 & 5 of the Data Sheet respectively.
  5. Nature of pension in Col. No. 15 of Data Sheet should be supported with part-II Office Order.
  6. Audit report for counting of former service should be enclosed in support of Col. 18 of Data Sheet.
  7. Col. No. 21 of the Data Sheet should be properly filled with as per Medical Option attached with pension claim.
  8. Complete details of EOL statement should be attached with the claim and 10 months average should be calculated on the basis of last 300 days for which individual has actually drawn payment (excluding EOL Period).
  9. Each kind of demand pending against the claimant and interest thereon should be shown separately in “No demand Certificate for Govt. dues”, and it should be specified to which Controller Credit is to be passed on for the demand.
  10. No demand certificate for Govt. Accommodation should be enclosed, in the absence of which an amount of Rs. 1 lakh may be withheld from gratuity payment.
  11. No judicial certificate that no judicial/disciplinary proceeding is pending.
  12. All the three parts of Commutation Application should be attached duly completed and Col. No. 36 and 37 of Data Sheet should be filled accordingly.
  13. In Col. No. 47 of the Data Sheet, name of district in which PDA is situated should be filled.
  14. No prefix or suffix as Zero is required in Bank Ale No. in Col No. 54 of the Data Sheet. It should be exactly same as provided by Bank and it should be supported by Bank details also.
  15. Details of single PDA (Bank or DPDO) should be filled in Data Sheet and other document attached with claim.
  16. In support of Col. NO. 62, Certificate on proper format as prescribed in Cir. No. 106 dated 18.03.2013 of this office should be attached.
  17. Calculation Sheet should be verified by LAO and all the documents of the pension claim should be verified by concerned HOO.
  18. HOO remarks on Page No. 5 of IAFA-356 should be filled completely and service rendered by claimant should be established.

Annexure-8

Common Errors/Mistakes observed in claim for Family Pensioner

  1. It has been observed that in several cases only pay particulars of LPC-Cum-Data Sheet are being verified by LAO/PAO, while as per instructions issued by this office time to time “All columns of LPC-Cum-Data Sheet should be verified by the LAO/PAO.”
  2. Death certificate in respect of deceased govt. Servant and an extract of DO Pt-II 00 notifying the causality should be enclosed.
  3. Nomination of DCRG in original executed by deceased govt. servant during his life time should be enclosed.
  4. Statement showing non qualifying service and dates of availing EOL should be enclosed.
  5. DCRG/Family pension claim on IAFA 356 A should be duly completed in all respect.
  6. Option for fixed medical allowance/only widowhood certificate should be enclosed.
  7. Marital status certificate should be duly countersigned by the HOO
  8. Date of Birth certificate must be issued from school/college/municipal corporation/gram panchayat duly countersigned by HOO.
  9. (a) A certificate stating that “the claimant is suffering from …….disorder and is not curable permanent nature and also stating that the claimant is unable to earn his livelihood due to the stated handicapped nature” by a medical board comprising of a Medical Supdt. Or a principal or a director or a Head of Institution or his Nominee as Chairman and Two other members, out of which at least one shall be a Specialist in the particular area of Mental or Physical disability including mental retardation (Rule 54 (6) (iv) to (vi) under CCS (P) Rules 1972) should be enclosed in case of disabled claimant.9. (b) A similar certificate is also required to be submitted by the HOO along with above certificate regarding income from all sources including self employment for examining the admissibility of family pension to the claimant.
  10. For Dual family pension, confirmation from concerned Record Office or PPOs copy of Army side family pension, is required to ascertain eligibility of Dual family pension claimant.
  11. Date of Birth of claimant of family pension must be agreed with the record as given in service book i.e. with the family details executed by individual/pensioner.
  12. It has been observed in several cases that the dependency of claimant is being shown his/her relatives whereas claimant children should be dependent on his/her parents. Therefore, dependency certificate be issued/ forwarded accordingly to this office.

I am directed to refer  to Government letter No.15324/HQDGNCC/Coord/532/D(GS-VI)/98 dated 29th May 1998 and to say  that    the   question    of  revision   of  pay   scales  of  WTOs (Retired) working    earlier     with    NCC organization  the rank of  Lt. Col.  has been examined  in this Ministry  in consultation with    Defence(Finance) and Ministry of   Finance, Department of expenditure  for the purpose grant  of  pension    and   pensionary  benefits (revised)   to  them.     It  has  been decided that erstwhile WTOs (NCQ) in   the rank of  Lt. Col. hitherto being governed by SAI  9/S/74 for  the   purpose   of Pay   and    Allowances subject to deduction of Rs.50/- per month due to a abolition  of  Special Disturbance Allowance  w.e.f.    1st January, 1973, will be placed  in Pay
Band-III   (Rs.15600-39100) with   the corresponding  grade pay (Rs.7600) for  the   purpose    of revision   of pensionary   benefits   w.e.f.    1.1.2006.

2.  NCC  HQrs will take necessary action in  the  matter in consultation with PCDA Allahabad.

3. This  issues  with the approval of Ministry of Finance, Department  of  Expenditure vide their  Id Note No.24/EV/2014 dated 13.1.2014 and  concurrence of  Ministry of  Defence (Finance/AG)  vide their ID No.1(82)/20.13-AG/PA(554-PA dated 13.01.2014.

Attention is invited to this office circulars no. 78 dated 08.07.2010,

under which a copy of Govt. of India, Ministry of Personnel, Public Grievances & Pensions, Department of Pension & Pensioners’ Welfare, OM No. 4/25/2008-P & PW (D), dated 26.05.2010 regarding grant of Fixed Medical Allowance @ Rs. 3ooI- PM to Central Government Pensioners/Family Pensioners residing in area not covered under CGHS was circulated to all Pension Disbursing Authorities (PDAs).

2. As per Govt. of India, Min. of PPG & P, Deptt. of P & PW OM No.4/25/2008-P & PW (D), dated 19.11.2014, Govt. has decided to enhance the amount of Fixed Medical Allowance from Rs.300/- to Rs. 500/- per month. The other conditions for grant of Fixed Medical Allowance shall continue to be in force. These orders will take effect from 19.11.2014.

3. A copy of Govt. of India, Min. of PPG & P, Deptt. of P & PW OM No.4/25/2008-P & PW (D), dated 19.11.2014 is enclosed for immediate implementation and the payment of Fixed Medical Allowance (FMA) to be regulated accordingly wef 19.11.2014. Other conditions for grant of Fixed Medical Allowance circulated in previous circulars will remain unchanged.

4. It is requested that suitable instructions alongwith a copy of this Circular may please be issued to all sub offices under your administrative control for implementation of the above Government order.

PCDA circular: Grant of Family Pension and gratuity

Grant of Family Pension and gratuity to the eligible member of the family of an employee/pensioner/family pensioner reported missing: PCDA circular No. 538

Subject: – Grant of Family Pension and gratuity to the eligible member of the family of an employee/pensioner/family pensioner reported missing-consolidated instructions regarding.

Reference: – This office Circular No. 498 dated 08.08.2013.

A copy of Govt. of India, Ministry of Defence letter No 1(1)/2010-D(Pension/Policy) dated 23.12.2014 is reproduced wherein it has now been decided to issue consolidated instructions in supersession of previous instructions by various Govt. letters as mentioned in Para-1 of ibid Govt. letter regarding grant of family pension to the eligible members of family of the Armed Forces Personnel/Pensioner/Family pensioner reported missing and whose whereabouts are not known.  It includes those kidnapped by insurgents /terrorists but does not include those who disappear after committing frauds Icrime/desertion etc.

2. In the case of a missing Armed Forces Personnel/ Pensioner/Family pensioner, the family can apply for the grant of family pension, amount of salary due, leave encashment due and the amount of DSOP/AFPP fund and gratuity (whatever has not already been received) to the IHQ / Record Office concerned, where the officers and JCOs/ORs in Army and equivalent in Navy and Air Force, had last served, six month after lodging of police report. The family pension and/or retirement gratuity may be sanctioned by the respective Pension Sanctioning Authorities (PSAs) after observing the following formalities:-

(i) The family must lodge a report with the concerned Police station and obtain a report from the police that the Armed Forces Personnel/ Pensioner/ Family pensioner has not been traced despite all efforts made by them. The report may be a First Information Report or any other report such as a Daily Diary/General Diary Entry, filed by the Police authorities concerned, as per the practice prevalent in the state/ UT.

(ii) An Indemnity Bond should be taken from the nominee/dependents of the Armed Forces Personnel/ Pensioner /Family pensioner that all the payments will be adjusted against the payments due to the Armed Forces Personnel/Pensioner /Family pensioner in case she/he appears on the scene and makes any claim.

3. In the case of a missing Armed Forces Personnel, the family pension, at the ordinary or enhanced rate, as applicable, will accrue from the expiry of leave or the date upto which pay and allowances have been paid or the date of the police report, whichever is later. In the case of a missing pensioner/family pensioner, it will accrue from the date of the police report or from the date immediately succeeding the date till which pension/family pension had been paid, whichever is later.

4. The retirement gratuity will be paid to the family within three months of the date of application. In case of any delay, the interest shall be paid at the applicable rates and responsibility for delay shall be fixed. The difference between the death gratuity and retirement gratuity shall be payable after the death of the employee is conclusively established or on the expiry of the period of seven years from the date of the police report.

5- Before sanctioning the payment of gratuity, Service HQrs/ Record Office will assess all Government dues outstanding against the employee/pensioner and affect their recovery in accordance with instruction in force.

6. The amount of salary due, leave encashment due and the amount of DSOP/AFPP fund will be paid to the family in the first instance as per the nominations made by the Armed Forces Personnel/ Pensioner on filing of a Police report and submission of an indemnity bond as indicated above.

7- The benefits to be sanctioned to the family/nominee of the missing Armed Forces Personnel/ Pensioner will be based on and regulated by the emoluments drawn by him/her as on the last date he/she was on duty including authorised periods of leave.

8. Formats of separate Indemnity Bonds to be used in the case of missing Armed Forces Personnel, missing pensioners and missing family pensioners are available at the official website of PCDA (Pensions) Allahabad i.e. www.pcdapensionnic.in.

Subject: Forwarding of revised LPC-cum-Data Sheets for Retiring and disability Pension Module (Commissioned Officers) of the Pension Sanction Software by incorporating Aadhaar Number, Mobile No. and E-mail ID.

Reference: This office Section order Nos. 4 and 5 dated 19/9/2014

Please refer to this office above cited Section orders under which PHP based LPC-cum-Data Sheet along with instruction for filling of additional columns of Data Sheets for sanction of pensionary awards in r/o Commissioned officers retired/ invalided out from service have been circulated.

2. As you may be aware, Aadhaar-Card Number-based biometric verification system for pensioners as an additional option has been introduced by Govt. of India from Nov 2014. Accordingly, this office issued circular No. 176, 177 dated 17.11.2014 & 19.11.2014 (copies enclosed for information) to all PDAs for accepting Life Certificate issued online by a Govt. agency as result of Aadhaar biometric authentication. It may be mentioned that www.Jeevanpramaan.gov.in is an official portal of Govt. of India for all activities relating to issue of this Aadhaar -based biometric authenticated Life Certificate.

3. In the backdrops of introduction of Aadhaar based -life certificate, a need has been felt to capture details of Aadhaar No., Mobile No., residential address and email ID in PPOs to facilitate improved sen/ices to pensioners. Accordingly, LPC-cum-Data Sheet in respect of Retiring Pension circulated earlier and LPC-cum Data Sheet for issue of Corrigendum of it have been replaced with new LPC-cum-Data Sheets under which new columns have been added to incorporate details of Aadhaar Card Number, Mobile No., residential address and E-mail-ID of the pensioners and Aadhaar No. of family members. The information of Aadhaar card is required to be received along with the pension claim from Nodal Agency(PCDA (O) Pune). Therefore, it is requested that the Aadhaar card information with photocopy of same in respect of pensioner, family pensioner and dependants may be obtained from Service H. Qrs or the Units/ offices where the individual has last served and provided to this office in LPC cum data sheet duly filled in with a photocopy of same in support for audit purpose. The Service H. Qrs. are requested to provide the details of Aadhaar Card of officer and family in family detail issued by them at the time of retirement or death for the purpose of notification of pensionary benefits. Revised LPC-cum-Data Sheets for sanction of Retiring Pension (original corrigendum) mentioned below are forwarded herewith for necessary action at your end.

a) For original Retiring Pension claims- G-1/M/DS-1(2014)

b) For corrigendum to Retiring Pension claims- G-1/M/DS-1A(2014)

4. The field-wise instructions to fill the LPC-cum-data sheet are enclosed herewith as Annexure for information and necessary action by all concerned. It is requested that all Retiring pension claims may be initiated on revised LPC-cum-Data Sheet so that PPOs/ Corrigendum PPOs may be issued duly incorporating above information in PPOs/Corrigendum PPOs. This additional information will be helpful for Aadhar-based biometric verification system for pensioners.
