Payment of revised waves Oct the outsider/substitute GDS who are working in short-term vacancies of regular GDS posts

CHQ Letter to Department of Post about Vacancies

ALL INDIA GRAMIN DAK SEVAKS UNION (AIGDSU)

Ref:No.GDS/CHQ/79/1/2018

Date: 13.09.2018

To
The Secretary,
Department of Posts, Dak Bhavan,
New Delhi-110001

Sir,
Sub: Payment of revised waves Oct the outsider/substitute GDS who are working in short-term vacancies of regular GDS posts.

A kind reference is invited to the above mentioned subject where the substitute GDS are still drawing their TRCA in old scales. As per the recommendation of Sri.Nataraja Murthy committee orders were issued for payment of arrears to outsider/substitute GDS on revised TRCA, but up to this date nothing is heard so far. This issue was debated in our last All India Working Committee meeting held at Champawat, Uttrakhand. Hence it is requested to cause orders for payment of TRCA to the outsider/substitute GDS in the revised TRCA, including arrears w.e.f 1.01.2016.

An early orders in this regard would be highly appreciated at this end.

Thanking you.

Yours Faithfully,

Circular of AIGDSU: GDS Committee Kamlesh Chandra

Circular of AIGDSU: GDS Committee Kamlesh Chandra

ALL INDIA GRAMIN DAK SEVAKS UNION (AIGDSU)

GDS/CHQ/1/5/2018

Dated 04-09-2018

To

All Circles / Divisional/ Branch Secretaries of All India Postal Gramin Dak Sevaks Union, All India Office Bearers….

Dear Comrades,

Hearty Greetings,

We have scored some brownie points in implementation of Kamalesh Chandra GDS Committee though not to our satisfaction. For this achievement we had to wage a relentless struggle. You will agree that struggles requires and resources and we managed the affairs with our reserve fund.

We are aware that the department has played tricks in manipulating and distorting the committee’s report to the detriment of the GDS employees. And we shall have to be ready for a given fight. We are on the course of another struggle. We have submitted our list of issues which require solution. The department has adopted such tactics which have deprived us of our legitimate amount of arrears as recommended by the Committee. The date of effect of the new pay matrix from 01/07/2018 has hit us hard by inflicting cumulative losses which are hard to repairs several recommendations have been arbitrarily slashed while several vital recommendations appear to have been thrown into cold storage.

Shall we tolerate such injustice hands down or fight it with all our force? Certainly we shall strike hard to achieve every single pie that due to us. And struggles require resources. You will agree that your CHQ had to wage relentless struggle and has been able achieve some success. But in such struggles we used all our resources and the position today stands is that the CHQ is running short of funds. We may be required to take recourse to legal fight in courts on several issues and all these require fund and money.

May your CHQ, therefore appeals to our Divisional and Branch Secretaries to rise to the occasion. We understand that the arrears have been paid by now. Our appeal is that the Divisional/Branch Secretaries should raise CHQ struggle fund at the rate of Ks 100 per member and send to the CHQ by crossed D.D. to the CHQ. We sincerely hope that our appeal will be honoured.
Dear Comrades, for some times, the CHQ is not receiving due quota from the Divisional/ Branch Unions which has aggravated the situation still more. We request our Divisional/Branch Secretaries to clear all arrears of quota and send the amount by crossed Bank draft.

We note with sorrow that the Contribution to our union journal “Rural Post Employees” has drastically came down, you may please note that you cannot get the information through what’s App or internet that our journal will provide.

We request that all Committee members of all Divisional/Branch Unions should necessarily contribute to the journal as regular members by remitting annual subscription of Rs 60/-,

Comrades, you are aware that Kerala has been reeling under severe floods which has created severe devastation. Humanity is trouble. The CHQ has donated an amount of Rs 10,000/-. We request our Circle/Divisional/Branch Secretaries to donate liberally to the CM/s disaster management fund.

Comrades, with your cooperation we assure you that we shall march forward to achieve newer results for our members.

With warm Greetings,

Yours fraternally,
S.S. Mahadevaiah,
General Secretary

Minutes of the meeting held on 31.07.2018 at 11:30 A.M. at Dak Bhawan

GDS Meeting on 31.07.2018 – No Discussions on TRCA and Allowances

TRCA and allowances cannot be discussed with unions as these have been implemented after consultation with several departments and authorities. This statement virtually closes the door for discussions. If pay and allowances cannot be discussed, then what is the use of discussions or such meetings.

To

Department of Posts
Dak Bhawan
New Delhi – 110 001

Sub.:- Minutes of the meeting held on 31.07.2018 at 11:30 A.M. at Dak Bhawan.

Ref.:- Your office letter no. 08-05/2016-SR dated 2nd August 2018.

Sir,

We have gone through the minutes and have noticed that the minutes don’t represent the actual proceeding. The minutes mention what the officers of the department said. There is nothing much except a small stanza about what the union representatives said. As per the minutes an attempt has been made show as if the moon duly arranged on a platter has been handed over to GDS employees. We take up the minutes stanza by stanza here under:

Para 2. It is said that TRCA and allowances cannot be discussed with unions as these have been implemented after consultation with several departments and authorities. This statement virtually closes the door for discussions. If pay and allowances cannot be discussed, then what is the use of discussions or such meetings. The pay (TRCA) and allowances are the subjects which the G.D.S. employees are greatly concerned with. The unions don’t give threat of strike but they are compelled by such attitude of not discussing vital issues to resort to agitation. It is an open secret that the committee that examined the recommendations suggested many severe cuts. The department cannot take refuse behind other departments/authorities. Yes, the recommendations of the one man committee are by and large good but have been distorted by committee of officers which are preposterous and are detrimental to the interests of the Gramin Dak Sevaks.

Para 3. Gives a short description of what Sri S.S.Mahadevaiah, General Secretary AIGDSU said. No mention is made about the issues raised by the General Secretaries of AIPEU – GDS and NUGDS.

Pata 4. An attempt has been made to defend the indefensible. Even a layman knows that the code of conduct did not stretch over a period of 19 months. The fact of delay is that the committee of officers formed to study the recommendations of the one man committee was working overtime to distort the recommendations in order to deny benefits to the Gramin Dak Sevaks.

Pare 5. We don’t understand the logic behind such excuses of delay and cuts in the amount of arrears. Of course the committee suggested implementation of TRCA matrix from a prospective date. But never said or meant that the same should be after 19 months i.e., 01.07.2018. It certainly meant that the recommendation should be effective from 01.01.2017, when it gave illustrations for calculation of arrears which was for one year i.e., for 2016.

As regards the statement that the payment of arrear was of kind of exgratia nature and could be manipulated at the will of the establishment, no such announcement was made by the Hon’ble Minister of state for communication in the press conference. His announcement was clear and categorical that the arrears would paid from 01.01.2016 which meant that the arrears would be paid on the basis of the recommendations and illustrations given by the pay committee. We need not give a table showing the amount of loss suffered by the GDS employees between the amount due as per illustrations suggested by the committee and what has been paid according to Directorate orders. If desired, we shall produce such table which is ready with us.

As regards the arrears termed as “ex-gratia”, it is rather unfortunate. The recommendations were due to be implemented from 01.01.2016 and the amount of arrears is a due right of the Gramin Dak Sevaks and we are determined to have our due.

Para 6. The issues are decided earlier the better.

Para 7. We don’t understand the logic of rejecting the given recommendations, which are clamouring for being implemented.

Para 8. The GDS employees love the service they render to the public. The decisions of struggle are very painful to us and we take such decisions when the department refuses to discuss vital issues as indicated in the minutes and we are pushed to the wall.

We request you kindly to arrange a fruitful meeting with us to discuss all issues without any precondition. We shall be forwarding our agenda of issues which are agitating the Gramin Dak Sevaks, in another letter.

With regards,

Yours faithfully

Speedy implementation of GDS Committee recommendations and related matters

AIGDSU – Speedy implementation of GDS Committee recommendations and related matters reg

ALL INDIA GRAMIN DAK SEVAKS UNION (AIGDSU)
(Central Head Quarter)
First Floor, Post Office Building, Padamnagar, Delhi 110007

President: M. Rajangam
General Secretary S.S. Mahadevaiah

No.GDS Committee/Agit/2018

Date: 19.04.2018

To:

The Secretary,
Department of Posts,
Dak Bhavan,
New Delhi-110001.

Respected Sir,

Sub: Speedy implementation of GDS Committee recommendations and related matters reg.

In spite of our countrywide requests, memorials, protest meetings/Demonstrations and Strikes there is unreasonable delay in consideration and implementation of the GDS Committee recommendations. The level of tolerance has already crossed it limits. This time we have accepted OFFICERS Committee with open mind but still discriminative attitude is seen towards this low paid and neglected/exploited lot.

The Gramin Dak Sevaks role in future INDIA POST especially in Banking is more significant and we are also carefully watching the developments. There cannot be any compromise about their status and service conditions in the changed scenario and the GDS should get what they deserve. The Government, being a model employer, should consider our reasonable demands in the interest of service to the rural population of this country. The old policies of the British regime such as cheap labour and exploitation are outdated in the present situation and it is high time that decisions are at the appropriate levels in democratic norms. India is a welfare state and we are eagerly waiting for BETTER TREATMENT TO G.D.S AT LEAST THIS TIME.

We do sincerely hope that you will take personal interest in this matter and play vital role for speedy implementation OF ALL RECOMMENDATIONS OF THE COMMITTEE TO TAKE EFFECT FROM 01.01.2016 at par with 7th CPC extended to Departmental counterparts.

With profound regards,

Yours faithfully,
S/d,
S.S.MAHADEVAIAH
General Secretary

No.GDS ON COMPASSIONATE GROUNDS – MERIT POINTS AND PROCEDURE FOR SELECTION – CLARIFICATION REGARDING 17-17/ 2010-GDS

Dated: 09.10.2013

SUBJECT: SCHEME FOR ENGAGEMENT OF A DEPENDENT OF DECEASED GDS ON COMPASSIONATE GROUNDS – MERIT POINTS AND PROCEDURE FOR SELECTION – CLARIFICATION REGARDING

This has reference to your office letter No. Staff/175 -SEL / 2013 dated 29.08.2013 on the subject cited above.

2. In this context, it may be clarified that the Scheme was initially introduced in case of GDS subject to the same condition applicable to regular employees under No. 43-212/79/Pen dated 04.08.1980.  With the introduction of the merit points and procedure for selection under letter of even number dated 14.12.2010 as amended from time to time, all conditions applicable to compassionate appointment scheme relating to regular employees continue to apply in matters the Scheme does not envisage a specific provision in the context of compassionate engagement of a dependent of the GDC [in case of death only].

3. However, the doubts raised are clarified as under, which are in conformity with the provisions applicable to regular employees:-

S,NO. Point of doubt Clarification
1 Whether in case of death of GDS staffs, some points/score system for “outstanding liabilities for Education/Marriage of dependent children” “will be similarly applicable to unmarried sisters  (Whether minor or major) in case of unmarried deceased official? Yes.  Brother or sister in case of unmarried GDS are considered as dependent family members for the purpose of consideration of engagement on compassionate grounds.
2 In a case where the son of the deceased official who is applying for the job have attained majority age, working as cultivator, married and is having children residing with the family of the deceased, will he, his wife and children be considered as dependent of the deceased official or only he will be considered (without considering his wife and children as dependent) for earning points/scores for compassionate appointment? None.  A married son is not considered dependent on a GDS.
3 What is the definition of family for considering compassionate appointment cases, whether grandchild/grandchildren of the deceased official (blood relation) will also be considered part of the family of dependent/liability for education and marriage (in case granddaughter) for earning points/scores for compassionate appointment? No. The Scheme was initially introduced in case of GDS subject to the same conditions applicable to regular employees under No.43-212/79/Pen dated 04.08.1980.  The term defined in case of regular employees holds good in case of GDS also.  Grandchild/children are not considered dependent on a GDS, Dependent family member for the purpose means:
(a) Spouse; or
(b) Son (including adopted son);or
(c) Daughter (including adopted daughter); or
(d) Brother or sister in case of unmarried GDS
4 Whether brother also is a dependent of the deceased official and if so up to what age he will be considered dependent and will he be entitled for points/scores for all liabilities? Unmarried brother is considered dependent in case of unmarried GDS irrespective of age provided he was wholly dependent on the GDS at the time of his/her death & he must support other dependent members of the family & thus entitles to points/scores for all liabilities.
5 In case of an unmarried daughter/Son residing with the family and who have discontinued study at the time of death of the deceased official, whether education will be taken as liability and if so, up to what age? No. Points will be allowed in those cases only where the dependent family member was undergoing education at the time of death of the GDS.
6. Whether divorced daughter returning to the family with children will be entitled for Points/ Scores for unmarried liability for  her subsequent ,marriage? Yes.
7 Whether in case of death of departmental staff, the status of an only married daughter with husband staying with the family (with no other family member) of the deceased departmental official will be entitled to compassionate appointment in case of death of her father (a case of  Meghalaya) ? So far as the matter is confined to compassionate engagement of dependent of the GDS is concerned, married daughter can be considered for compassionate engagement provided she was wholly dependent on the GDS at the time of his /her death in harness and she must support other dependent members of the family

4. Contents of this letter may please be disseminated to all concerned. This issues with the approval of competent authority.
