Subject: Classification of Posts under the CCS (CCA) Rules, 1965.

 

The undersigned is directed to refer to this Department’s Order No. 8.0. 3578 (E) dated 9.11.2017 regarding classification of civil posts under CCS (CCA) Rules, 1965. As per this order, all civil posts except person serving in the Indian Audit and Accounts Department under the Union are classified as follows:

If, for any specific reason, a Ministry/ Department proposes to classify the posts differently, it would be necessary for that Department to send a specific proposal to Department of Personnel and Training giving full justification in support of the proposal within three months of this O.M. so that the exception to the norms of classification laid down in 8.0. 3578 (E) dated 9.11.2017 (copy enclosed) can be notified.

Subject: Frequently Asked Questions on timeline for completing Disciplinary proceeding in time bound manner under CCS (CCA) Rules, 1965.

Instructions have been issued in the past for expeditious disposal of disciplinary proceeding cases.  Further, Central Civil Services (Classification, Control & Appeal) Rules, 1965 have also been notified vide Gazette Notification No. 548(E) dated 2.06.2017 (copy enclosed) for introducing stringent timeline for  completing disciplinary proceeding in a time bound manner. Based on the same, a set of frequently asked questions is attached for necessary information.

2. Ministries/ Departments are requested to bring the contents of this O.M. to all concerned for compliance.

Subject:- Implementation of the recommendations of 7th Central Pay Commission: Discontinuation of Central Secretariat (Deputation on Tenure) Allowance to officers of Organized Group ‘A’ Services on their appointment as Under Secretary, Deputy Secretary and Director in the Central Secretariat under the Central Staffing Scheme.

This Department’s OM No. 2/22(A)/2008-Estt(Pay-II) dated 3rd September 2008 provided for rates of Central Secretariat (Deputation on Tenure) Allowance to officers of Organized Group ‘A’ Services on their appointment as Under Secretary, Deputy Secretary and Director in the Central Secretariat under the Central Staffing Scheme.

2. As provided in para 7 of Ministry of Finance (Department of Expenditure)’s Resolution No.1-2/2016-IC dated 25th July, 2016, the matter regarding allowances (except Dearness Allowance) based on the recommendations of the 7th Central Pay Commission (CPC) was referred to a Committee under the Chairmanship of Finance Secretary and until a final decision thereon, all allowances have been paid at the existing rates in the existing pay structure .

3. The decision of the Government on various allowances based on the recommendations of the 7th CPC and in the light of the recommendations of the Committee under the Chairmanship of the Finance Secretary, has since been issued as per the Resolution No.11-1/2016-IC dated 6th July 2017 of Department of Expenditure.

4. D/o Expenditure’s OM No.29/ 1/2017-E.II(B) dated 11.07.2017 also provided that disbursement of all existing allowances which have not been specifically recommended for continuation in terms of the Resolution dated 6th July,2017 shall be discontinued from the salary of the month of Jul,2017.

5. In view of D/o Expenditure’s OM No.29/1/2017-E.II(B) dated 11.07.2017, Central Secretariat (Deputation on Tenure) Allowance can not be paid without issue of a fresh O.M. All Ministries/ Departments may please take note for strict compliance.

Subject:- Grant of Deputation (Duty) Allowance – Recommendations of the Seventh Central Pay Commission – Regarding.

This Department’s OM No. 6/8/2009-Estt.(Pay-II) dated 17.6.2010 inter-alia provides for rates of Deputation (Duty) Allowance admissible to Central Government employees.

2. As provided in para 7 of Ministry of Finance, Department of Expenditure’s Resolution No.1-2/2016-IC dated 25th July, 2016, the matter regarding allowances (except Dearness Allowance) based on the recommendations of the 7th Central Pay Commission (CPC) was referred to a Committee under the Chairmanship of Finance Secretary and until a final decision thereon, all Allowances have been paid at the existing rates in the existing pay structure.

3. The decision of the Government on various allowances based on the recommendations of the 7th CPC and in the light of the recommendations of the Committee under the Chairmanship of the Finance Secretary has since been issued as per the Resolution No.11-1/2016-IC dated 6th July 2017 of Department of Expenditure.

4. As mentioned at Sl.No.46 of the Appendix-II of the said Resolution dated 6th July 2017, the recommendation of the 7th CPC for enhancement of ceiling of Deputation (Duty) Allowance for civilians by 2.25 times has been accepted and this decision is effective from 1st July, 2017. Accordingly, the President is pleased to decide that the rates of Deputation (Duty) Allowance and certain other conditions relating to grant of Deputation (Duty) Allowance shall be as under:-

The Deputation (Duty) Allowance admissible shall be at the following rates:

(a) In case of deputation within the same station the Deputation (Duty) Allowance will be payable at the rate of 5% of basic pay subject to a maximum of Rs.4500 p.m.

(b) In case of deputation involving change of station, the Deputation (Duty) Allowance will be payable at the rate of 10% of the basic pay subject to a maximum of Rs.9000 p.m.

(c) The ceilings will further rise by 25 percent each time Dearness Allowance increases by 50 percent.

(d) Basic Pay, from time to time, plus Deputation (Duty) Allowance shall not exceed the basic pay in the apex level i.e. Rs. 2,25,000/-. In the case of Government servants receiving Non Practising Allowance, their basic pay plus Non-Practising Allowance plus Deputation (Duty) Allowance shall not exceed the average of basic pay of the revised scale applicable to the Apex Level and the Level of the Cabinet Secretary i.e. Rs.2,37,500/-.

Note: 1 ‘Basic pay’ in the revised pay structure (the pay structure based on 7th Central Pay Commission recommendations) means the pay drawn by the deputationist, from time to time, in the prescribed Level, in Pay Matrix, of the post held by him substantively in the parent cadre, but does not include any other type of pay like personal pay, etc.

Note: 2 In cases where the basic pay in parent cadre has been upgraded on account of non-functional upgradation (NFU), Modified Assured Career Progression Scheme (MACP), Non Functional Selection Grade (NFSG), etc., the upgraded basic pay under such upgradations shall not be taken into account for the purpose of Deputation (Duty) Allowance.

Note 3 In the case of a Proforma Promotion under Next Below Rule (NBR): If such a Proforma Promotion is in a Level of the Pay Matrix which is higher than that of the ex-cadre post, the basic pay under such Proforma Promotion shall not be taken into account for the purpose of Deputation (Duty) Allowance. However, if such a Proforma Promotion under NBR is in a Level of the pay matrix which is equal to or below that of the ex-cadre post, Deputation (Duty) Allowance shall be admissible on the basic pay of the parent cadre post allowed under the proforma promotion, if opted by the deputationist.

Note 4 In case of Reverse Foreign Service, if the appointment is made to post whose pay structure and/ or Dearness Allowance (DA) pattern is dissimilar to that in the parent organisation, the option for electing to draw the basic pay in the parent cadre [alongwith the Deputation (Duty) Allowance thereon and the personal pay, if any] will not be available to such employee.

Note: 5 The term ‘same station’ for the purpose will be determined with reference to the station where the person was on duty before proceeding on deputation.

Note: 6 Where there is no change in the headquarters with reference to the last post held, the transfer should be treated as within the same station and when there is change in headquarters it would be treated as not in the same station. So far as places falling within the same urban agglomeration of the old headquarters are concerned, they would be treated as transfer within the same station.

5. Para 6.1 of this Department’s OM No.6/8/2009-Estt(Pay-II) dated 17.6.2010 stands amended to the above effect.

6. In so far as persons serving in the Indian Audit & Accounts Department are concerned, these orders issue after consultation with the Comptroller & Auditor General of India.

7. These orders shall take effect from 1st July, 2017

2. Names of willing and eligible officers, who have been empanelled to hold Joint Secretary or equivalent posts at the Centre under the Central Staffing Scheme, may be recommended to this office along with cadre clearance, vigilance clearance, detailed bio-data, viz. name, date of birth, service, batch, contact telephone number, email address, educational qualifications, complete experience/posting details etc. CR dossiers/certified ACRs for the last five years and details of debarment & cooling off in respect of past central deputation, In case the officers are currently on Central deputation, the nomination may be forwarded with the approval of the Minister-in-charge concerned.

3. The post is a Non-Central Staffing Scheme post to be filled up through the Civil Services Board (CSB) procedure. It may be noted that no ‘Mandatory Posting Certificate’ for allotment/retention of Government accommodation would be issued by this office to the officer appointed on the above referred post However, those officers who have served and are currently serving on Central Staffing Scheme post in Delhi for at least four years and require to retain Government accommodation, would be issued a certificate to the effect that the officer concerned has served for at least four years in CSS post and he/she needs to retain Government accommodation for his/her tenure on non-CSS post.

4. It is requested that the applications of the eligible candidates may be forwarded so as to reach this Departmentwithin one month from the date of issueof this circular.

Subject: Inviting comments on the definition of “Operational Staff” which would be eligible for Overtime Allowance

As per the Dept. of Expenditure’s Resolution No. 11-1/2016-IC dated 06.07.2017, following is the decision of Government on Overtime Allowance (OTA): “Ministries/Departments to prepare a list of those staff coming under the category of ‘Operational Staff’. Rates of Overtime Allowance not be revised upwards”. Further it has been clarified by the Dept. of Expenditure that the Government has decided that given the rise in the pay over the years, the recommendations of the 7th CPC to discontinue OTA for categories other than Operational Staff and industrial employees who are governed by statutory provisions may be accepted.

2. Accordingly, it has been decided to implement the aforesaid decision of the Government on Overtime Allowance across all the Ministries/Departments and attached and subordinate office of the Government of India.

3. However, this Department has been receiving queries from various Deptts. as
to which staff would be covered under the term “Operational“. Thus it appears that there is a lack of clarity as to what constitutes Operational Staff. In pursuance of decision taken on the recommendations of the 7th CPC relating to OTA, a broad definition has been attempted in order to assist in identification of operational Staff.

Definition: “All non-ministerial non-gazetted staff directly involved in smooth operation of the office including those tasked with operation of some electrical or mechanical equipment.”

4. Inputs and suggestions are requested from all Ministries/Departments taking into account the specific peculiar requirements of staff under each of them keeping in view the content of work being performed by them. The inputs /suggestions may be kindly sent to the undersigned on mail id: sandeep.saxena@nic.inwithin 15 days of the issue of this O.M.

Subject: Stepping up of pay of senior Assistants of CSS drawing less pay on promotion in the Section Officers Grade than their juniors -regarding.

Ref: OM No.18/2/2007-CS-l dated 20.05.2014 & 08.07.2014 and OM No.18/212014-CS.l(S) dated 27.12.20216.

Representations have been received from some CSS officers in whose case re-fixation and recovery orders have been issued by concerned Ministries/Departments in pursuance to DOPT OM dated 20.05.2014, requesting withdrawal of the OMs referred above.

2. It is once again clarified that OM No.5/16/80-CS.I dated 13.4.1988 was issued on acceptance of award by Board of Arbitration in CA Reference No.7 of 1984 which allowed stepping up of pay of an Assistant of CSS, who is senior by virtue of having been recruited through an earlier examination but is drawing less pay on promotion in the Grade of Section Officer than his junior recruited through a later examination, up to a level equal to the pay of such junior Section Officer in the same cadre i.e. senior DR Assistant to junior DR Assistant of later exam on their promotion as Section Officer. Vide OM No.5/21/92-CS.I dated 23.2.1994 this benefit of stepping up was extended to Section Officers appointed through Limited Departmental Competitive Examination (LDCE) (again applicable to DR Assistants only). OM No.5/1/96-CS.I dated 8.10.1996 further extended this benefit in case of promotee Assistants and also to the cases where both junior and senior have been recruited on the basis of the same Select List Assistants Grade Examination, as the case may be in accordance with judgements of CAT in OA No. 365/90 (Shri K.C. Sehgal VS UOI and CA No. 869/91 (Shri L.K. Chawla VS UOI), which were upheld by the Hon’ble Supreme Court.

3. That there are general guidelines of stepping up of pay issued by the Ministry of Finance vide OM No.F.2(78)-E.III(A) dated 0 .02.1966 and this Department vide OM dated 04.11.1993. One of the conditions of the general guidelines for allowing stepping up of pay to a senior govt. servant with reference to a junior is that the senior should have drawn more pay than the junior in the lower grade also.

4. However, certain clarifications were issued by CS-I Division, DoPT in 2007 and 2008 to individual Ministries/Departments, on references received from them, which were at variance with the general conditions of stepping up of pay i.e. stepping up of pay was allowed even if junior was drawing more pay than the senior in the lower grade i.e. in Assistant/Grade. Therefore, vide OM dated 29.5.2009, the clarification issued in 2007 & 2008 were withdrawn and Ministries/Departments were advised to strictly allow stepping up enforcing conditions laid down in OM dated 8.10.1996. Departments were also informed vide OM dated 21.05.2010 that as the matter was still under consideration, status-quo, as on date, might be maintained in the matter of stepping up of pay of Section Officers of CSS till the matter attains finality. Eventually, the matter attained finality and a consolidated OM as vetted by the Estt..(Pay) Division of this Department and Department of Expenditure was issued on 20.05.2014.

5. The Ministries/Departments were requested vide OM dated 20.05.14 that stepping up of pay already allowed in cases where the individuals are not covered by the OMs dated 13.04.1988, 23.02.1994 and 08.10.1996 and general conditions as laid down in OM dated 04.11.193, should be reviewed and pay re-fixed accordingly. That excess payments made to the employees in the cases of wrong stepping up of pay should be recovered in terms of DOP&T’s OM No.18/26/2011-Estt(Pay-l) dated 06.02.2014 and a compliance report in this regard furnished to this Department. It was further clarified vide OM dated 08.7.2014 that all the three OMs and general conditions of stepping up of pay are not exclusive of each other and the three OMs are to be read with and subject to the general conditions reiterated vide OM dated 4.11.1993, therefore, stepping up of pay is not to be allowed where junior was drawing more pay than the senior in the lower grade.

6. As regards, OA No.2884/2015 and similar OAs filed in this regard, it is observed that only applicants in these cases have been granted interim stay by the Learned CAT. That the said OAs have been filed by the applicants in the individual capacity. Thus in all those cases where stepping up of pay has been allowed, but where the benefited individuals were not covered by the OMs dated 13.4.88, 23.2.94 and 8.10.96 and the general conditions of stepping up of pay as laid down in the DOP&T’s OM No. 4/7/92-Estt(Pay-1) dated 04.11.93, pay will have to be re-fixed and recovery of excess payment, if any, is to be made.

7. Therefore, vide reminder OM dated 27.12.16, the Ministries/Departments were requested to expedite the compliance reports as requested vide OM dated 20.05.2014 except in those cases where matter of recovery is subjudice/stayed by order of any competent court.

8. It may be mentioned that one of the similarly placed officers, in whose case orders for stepping up of pay with reference to a promotee assistant was issued but not implemented, had approached CA (PB) through OA No.1199/2014(H.C. Rai vs. UOI). The CAT vide its order dated 28.03.17 while dismissing the OA had categorically ruled that the stepping up of his pay was not in consonance with the provisions of OM dated 20.05.2014 i.e. OMs dated 13.4.88, 23.2.94 and 8.10.96.

9. With regards difficulty being faced by some Ministries/Departments in establishing links/chain of officers in refixation/recovery matters, it is hereby mentioned that many Ministries/Departments have already issued re-fixation orders establishing links by themselves as per the instructions issued by this Department.

10. All the Ministries/Departments are thus again requested to furnish the compliance reports in the prescribed proforma, latest by 15th November 2017.

The undersigned is directed to refer to this Department’s Order of even number dated 13.10.2017 on the subject mentioned above, wherein the concerned Ministries/ Departments were requested to relieve the officer(s) concerned immediately so that the officers could join the allocated Ministry/ Department. Subject: Stepping up of pay of senior of CSS promotion in the Officers Grade than juniors – reg.

Representations have been received from some CSS officers in whose case re-fixation and recovery orders have been issued by concerned Ministries/Departments in pursuance to DOPT 0M 20.05.2014, requesting withdrawal of the OMs referred above.

2. It is once again clarified that 0M No.5/16/80-CS.l dated 13.4.1988 was issued on acceptance of award by Board of Arbitration in CA Reference No.7 of 1984 which allowed stepping up of pay at an Assistant of CSS, who is senior by virtue of having been recruited through an earlier examination but is drawing less pay on promotion in the Grade of officer than his junior recruited through a letter examination, up to a level equal to the pay of such junior Sexton Officer in the same cadre i.e. senior DR Assistant to junior DR Assistant of later exam on their promotion as Section Officer, Vide OM No.5/21/192-CS.I dated 23.2.1994 this benefit of stepping up was extended to Section Officers appointed through Limited Departmental Competitive Examination (LDCE) (again applicable to Assistants only). OM NO.5/1/96-CS.l dated 8.10.1996 further extended this benefit in case of promotee Assistants and also to the cases where both junior and senior have been recruited on the basis of the same Select List/Assistants Grade Examination, as the case may be in accordance with OA No.365/90 (Shri K.C.Sehgal Vs UOI and OA No .869/91 (Shri L.K. Chawla VS UOI), which were upheld by the Hon’ble Supreme Court.

3. That there are general guidelines of stepping up of pay issued by the Ministry Of Finance vide 0M No.F.2(78)-E.III(A) dated 04.02.1966 and this Department vide 0M dated 04.11.1993. One Of the conditions of the general guidelines for allowing stepping up of pay to a Senior Govt. servant with reference to a junior in the lower grade also.

The undersigned is directed to refer to this Department’s O.M.No.12011/04/2008-Estt(AL) dated 11-09-2008 and O.M.No.A-27012/02/2017-Estt.(AL) dated 16-08-2017 on the subject mentioned above and to state that the reimbursement of Children Education Allowance for differently abled Children of government employees shall be payable at double the normal rates prescribed. The annual ceiling fixed for reimbursement of Children Education Allowance for differently abled children of government employees is now Rs.54,000/- The rest of the conditions will be the same as stipulated vide O.M.No.12011/04/2008-Estt(AL)dated 11-09-2008.

2. These orders shall be effective from 1st July,2017.

Subject: Journey to Headquarters on LTC in respect of dependent family members of  the Government servant – Clarification – reg.

The undersigned is directed to refer to this Department’s O.M. No. 31011/14/86-Estt.(A-1V) dated 08.05.1987, which inter alia provides that the Govt. servant and the members of the family may claim LTC independently, however, reimbursement in such cases will be restricted to the actual distance travelled by the family or the distance between the headquarters/place of posting of the Government servant and the place visited/hometown, whichever is less.

2. Restriction of reimbursement to the distance from the Headquarter/place of posting creates an anomalous situation where the Government servant seeks to avail of LTC in respect of members of the family to the Headquarters/place of posting either from the Home town of the Government servant or from anywhere else. For illustration, a dependent child of a Govt. servant (posted in Delhi) staying and pursuing studies in Mumbai may visit a Government servant at his Headquarters/place of posting (i.e. Delhi) on LTC, however, reimbursement in such case shall be admissible for distance between the Headquarters and place of visit (which in this case is Headquarters itself), which shall be NIL in this case.

3.To resolve the issue, the matter has been considered by this Department in consultation with Joint Consultative Machinery – Staff side and Department of Expenditure. It is clarified that full reimbursement as per the entitlement of the Government servant shall be allowed for journey(s) performed on LTC by the family members from any place in India to Headquarters/place of posting of the Government servant and back. When such journey is performed from the Home Town, the LTC shall be counted against ‘Home Town’ LTC and in case the journey is from any other place in India, then it shall be counted against ‘Any place in India’ LTC.

4. The provisions of this OM (para 3) will have prospective effect.

Sub : Fixation of the pay of the pre-revised pay scale of 1S scale granted to candidates appointed as trainees on compassionate grounds in the Seventh Central Pay Commission (7th CPC) – reg.

The undersigned is directed to invite attention to this Department’s 0.M.No.14014/02/2012-Estt(D) dated 16.01.2013 containing consolidated instructions on the subject of compassionate appointments. With regard to appointment of candidates not immediately meeting the educational standards as trainees these instructions provide as under:-

“In exceptional circumstances Government may consider recruiting persons not immediately meeting the minimum educational standards. Government may engage them as trainees who will be given the regular pay bands and grade pay only on acquiring the minimum qualification prescribed under the recruitment rules. The emoluments of these trainees, during the period of their training and before they are absorbed in the Government as employees, will be governed by the minimum of the – 1S pay band Rs.4440-7440 without any grade pay. In addition, they will be granted all applicable Allowance, like Dearness Allowances, House Rent Allowance and Transport Allowance at the admissible rates. The same shall be calculated on the minimum -IS pay band without any grade pay. The period spent in the -1S pay band by the future recruits will not be counted as service for any purpose as their regular service will start only after they are placed in the pay band PB-1 or Rs.5200-20200 along with grade pay of Rs.1800.”

2. The 7th CPC has not provided any replacement scale for 1S pay, band of Rs.4440- 7440 without any grade pay which is granted to trainees appointed under the scheme for compassionate appointment. The matter was taken up with the Department of Expenditure and it has now been decided by the Government that Level-1 of the Pay Matrix introduced on implementation of the 7th CPC Report be the replacement for the pre-revised- 1S scale. The pay of those governed by the 1S scale may be revised by using the Fitment Factor of 2.57 for placement in Level-1 in conformity with the Rule, 7 of the CCS (RP) Rules, 2016. All pre – revised pay stages lower than pre-revised pay of Rs.7,000 in the pre-revised 1S scale shall not be considered for determining the benefit of bunching, on the same lines as has been clarified by this Department’s 0.M dated 03.08.2017 on application of the benefit on account of bunching.

3. This will be effective from 01.01.2016.

Subject: Appointment of officers working in the Ministries/Departments under CSS/ Non-CSS posts to National Institution for Transforming India(NITI), Aayog under Central Staffing Scheme on lateral shift basis.

Sir/ Madam,
It is proposed to fill up Two (2) vacancies of Deputy Secretary/Director level posts in the National Institution for Transforming India (NITI) Aayog under Central Staffing Scheme on lateral shift basis.
2. The officers who are working at QS/Director level in different Ministries/Departments under the Central Staffing Scheme/Non Central Staffing Scheme will be eligible to apply for these posts. If the officer is selected for the post, it will be treated as; a ‘lateral shift’, which would entail additional tenure of three years as per the special dispensation allowed for appointment in NITI Aayog that permits total deputation tenure up to 8 years on shift to NITI Secretariat or vice versa. The +3 option would be available only to those officers who are already working on a CSS/Non-CSS post. The additional tenure is subject to completion of two years on the present stint on the CSS/Non-CSS post and availability of cadre clearance. In the absence of cadre clearance (for +3 tenure), the tenure will be restricted to the balance period of four/five years central deputation tenure.

3. The post may be circulated amongst the officers working at Deputy Secretary/Director or equivalent level under the Central Staffing Scheme/Non Central Staffing Scheme in the Government of India on priority basis. Names of the willing and eligible officers who can be spared by the Ministries/Departments may be forwarded to this Department along with the approval of the Minister-in-Charge, cadre clearance (for +3 tenure), vigilance clearance, detailed bio-data in the enclosed proforma and attested copies of ACR(s) for the period for which they have worked under CSS/Non-CSS.

4. It is requested that the application(s) of the eligible officer(s) may please be forwarded so as to reach this Department within 3 weeks from the date of issue of this circular.

Subject: Revision of Pension in respect of Puducherry pensioners /family pensioners drawing pension under ex-French Rules on the line of revision of pension of Central Government Pensioners on the recommendations of VIIth Central Pay Commission – regarding.

Sir,

I am directed to say that the question of revision of pension of Puducherry pensioners / family pensioners drawing pension under the Ex-French Pension Rules in line with the revision of pension for Central Government Pensioners as per this Department’s O.M. No.38/37/2016-P&PW(A) (i) and (ii) dated 04.08.2016 has been under consideration of the Government of India. The President is now pleased to decide that the Puducherry pensioners and family pensioners shall also be eligible, as a special case, for benefit of revision of pension as enumerated in this Department’s G.M. dated 04.08.2016 referred to above i.e. by multiplying the pension /family pension, as had been fixed at the time of implementation of the 6th CPC recommendation by 2.57. However, the order regarding revision of pension as per Pay Fixation method available to the Central Govt. Pensioners vide this Department’s OM No. 38/37/2016-P&PW(A) dated 12.05.2017 shall not be applicable to these Ex-French Pension Rules pensioners / family pensioners.

2. The pensioners/ family pensioners, referred to above will also be eligible for dearness relief at the revised rates effective after the 7th CPC on the revised pension as per orders issued by the Government in this regard from time to time.

3. The pension/ family pension will be revised in terms of these orders by the Govt. of Puducherry in each case individually and the revised pension payment orders will be issued to the concerned pension disbursing authority for arranging payment. It may be ensured that proper and thorough physical verification of the beneficiaries is carried out before revision of pension / family pension.

4. The above mentioned benefits shall not, however, be admissible in the case of Pensioners / family of the deceased pensioners who have opted for French nationality and are drawing metropolitan Pension from the French Government.

5. These orders issue with the concurrence of the Ministry of Finance, Department of Expenditure, vide their I.D. No 30-1/33(iii)/2016-IC dated 13.07.2017.

Subject:- Modified Assured Career Progression Scheme for the Central Government Employee Clarification regarding.

the undersigned is directed to invite reference to the Para 4 of Annexure-I of the Modified Assured Career Progression Scheme issued vide the Department of Personnel and Training Office Memorandum No. 35034/3/2008-Estt.(D) dated May 19, 2009 providing that benefit of pay fixation available at the time of regular promotion shall also be allowed at the time of financial upgradation upder the scheme. Therefore, the pay shall be raised by 3% of the total pay in the pay band and the grade pay drawn before such upgradation. There shall, however, be no further fixation of pay at the time of regular promotion if it is in the same grade pay as granted under MACPS. However, at the time of actual promotion if it happens to be in a post carrying higher grade pay than
what is availalable under MACPS, no pay fixation would be available and only difference of grade pay would be made available.

2. References have been received from varios Ministries/Departments whether at the time of regular promotion/grant of Non-Functional scale, the employee may be allowed to draw the difference in Pay after availing regular increment in the Pay Band and Grade Pay w.e.f. date of
promotion or date of next increment consequent to MACP.

3. The matter has been considered in this Department in consultation with the Department of Expenditure and it has been decided that the para 4 of the Annexure-I of the MACP Scheme would be modified as under:

Benefit of pay fixation available at the time of regular promotion shall also be allowed at the time of financial upgradation under the Scheme. Therefore, the pay shall be raised by 3% of the total pay in the pay band and the grade pay drawn before such  upgradation. There shall, however, be no further fixation, of pay at the time of regular promotion / grant of Non Functional Scale, if it is in the same grade pay as granted under MACPS. However, at the time of actual promotion / grant of Non-Functional Scale, if it happens to be in a post carrying higher grade pay than what is available under MACPS, no pay fixation would be available and only difference of grade pay would be made available. At the time of such regular promotion/grant of Non-Functional Scale to the higher grade pay than what has been given under MACPS, the employee have the option to draw the difference of Grade Pays from the date of such regular promotion/grant of Non-Functional Scale or the date of accrual of next increment in the pay allowed under MACP”

DoP&T has been receiving many references from various Ministries/ Departments seeking clarification on the issue of grant of bunching to Assistant Section Officers of Central Secretariat Service in terms of Department of Expenditure’s O.M. dated 07.09.16.

2. It has also been noticed that there have been divergent views on the matter that while some Ministries/ Departments have given the benefit on their own, some other Ministries/ Departments have sought clarifications on various issues they are facing while giving the benefit of bunching in terms of DoE’s O.M. dated 07.09.16.

3. The matter has been taken up for further clarifications with Establishment Division/ Department of Expenditure briefly on the following issues:

i. While the Seventh Pay Commission had not prescribed different modes of pay fixation for Direct Recruit (DR) and Promotee ASOs, there have been two different modes of pay fixation for DR and Promotees prior to implementation of Seventh pay Commission. Due to differential methods of pay fixation, required differential of 3% is not calculable based on seniority alone as the other relevant facts of being DR/Promotee comes into play here.

ii. The manner of different pay fixation for DR ASO and promotee Assistants has been challenged in various court cases (viz. OA No.2147/2015, OA No. 150/2016, OA No.1015/2013 and OA No.476/2015 etc.)

4. It has already been decided to consult Department of Expenditure through Establishment (PEW) in the matter and same is under examination. Therefore, to ensure uniform implementation of Department of Expenditure’s instruction, all the Ministries/ Departments are advised to wait for further instructions with regard to grant of bunching benefits to ASOs of CSS and also if orders have already been issued by any Ministry/ Department, the same may not be given effect till further instructions.

5. This issues with the approval of competent authority.
