Dopt issued guidelines for giving information to the applicants under RTI Act

Format for giving information to the applicants under RTI Act- issue of guidelines regarding.

Subject: Format for giving information to the applicants under RTI Act- issue of guidelines regarding.

It has been observed that different public authorities provide information to RTI applicants in different formats. Though there cannot be a standard format for providing information, the reply should however essentially contain the following information:

(i) RTI application number, date and date of its receipt in the public authority.

(ii) The name, designation, official telephone number and email ID of the CPIO.

(iii) In case the information requested for is denied, detailed reasons for denial quoting the relevant sections of the RTI Act should be clearly mentioned.

(iv) In case the information pertains to other public authority and the application is transferred under section 6(3) of the RTI Act, details of the public authority to whom the application is transferred should be given.

(v) In the concluding para of the reply, it should be clearly mentioned that the First Appeal, if any, against the reply of the CPIO may be made to the First Appellate Authority within 30 days of receipt of reply of CPIO.

(vi) The name, designation, address, official telephone number and e-mail ID of the First Appellate Authority should also be clearly mentioned.

2. In addition, wherever the applicant has requested for ‘certified copies’ of the documents or records, the CPIO should endorse on the document “True copy of the document/record supplied under RTI Act”, sign the document with .date, above a seal containing name of the officer, CPIO and name of public authority; as enumerated below:

Further in case the documents to be certified and supplied is large in number, information on RTI application should be supplied by a designated PIO but the certification of the documents, if need be, could be done by an other junior gazetted officer.

Government favours discontinuing interview for appointment to various posts

 

Union Minister of State (Independent Charge) for Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances, Pensions, Atomic Energy and Space, Dr Jitendra Singh has said that the Union Government is in favour of doing away with the practice of holding interviews for appointment to junior level posts.

 

Presiding over a meeting of Principal Secretaries of General Administration Department (GAD)/Personnel from different States and Union Territories here today, Dr Jitendra Singh said that the Department of Personnel & Training (DoPT) has initiated a serious exercise for identifying the posts for which interview for selection can be discontinued and a communique in this regard has been sent to various State Governments, State Public Service Commissions and Staff Selection Commission. He said that this follows the suggestion put forward by the Prime Minister Shri Narendra Modi during his Independence Day address to the nation from the ramparts of the Red Fort.

 

Dr Jitendra Singh said that the government will soon identify all those posts, particularly at junior level like Group III & IV, where an interview is avoidable and will stop this practice. He said, for a post for which an interview is not necessary to determine the capability of a candidate, the provision of interview sometimes leads to scope for manipulation, manoeuvrability and corruption. Therefore, barring such posts where an interview would help in testing special capabilities for a particular assignment, abolition of the provision of interview will not only be in larger public interest but would also offer a level playing field for even those of the candidates who lack resources and come from lower socio-economic strata, he added.

 

Referring to some of the revolutionary decisions taken by the DoPT during the last 15 months of the present government, Dr Jitendra Singh made a special mention of the introduction of self-attestation of certificates. This, he said, not only eliminated inconvenience caused to the youth for going around to seek attestation of certificates from gazetted officers, etc., but also sent out a reassuring message that the present government has the capacity to trust the youth of this country. Similarly, he also referred to the Pension Department’s plans to finalise Pension Portal which would help in ending the practice of producing life certificates by a pensioner.

 

Dr Jitendra Singh also informed that a pilot exercise undertaken for three States of Jammu & Kashmir, Maharashtra and Tamil Nadu had proved successful wherein, for the first time, an Induction training programme was introduced for the newly inducted State-level functionaries and the same practice is now being extended to other States as well. He also referred to a landmark decision by the DoPT to revise and revisit the pattern and syllabus of IAS and other Civil Services Exam to offer a level playing opportunity for aspirants from different streams.

 

The meeting was attended among others by Secretary, DoPT, Shri Sanjay Kothari, Secretary, Department of Administrative Reforms & Public Grievances, Shri Devendra Chaudhry and Establishment Officer, DoPT, Shri Rajiv Kumar.

UR –  All unabsorbed and eligible PAs of previous zones and the PAs from CSL No. 1781 (SLY 2007) to CSL No. 1817 (SLY 2008) of Common Seniority List of PAs issued by this Department’s O.M. No. 4/7/2011-CS.ll (A) dated 13.07.2012 who have completed 5 years of ‘Approved service’ as on 01.07.2013.

SC & ST  – All unabsorbed and eligible PAs of previous zones and PAs who have completed 5 years of ‘Approved service’ as on 1.7.2013.

2. Other terms & conditions of this Department’s OM of even no. dated 27.02.2015 would remain unchanged. The requisite information be furnished to this Department in the prescribed proforma latest by 29.05.2015.

Subject: Stepping up of pay of senior Assistants of CSS drawing less pay on promotion in the Section Officers’ Grade man their juniors – OM No.18/2/2007-CS-I dated 20.05.2014 – Followup action regarding.
The undersigned is directed to refer to this Departments OM No.18/2/2007-CS-I dated 20.05.2014 and subsequent clarifications issued vide OM dated 08.07.2014 on the subject mentioned above.
2. The Ministries/Departments were requested vide OM dated 20.05.14 that stepping up of pay already allowed in cases where the individuals are not covered by the OMs dated 13.04 1988, 23.02 1994 and 08.10.1996 and where conditions laid down in the OM dated 04.11.1993 are also not fulfilled, may be reviewed and pay re-fixed accordingly. They were further requested that the excess payments made to the employees in the cases of wrong stepping up of pay may be recovered in terms of DOP&Ts OM No.18/26/201 1-Estt(Pay-I) dated 06.02.2014 and a compliance report in this regard furnished to this Department by 31.08.2014. However the compliance reports are still awaited from the Ministries/Departments.
4. The Ministries/Departments are once again requested to furnish the compliance report in this regard immediately.

OFFICE MEMORANDUM

Subject: Fixation of pay of State Government Employees on their appointment in Central Government, subsequent to implementation of CCS (RP) Rules, 2008.

The undersigned is directed to say that the method of fixation of pay of State Government employees on their appointment under the Central Government has been spelt out in this Department’s OM No.12/1/94-Estt(Pay-I) dated 24 March, 1994, 3rd January, 1996 and OM NO.13/2/99-Estt (Pay-I) dated 18.6.2001.

2. The question of fixation of pay in cases of appointment from State Govt. to Centrat Govt. consequent upon revision of pay scales on acceptance of the recommendations of the VI Central Pay Commission in the revised pay structure has been considered in consultation with the Department of Expenditure and the President is pleased to decide that in cases of appointment of State Government employees in Central Government on or after 1.1.2006, pay will be fixed in the following manner:-

(a) Where the State Government has revised the Pay scales of their employees on the pattern of VI Central pay Commission at the base index of 115.76 as per AICPI (IW) 2001 series w.e.f. 1.1.2006 the pay of these State Government employees on their appointment under the Central Government would be fixed as follows:

(i) When the appointment is to a post carrying higher Grade Pay, one increment equaI to 3% of the sum of the pay in the existing grade pay will be computed and rounded off to the next multiple of 10. This will then be added to the existing pay in the pay band. The grade pay corresponding to the higher post will thereafter be granted in addition to this pay in the pay band. In cases where the appointment involves change in pay band also, the same methodology will be followed. However. if the pay in the pay band after adding the increment is less than the minimum of the higher pay band to which the appointment is takihg place, pay in the pay band will be stepped up to such minimum.

(ii) Where the appointment is to a post involving identical Grade Pay, the individual shall continue to draw the same pay.
(b) Where the State Government have revised the pay scales of their employees after 1.1.2006 beyond the base index of 115.76 as per AICPI (IW) 2001 series, basic pay of the employees is to be determined first in the Central Scale by reducing the element of DA, ADA, IR etc. granted by the State Government after 1.1.2006 (beyond the base index of 115.76 as per AICPI (IW) 2001 series) and thereafter the pay would be fixed as provided in the clause (i) &(ii) under sub para (a) above.

(c) Where the state Government have either not revised or revised the pay scale of their employees on or after 1.1.2006 below the base index of 115.76 as per AlCPl (IW) 2001 series, basic pay of these employees shall be determined first in the Central scale, by adding the element of D.A. ADA upto base index of 115.76 as per AICPI (IW) 2001 series granted by the State Government and thereafter their pay would be fixed as provided in the clause (i) &(ii) under sub-para (a) above.

3. These orders are applicable to employees of the State Government and local bodies under the State including Emergency Divisional Accountants/Divisional Accountants / local bodies under the State Government appointed under Central Government on or after 1.1.2006.

4. In so far as the employees serving in the Indian Audit and Accounts Department are concerned, these orders issue after consultation with the Comptroller and Auditor General of India.

OFFICE MEMORANDUM

Subject: The Lokpal and Lokayuktas Act, 2013- Submission of declaration of assets and liabilities by the public servants belonging to CSSS & CSCS.
The undersigned is directed to refer to the subject mentioned above and to say that the Government has since notified the Public Servants (Furnishing of Information and Annual Return of Assets and Liabilities and the limits of Exemption of Assets in Filing Returns) Rules, 2014 under the Lokpal and Lokayuktas Act, 2013 on 14.07.2014. The same is available at the website of this Department.
2 Every public servant is now required to file declaration, information or return, as the case may be, regarding his assets and liabilities as on 31st March every year, to the competent authority, on or before 31st July of that year. Every public servant is also required to file revised declarations, information or as the case may be, annual returns as on the 1st August, 2014, to the competent authority on or before, 15th September, 2014.
3. All Ministries/Departments are, accordingly, requested to bring the provisions of the public Servants (Furnishing of Information and Annual Return of Assets and Liabilities and the limits for Exemption of Assets in Filling Returns) Rules, 2014 to the notice of all CSSS/CSCS officers under their administrative control.
4. The web based cadre management system will be modified to include all the forms now prescribed under the above quoted rules. However, it will take some time before it is incorporated in the system and made operational for filing of declarations, returns etc. In the meanwhile, all CSSS & CSCS Officers are advised to file hard copy of the revised declarations, information and returns to their Ministries/Departments well before the closing date of 15.09.2014. Ministries/Departments are requested to forward the declarations, information and returns submitted by PPS and above level officers of CSSS to CS-II Division, DoP&T for information and records.

Subject: Grant of Honorarium to Inquiry Officers (IO)/Presenting Officers (PO).

The undersigned is directed to refer to this Department’s OM of even number dated 31.7.2012 laying down the rates of honorarium payable to Inquiry Officer / Presenting Officer for holding departmental proceedings.

2. It has been brought to the notice of this Department that the condition mentioned in para 2.1 of the said OM, was in conflict with the provisions of FR 46 B which limits the maximum amount payable as honorarium to an individual in a financial year to Rs. 5,000/- creating confusion whether the same was within the delegated powers of the Ministry.

3. The matter has been considered and it is clarified that the honorarium payable to IO/Presenting Officer for conducting inquiry in departmental proceedings would be outside the purview of the general delegation under FR 46 B.

4. This issues with the concurrence of Department of Expenditure vide their I.D. No. 141412009-E.II(B) dated 16.5.2014.

Sub: Best Practices / New Initiatives introduced by the Department of Personnel & Training to boost morale and effective functioning of the employees of the Department – Regarding: 
During the year 2013-2014, the Department of Personnel & Training has introduced the following new initiatives to boost the morale of its employees and to give a fillip to their effective functioning: -

1. CERTIFICATE OF EXCELLENCE &
2. EMPLOYEE OF THE MONTH 
Realizing that recognition of meritorious performance of employees is a critical tool in human resource management, a new non-monetary incentive in the form of an annual award of “Certificate of Excellence” to recognize the contribution of its meritorious employees of the level of Under Secretary and below has been introduced. This initiative was circulated to all Ministries/Departments vide O.M. No. A-37011/1/2013-Ad.l, dated 18th December 2013 (copy enclosed).
Subsequently, another monthly non-monetary incentive was introduced wherein one employee from across all categories of employees of the level of Under Secretary & below was to be designated as ‘Employee of the Month’. The awardee is given a certificate and his photograph is displayed under the relevant link in the intra-Departmental (employee) Portal of the Department.
Under both the initiatives, nominations of eligible employees would be called for from all Wings of the Department and the work performance and outcomes achieved by such employees would be examined by a Committee Of Joint Secretaries in DoPT. The same Committee would meet once every month to assess the nominations received from various Wings to recommend award of ‘Employee of the Month’.
3. APPOINTMENT OF MENTORS FOR THE EMPLOYEES JOINING DoPT 
A process of mentoring of each ‘newcomer’ in the Department with a view to sensitize the incumbent about the Department and dealing with court cases, RFD, Parliamentary matters, etc., has been introduced in the Department. The mentoring process is for a period of six months. The mentor is to be an officer two levels above the incumbent.
4. EMPLOYEES’ INTERACTION WITH MOS (PP) AND SENIOR OFFICERS IN OPEN HOUSE SYSTEM 
An ‘Open House’ interaction of the Group ‘B’ (Non-Gazetted) employees and above was organized in October, 2013 which provided a platform to these employees to interact directly with MOS (PP) and other Senior Officers of the Department.
5. APPOINTMENT OF GRIEVANCE REDRESSAL OFFICERS IN EACH DIVISION 
In each Division, two Grievance Redressal Officers (GRO) have been appointed at US/DS/Director level to redress the grievances of the employees of inter-personal nature.
6. INSTALLATION OF ‘IDEA BOXES’ IN THE DEPARTMENT FOR SOLICITING ‘OUT OF THE BOX’ SOLUTIONS TO VARIOUS ISSUES 
The Department has installed ‘Idea Boxes’ to receive the innovative ideas from the employees to improve the functioning of the Department and to create a conducive work culture.
7. TRAINING OF THE EMPLOYEES WITH SPECIFIC FOCUS ON DEPARTMENT RELATED FUNCTIONS 
A training plan for the employees at the level of Under Secretary & below (and equivalent) of DoPT has been chalked out in consultation with ISTM. The duration of the Training Programme is one week, inclusive of a field visit outside Delhi.
8. RETREAT FOR OFFICERS OF THE LEVEL OF DS AND ABOVE IN THE DEPARTMENT 
The Department organized a two-day Retreat at LBSNAA, Mussoorie in October 2013 for the officers at the level of DS I Director & above in the Department. The objective of the Retreat was to discuss the stakeholders’ perception about the Department and develop an action plan to positively change the orientation of the Department towards service delivery.
9. INTRODUCTION OF INTERNSHIP SCHEME IN THE DEPARTMENT. 
The Department has introduced an ‘Internship Scheme’ under which applications are invited from students to work on selected topics relating to the functions of the Department. The duration of the internship is two months and they are given a stipend of Rs.10,000/- per month and a Certificate on successful completion of the internship and submission of report. The interns are selected by the Committee of Joint Secretaries.
2. The Ministries / Departments of the Government of India may consider adopting the above initiatives as a Human Resource Management Tool to motivate the industrious employees.

Sub:- Weeding out of files/records – reg.
The undersigned is directed to say that on review, a large number of old dossiers of ACRs/ APARs in respect of PSs, PPSs ahd Sr. PPSs retained in this section are being considered for weeding out. The ACRs/APARs of officers may be destroyed after five years/more from the date of his/her retirement. As per the instruction contained in this Department’s OM No. 21011/1/2005- Estt(A)(Part-III) dated 02.04.2012, before any ACR dossier is weeded out on completion the normal retention period, it may be certified by the concerned section that no request for handing over the ACR dossier has been received from that retired officer.
2. Accordingly, cadre units participating in CSSS are requested to intimate the details of ACRs/APARs of more than five years vintage in respect of which requests, if any, have been received for handing over from the concerned retired officer. Details of pending disciplinary/ court cases may also be furnished. In case the requisite information being ‘Nil’ the same may also be intimated.
3. In case, no information is received from a cadre unit by 30.06.2014, it will be presumed that the requisite information pertaining to that cadre unit is ‘Nil’.

CHARACTER OF POSTS 
Ministerial or non- ministerial 
Ministerial servant means a Government servant of a subordinate service whose duties are entirely clerical, and any other class of servant specifically defined as such by general or specific order of a local government. Local government does not include a Chief Commissioner. FR 9(17)
(a) Those member of Group B service whose duties are predominantly clerical shall be called as
(b) Having regard to the nature of the duties attached to them, the posts of Private Secretary to Secretaries and Joint Secretaries should be classified as ‘Ministerial’.
(c) Unless already classified, all new posts should be classified into ‘Ministerial’.
(d) Posts of Senior Gestetner Operator are to be classified as ‘Ministerial’
(e) All proposals regarding classification of posts as ‘Ministerial’ or ‘non-Ministerial’ should be referred to the Department of Personnel & Training who will, where necessary consult UPSC.
Industrial& Non-Industrial
Such of the staff who come within the meaning of ‘Workmen’ for the purposes of the Industrial Disputes Act. 1964, as amended from time to time, should be classified as ‘Industrial employees’.
Tenure posts 
Tenure post means a permanent post which an individual Government servant may not hold for more than a limited period. In case of doubt, the Central Government may decide whether a particular post is not a tenure post. FR 9(30A).
The Union Public Service Commission should be consulted before classifying a post, whether permanent or temporary, as a tenure post.
STATUS (GAZETTED OR NON-GAZETTED) 
CRITERIA :
(i) Group A posts and Group B non-ministerial and executive posts should ordinarily be
(ii) Group B ministerial posts may be given gazetted status only on very special considerations, such
(a) The officer already had gazetted status before appointment.
(b) The officer has commissioned or gazetted officers under his orders.
(c) The officer performs duties of a technical character requiring special qualifications.
(d) The office is periodically left in charge of the office during the absence of his superior on tour and
has to dispose of business and to deal with gazetted officers or businessmen/ on behalf of his
(iii) Group C posts to be treated as a rule, as non-gazetted.
All newly created posts, whether permanent or temporary, should be classified, as soon as created in consultation with Department of Personnel & Training
EX-OFFICIO SECRETARIAT STATUS
The instruction for the conferment of ex-officio secretariat status on officers holding non-secretariat posts are contained in the Ministry of Home Affairs O.M. No. 17/7/65-Estt(A) dated 16th November, 1967. According to these instructions, Secretariat status is necessary only for those officers who:
(a) sign communication, orders or notifications on behalf of Government.
(b) within the limits of the Rules of Business or secretariat Instructions, take decision on behalf of
Whatever there is a departure from the conditions stated at (a) and (b) above; the ex-officio status would lapse with the transfer/retirement of the present incumbent.
The conferment of ex-officio secretariat status on any non-Secretariat officer does not add to the status of the post held by him.

Subsequently, on references from certain Ministries/Departments clarifications in this regard had been issued during 2007-08. These clarifications were withdrawn vide OM No. 18/212007-CS.I(S) dated 29.5.2009 and the Ministries/Departments were asked vide OM No.18/2/2007-CS.I(S) dated 21st May, 2010 to maintain status-quo in the matter till the same is finally settled.

Vs. National Federation of Blind & Ors. and this Department’s O.M. of even no. dated 03.12.2013.

2. The Ministries/Departments/Organisations of the Government of India were requested to furnish data on vacancies available and posts identified for persons with disabilities in all the cadres under their control, including attached offices, subordinate offices, public sector undertakings/Government companies, cantonment board and the services under their administrative control so that consolidated Status Report could be filed before the Hon’ble High Court of Delhi before the next date of hearing on 28.04.2014.

1.Whether the examination fees as charged by the school is reimbursable?
“Examination fee” has been included as part of reimbursable items as indicated in para 1(e) of O.M. dated 2nd September, 2008, subject to the fulfillment of other existing conditions vide) OM No.12011/01/2012-Estt.(AL) dated 31-07-2013. The said orders do not have a retrospective effect.
2. Whether reimbursement of amount of fee paid during 1at and 2nd quarter could be claimed in 3rd or 4th quarter, without the fee receipts of the 3rd and 4th quarter?
No. As it is reimbursement for the whole year, original receipts for the fee paid for the 3rd / 4th quarter has to be submitted to ensure that the child has not dropped out of the school in the mid-session. O.M. No.12011/01/2013-Estt. Allowances dated 23.04.2013 refers.
3. Whether a Government servant is required to give a certificate that the spouse, if earning, has not claimed CEA?
Yes. In terms of O.M. No.12011/01/2013-Estt.(Allowances) dated 23.04.2013, the claimant Government servant is required to furnish an undertaking that reimbursement of CEA has not been claimed in respect of the child by the spouse of the claimant.

Subject: Amendment of Recruitment Rules/Service Rules -regarding.

The UPSC has undertaken an analysis with respect to the Ministries/Departments from whom RR proposals have either rarely been received or not received at all in the Commission during the last three years. From the aforesaid analysis the following conclusions have been drawn by UPSC:

i) There are cases where the Ministries were granted approval by the Commission for filling up the post as a one-time measure, pending finalization of recruitment rules. However, the Ministries have not framed the recruitment rules of such posts as a follow up to the same.

ii) Recruitment Rules are not being amended on a regular basis (every five years) as required as per the norms of DoPT.

iii) Instances have been noticed where the regular posts are filled up by the Ministries/Departments themselves without consulting the Commission, by appointing consultant or by making ad-hoc appointments.

iv) Ministries/Departments have not specified the posts which are exempted from consultation with the U.P.S.C. or taken out of the purview of the U.P.S.C.

2. DoPT instructions contained in O.M. No. 39021/5/83-Estt. (B) dated 9th July, 1985 and OM No. AB 14017/79/2006-Estt.(RR) dated 6th September, 2007 provide that where no Recruitment Rules exist or where the existing Recruitment Rules are repealed as per the prescribed procedure, the option of approaching the UPSC for suggesting one time method for recruitment to the post would be available. Accordingly, Ministries/Departments are advised to ensure that no ad-hoc appointment should be made in the absence of recruitment rules. In case there are overriding compulsions for filling up any Group A or Group B post in the absence of Recruitment Rules, they should make a reference to the UPSC for deciding the mode of recruitment to fill up the post on regular basis.

3. DoPT guidelines on framing/amendment/ Relaxation of Recruitment Rules dated 31.12.2010 vide Para 3.1.5 provide that the Recruitment Rules should be reviewed once in 5 years with a view to effecting such change as are necessary to bring them in conformity with the changed position, including additions to or reductions in the strength of the lower and higher level posts. Further, consequent upon the implementation of 6th CPC recommendations, DoPT vide OM dated 24.3.2009 issued instructions to all the Ministries/Departments to initiate action to amend the existing Service Rules/Recruitment Rules in view of the revised pay structure/merger of pre-revised pay scales/up-gradation etc.

UPSC has observed that many Ministries/Departments are not adhering to these instructions and requisitions are being received from them to operate recruitment rules notified even twenty five years ago. Ministries/Departments are, therefore, once again directed to effect necessary amendments to the Recruitment Rules/Service Rules after following the due procedure of furnishing proposals to the Department of Personnel & Training and the UPSC.

4. Ministries/Departments need to ensure that appointment to all posts are effected as per the provisions in the Recruitment Rules which are statutory in nature and adhere to these instructions scrupulously.
