Sub:- Discontinuation of Direct Recruitment to the posts of Senior Section Engineers (SSEs).

Attention is invited to Board’s letter No. E(NG)I/2008/PM1/15 dated 03.09.2009 which inter alia lays down that 20% of the vacancies in Group ‘C’ posts of Senior Section Engineer(SSE) in Civil Engineering, Electrical, Mechanical, Signal & Telecom and Track Machine Organization (TMO) Departments will be filled by direct recruitment.

This provision of direct recruitment in the post of SSEs has since been reviewed by Board. It has been decided to provisionally discontinue direct recruitment in the post of SSEs. This decision will be reviewed after one year. Therefore, all direct recruitment in all technical supervisory categories for the present be only in the post of Junior Engineers (JEs). Vacancies of SSEs may accordingly be added to those of Junior Engineers (JEs) for the purpose of direct recruitment.

Reference has been received from one of the zonal railways, seeking clarification, whether Board’s instructions contained in the letter of even number dated 21.02.2018 (RBE No.25/2018), regarding relaxation of upper age limit are applicable in the case of engagement of substitutes or otherwise.

The matter has been looked into and it is clarified that relaxation in upper age limit provided vide RBE No.25/2018 are also applicable in the case of engagement of substitutes.

Direct Recruitment to Group C – Reservation Fixed on the basis of Population

“In case of direct recruitment to Group C posts normally attracting candidates from a locality or a region, the percentage of reservation is generally fixed on the basis of proportion of their population in the respective States/Union Territories”

Article 16(4) of the Constitution enables provision of reservation to backward class of citizens, who are not adequately represented in the services under the State.

As per extant instructions, reservation is provided to Scheduled Castes, Scheduled Tribes and Other Backward Classes at the rate of 15%, 7.5% and 27% respectively in case of direct recruitment on all India basis by open competition. In case of direct recruitment on all India basis otherwise than by open competition, the percentage fixed is 16.66% for Scheduled Castes, 7.5% for Scheduled Tribes and 25.84% for Other Backward Classes.

In case of direct recruitment to Group C posts normally attracting candidates from a locality or a region, the percentage of reservation is generally fixed on the basis of proportion of their population in the respective States/Union Territories.

The services under the State come under the List II of the Seventh Schedule i.e. State List of the Constitution. The information on the state-wise provisions for reservation is not centrally maintained.

As per the 9 Judge Bench Constitutional judgment of the Supreme Court in Indira Sawhney case, total reservation cannot exceed the limit of 50%. In the same judgment, the Supreme Court has also observed that clause (4) of Article 16 of Constitution speaks of adequate representation and not proportionate representation.

This was stated by the Union Minister of State (Independent Charge) of the Ministry of Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances & Pensions, Atomic Energy and Space, Dr Jitendra Singh in a written reply to question in the Lok Sabha today.

Subject: Reservation for Ex-servicemen in direct recruitment Group ‘C’ posts – Regarding

Reference is invited to the reservation, concessions and relaxations applicable for ex-Servicemen in Central Government Services (Group ‘C’ posts). The Government of India has been issuing instructions from time to time for filling up of vacancies under prescribed quota reserved for ex-servicemen category. In this regard the DoPT has issued compendium of instruction on reservations for Ex-servicemen – consolidation of instructions vide OM. No.3603/4/3/2013-Estt.(Res.) dated 25th February, 2014.

All Pr.CCA.s/CCAs/CAs (with independent charge) are therefore requested to ensure that the provisions/ rules for Ex-servicemen notified under Ex-servicemen (Re-employment in Central Services and Posts) Rules. 1979. as amended from time to time are being properly followed up/implemented while forwarding of vacancies or direct recruitment posts to this office for consolidation. The non-implementation of reservations prescribed for ex-servicemen shall be treated as violation of Govt. of India’s instructions on the subject.

Vacant Posts in Central Government for different Categories 

Category-wise data on vacant posts is not maintained centrally.

As per the data received from 79 Ministries/Departments for the year 2014-2015, 18822 employees (8.56%) were recruited from Minority Communities in Government services and PSUs.

As per the data received from 44 Ministries/Departments for the year 2015-2016, 2851 employees (7.5%) were recruited from Minority Communities in Government services and PSUs.

As per information available on the URL www.rrcps.nic.in, in respect of 74, 69 and 50 Ministries/Departments for the years 2013, 2014 and 2015 respectively, the representation of SC, ST and OBC categories in the appointments made through Direct Recruitment is as following:-

The posts sanctioned in Government Ministries/ Departments are required to be filled as per the Recruitment Rules as and when vacancies arise. The filling up of posts is a continuous process depending on the vacancies arising across Ministries/Departments during the years and action calendars of the recruitment agencies. In this regards all Ministries/Departments have been requested to take advance action for reporting vacancy position with respect to Direct Recruitment Posts to recruitment agencies such as Union Public Service Commission (UPSC) and Staff Selection Commission (SSC) etc. Further all Ministries/ Department have also been requested for timely convening of the Departmental Promotion Committee meeting for filling up of promotional posts.

This was stated by the Minister of State in the Ministry of Personnel, Public Grievances and Pensions and Minister of State in the Prime Minister’s Office Dr. Jitendra Singh in a written reply to a question by Shri Nalin Kumar Kateel in the Lok Sabha today.

2. It has been observed that, so far, the necessary action for abolition of 85% posts of JSA falling vacant has not been complied with.

3. The concerned Ministries/Departments are requested to take necessary action to abolish the remaining posts immediately and furnish a compliance report to this Department along-with a copy of the Office Order of the number of posts abolished.

DoPT to Department: Complete Recruitment Process Within 6 Months

NEW DELHI: All government departments need to complete direct recruitment process within six months of the closing date of receipt of applications mentioned in the advertisements, according to draft guidelines formed by the Centre.

The draft prepared by the Department of Personnel and Training (DOPT) says there was “unduly large” delay in recruitment process undertaken by many central government departments.

“All ministries or departments are, therefore, requested that while initiating the recruitment process to fill vacant posts by the method of direct recruitment in their ministries or departments, they may ensure that the recruitment process i.e., conducting written examination or holding of interviews is completed within six months from the closing date of receipt of applications mentioned in the advertisement,” the Department of Personnel and Training (DoPT) has said in draft instructions.

It has come to notice of DoPT that ministries which undertake direct recruitment for various posts in the Government of India by conducting competitive examinations or interviews, are not adhering to the time frame for that purpose.

“It is seen that in many cases the time gap between the date of advertisement for the vacancy and date of examination or interview is unduly large and defeats the object of early recruitment process.

“Further, delay of recruitment process by more than a year will deny the opportunity to fresh candidates who become eligible during that year,” it said in a note to all central government ministries seeking comments. The DoPT has asked all ministries to send their views on the draft by November 16.

Sub: Upper age limit for direct recruitment to non-gazetted posts on the Railways.

In terms of Board’s letter of even number dated 10/5/1999 (RBE No… 99 /1999), an across the board relaxation of three years above the prescribed upper age limit in open market recruitment to all non-gazetted posts including engagement of Substitutes on the railways has been provided. The currency of this relaxation contained in letter of even number dated 10.5.1999 (RBE No. 99/1999) has been extended from time to time and was available up to 03.2.2015 in terms of RBE No. 57/2012.
The matter has further been reviewed and it has now been decided by this Ministry to provide relaxation in the following manner above the prescribed upper age limit for recruitment to all non-gazetted posts including engagement of Substitutes:-

Dispatch Rider/MTS Group C staff to now get reimbursement for acquiring Driving Licence for Motor Cars

In a bid to encourage filling up of the post of Staff Car Driver (Ordinary Grade) through the method of Deputation/Absorption, the Department of Personnel & Training (DoPT) has issued orders to allow the Dispatch Riders and Multi-Tasking Staff (MTS) Group C employees, provided they fulfil the criteria laid down in the Recruitment Rules of the post of Staff Car Driver, avail reimbursement for acquiring Driving Licence for Motor Cars.

The DoPT has also advised various Ministries/Departments to review the existing Recruitment Rules for the post of Staff Car Driver and bring them in conformity with the Model Recruitment Rules issued by the DoPT on July 7, 2014. Accordingly, the post of Staff Car Driver (Ordinary Grade) is to be filled by Deputation/Absorption failing which by Direct Recruitment.

Vacancies of Staff Car Driver will thus be filled first by Deputation / Absorption from amongst the regular Dispatch Rider (Group C) and Group C employees in Pay Band-I: Rs. 5200-20200 Grade Pay Rs. 1800 in the same Ministry / Department who possess valid Driving License for Motor Cars failing which from employees of equivalent posts in other Ministries / Department of the Central Government who fulfil the necessary qualifications.

Sub:- Filling up of vacancies of Sr.SO(A/cs) Sr.ISA and Sr.TIA Grade Rs.9300-34800 / Grade Pay Rs.4800/-through direct recruitment.

There are large number of vacancies of supervisory staff (Sr.SO/A/cs, Sr.TIA and Sr.ISA), of Accounts department on Railways. Shortage of the supervisory staff has resulted in accumulation of arrears, internal checks in Accounts Offices, Stations and Stores depots which is hampering the mandatory internai check mechanism and efficiency of Accounts department.

Despite arranging intensive training for departmental examination (Appendix-3 IREM) to aspiring candidates, sufficient number of candidates are not qualifying the examination. In this regard some of the Railways have approached Board’s office for recruitment of supervisory staff of Accounts department through RRBs. In order to meet with the situation, it is proposed to till 50% of the existing vacancies (as on 1/1/14) of Sr.SO/A/cs, Sr.TIA and Sr.ISAs through direct recruitment as a one-time measure. Similar course was adopted in the past for tilling up of posts of TIAs on N F Railway.

The existing staff will also be eligible for appearing in the proposed special recruitment in terms of para 115(iv) of Board’s letter no. E(NG)-II/2001/RR-1/35 dated 17/12/02 (RBE 221/2002) to appear in the recruitment examination of supervisory staff of Accounts department through RRB as departmental candidates.

Subject: Inter se seniority of direct recruits and promotees – instructions thereof

The undersigned is directed to refer to the subject mentioned above and to say that the fundamental principles of inter se seniority of direct recruits and promotees in Central Civil Services/posts were laid down in the Department of Personnel & Training (DOPT) O.M. No. 9/11/55-RPS dated 29.12.1959 which provided, Inter alia, that the relative seniority of direct recruits and of promotees shall be determined according to the rotation of vacancies between direct recruits and promotees, which shall be based on the quotas of vacancies reserved for direct recruitment and promotion respectively, in the Recruitment Rules.

2. The carrying forward of unfilled slots of a vacancy year, for being filled up by direct recruits of later years, was dispensed with through modified instructions contained in D0PT 0.M. No.35014/2/80-Estt.(D) dated 7.2.1986 which provides that rotation of quotas for purpose of determining seniority would take place only to the extent of the available direct recruits and the promotees. The unfilled direct recruitment/promotion quota vacancies would be carried forward andadded to the corresponding direct recruitment/promotion quota vacancies of the next year (and to subsequent years where necessary) for taking action for the total number of direct recruitment/promotioal according to the usual practice. Thereafter, in that year, while seniority will be determined between direct recruits and promotees, to the extent of the number of vacancies for direct recruits and promotees, as determined according to the quota for that year, the additional direct recruits/promotees selected against the carried forward vacancies of the previous year, would be placed en-bloc below the last promotee/direct recruit, asthe case may be, in the seniority list, based on the rotation of vacancies for that year.

3. All the existing instructions on seniority were consolidated by DOPT through a single OM. No. 22011/7/86 Estt(D) dated 03.07.1986.

4. In view of divergent stance taken by different Ministries/Departments on interpretation of ‘available direct recruits and promotees’ in the context of OM dated 7.2.86, the DoPT had issued O.M. No. 20011/1/2006-Estt.(D) dated 3.3.2008 which provided that the actual year of appointment, both in the case of direct/recruits and prornotees, would be reckoned as the year of availability for the purpose of rotation and fixation of inter se seniority.

5. The matter has been examined in pursuance of Hon’ble Supreme Court Judgment on 27.11.2012, in Civil Appeal No. 7514-7515/2005 in the case of N.R.Parmar vs. UOl & Ors in consultation with the Department of Legal Affairs and it has been decided, that the manner of determination of Inter-se-seniority of directrecruits and promotes would be as under:

a) DoPT OM No. 20011/1/2006Æstt.(D) dated 3.3.2008 is treated as non-existent/withdrawn ab initio;

b) The rotation of quota based on the available direct recruits and promotees appointed against the vacancies of a Recruitment Year, as provided In DOPT O.M. dated 7.2.1986/3.07.1986, would continue to operate for determination of inter se seniority between direct recruits and promotees;

c) The available direct recruits and promotees, for assignment of inter se seniority, would refer to the direct recruits and promotees who are appointed against the vacancies of a Recruitment Year;

d) Recruitment Year would be the year of initiating the recruitment process against a vacancy year;

e) Initiation of recruitment process against a vacancy year would be the date of sending of requisition for filling up of vacancies to the recruiting agency in the case of direct recruits; in the case of promotees the date on which a proposal, complete In all respects, is sent to UPSC/Chairmarn-DPC for convening of DPC to fill up the vacancies through promotion would be the relevant date.

f) The initiation of recruitment process for any of the modes viz, direct recruitment or promotion would be deemed to be the Initiation of recruitment process for the other mode as well;

g) Carry forward of vacancies against direct recruitment or promotion quota would be determined from the appointments made against the first attempt for filling up of the vacancies for a Recruitment Year;

h) The above principles for determination of inter se seniority of direct recruits and promotees would be effective from 27.11.2012, the date of Supreme Court Judgment in Civil Appeal No. 7514-7515/2005 In thecase of N.R. Parmar Vs. UOl & Ors

I) The cases of seniority already settled with reference to the applicable interpretation of the term availability, as contained in DoPT O.M. dated 7.2.86/3.7.86 may not be reopened.

7. As the conferment of seniority would be against the Recruitment Year in which the recruitment process is initiated for filling up of the vacancies, It is incumbent upon all administrative authorities to ensure that the recruitment process is initiated during the vacancy year itself. While requisition for filling up the vacancies for direct recruitment should be sent to the recruiting agency, complete in all respects, during the vacancy year itself, the timelines specified in the Model Calendar for DPCs contained in DoPT O.M. No.22011/9/98-Estt(D)dated 8.9.98 and the Consolidated Instructions on DPCs contained In O.M.No.22011/S/86-Estt(D) dated April 10, 1989 should be scrupulously adhered to, for filling up the vacancies against promotion quota.

Sir,

This Department has received letters from Bank of Baroda. Andhra Bank , SBBJ and SBT (subsidiaries of SBI), seeking clarification on observations and directions of the Assistant Director, NCSC, State Office for Gujarat. Rajasthan, D&NH and Daman & Diu at Ahmedabad, that Banks ought to have consulted the Commission before implementing the orders regarding ‘not applying reservation for SCs/STs where quantum of direct recruitment (in clerical cadre) is more than 75% and that Banks should not proceed further in the matter of promotion to clerical cadre till further orders from the Commission. The Commission also advised that in case bank desires to continue with the existing policy, it should approach NCSC for proper consultation/permission or to go for a change of the promotion policy as it is not in conformity with the Act. It is understood that Commission has already taken up the matter with SBI Hqrs
2 The matter was taken up with Department of Personnel & Training, Ministry of Personnel, PG and Pension. DOP&T has invited attention to their OM No. 36012117188-Estt.(SCT), dtd, 25.4.89, which clarifies that if the percentage, ‘in direct recruitment’ is more than 75% then reservation is not applicable in promotions.

3. Further, while examining some directions of NCSC to DOP& T (NCSC & ST’s letter No. 4/3/98-SSW.II dtd. Nil refers), a copy of which was also endorsed to other Ministries/Deptts. under the Central Government for compliance, vide its OM No. 36036/2/97-Estt,(Res.), dtd. 30.11.1998, DOP&T clarified that though the NCSC&ST is vested with certain powers to safeguard the interests of SC/STs in order to discharge its role in terms of Art.338 of the Constitution. However, the NCSC has only advisory powers and it does not have the authority to issue directions in the nature of injunctions.
This view was upheld by the Supreme Court in Appeal (Civil) 13700 of 1996 All India Indian Overseas Bank SC & ST Employees Welfare Association vs. Union of India case and the directions were given as under:
“All the Procedural powers of a Civil Court are given to the Commission for the purpose of investigating and inquiring into these matters and that too for that limited purpose only. The powers of a Civil Court of granting injunctions, temporary or permanent, do not inhere in the Commission nor can such a power be inferred or derived from a reading of clause 8 of Article 338 of the Constitution.
The Commission having not been specifically granted any power to issue interim injunctions, lacks the authority to issue an order of the type found in the letter dated March 4; 1993. The order itself being bad for want of jurisdiction, all other questions and considerations raised in the appeal are redundant. The High Court was justified in taking the view it did. The appeal is dismissed No costs”.
The letter further suggests that Ministries/Deptts. may ignore such instructions issued by the Commission as may purport to either amend or withhold or keep in abeyance the instructions issued by the Government in implementation of the reservation policy for the SCs/STs.
4 All service disputes including those in Public Sector Banks are to be resolved within the four corners of the constitutional provisions and tenets of law.
5. In view of foregoing and the fact that as PSBs enjoy autonomy in their HR matters, no prior consultation with DOP& T or NCSC appears desirable while implementing their recruitment policies unless there is a departure from the policies laid down by the Government.

Kindly refer to this office letter dated 02.08.20 13 on the subject cited above, it has been decided by the competent authority to give one more opportunity to the candidates who have been offered appointment to the post of Assistant / UDC and could not join within the stipulated date due to certain reasons. Now they may be given another extended opportunity to join upto 30th September 2013.

You are therefore, requested to issue necessary directions to all the candidates to join their duties by 30th September,2013 failing which the offer issued to them would automatically be treated as withdrawn.

A consolidated report regarding joining/non-joining and withdrawal of offer of appointment may be given to the undersigned by 07th October, 2013 positively by email.

Subject: Stepping up of pay to the direct recruit JWMs at par with junior

References have been received by this office regarding stepping up of pay to the directly recruited JWMs through UPSC at par with those JWMs who had been placed at the same grade by virtue of merger of posts of AF and JWM as per 6th CPC, in the light of DOPT OM No. 200020/4/2010-Estt.(D) dtd 13.9.2012.

In this connection, it may be stated that ibid DOPT order has defined only the seniority position of Govt. servants as on 29-08-2008 in respect of holder of post having higher pay scale or post which constituted promotion post for the posts in the feeder grade vis-a-vis to those holding post having lower pay scale or posts in feeder grade but placed w.e.f 1.1.2006 to the higher post due to merger of posts. The clarification thus effectively defines placement of Govt. servant who got the benefit of merger below the Govt. servants who were already holder of the higher post prior to the date of implementation of 6th CPC i.e, 29.8.2008. However, such seniority to the holder of the post does not entitle them any stepping up of pay benefit as pay of the juniors hove been fixed based on the pay they already earned by virtue of their service.

Attention is also invited in this regard to clause 2(e) of GOI decision no.23 under FR 22 where it has been clearly stated that “where a person promoted from lower to a higher post, his pay is fixed with reference to the pay drawn by him in the lower post under FR-22 1(a)(i) and he is likely to get more pay than a direct appointee whose pay is fixed under different set of rules. In such cases, the senior direct recruit cannot claim pay parity with the junior promoted from a lower post to higher post as seniority alone is not a sole criteria for allowing stepping up”.

Keeping in view of the above, it is felt not to extend stepping up benefit in such type of cases.

The issue of laying down uniform guidelines for issuance of notification for open market recruitment for the vacancies accruing during the period 01/1/2014 to 31/12/2014 has been under consideration of this Ministry. The matter has been examined and the decisions arrived at by the Board are apprised for compliance:- .

(a) The current procedure of selection from open market in vogue shall be adhered to and notification adhering to the same may be issued;

(b) While the other Railway Recruitment Cells will restrict themselves to the procedure of calling applications physically, RRC/Southern Railway only, as a pilot project, will give the option to the candidate to apply physically and online;

(c) Instruction contained in Board’s letter No. 2011-E(SCT)1/104/1 dated 25/9/20 12 (copy enclosed) be adhered to while issuing aforesaid notification; and

(d) Vacancies against Ex-servicemen quota will be filled up along with the general recruitment.

OFFICE MEMORANDUM

Subject: Appointment of direct recruit Assistants, Central Secretariat Service based on Combined Graduate Level Examination (CGLE), 2012-reg.

The undersigned is directed to nominate the successful candidates recommended by Staff Selection Commission based on the CGLE, 2012 to the various participating Ministries/ Departments (Cadre Units) of Central Secretariat Service as detailed in Annexure.

2. The procedure for joining and imparting training (Foundation Course) to direct recruit Assistants of CSS shall be as per the revised design detailed in this Department O.M. No 7/8/2008-CS I(A) dated 16.10.2012.

3. The Cadre Units shall be responsible for completing the pre and post appointment formalities viz, character and antecedents verification in accordance with the instructions issued from time to time, medical examination etc in respect of nominated DR Assistants. Those candidates who are already in Government servile, their present employers may be requested to furnish copies of Verification/Medical Report The Cadre Units shall issue offers of appointment to the DR Assistants only after completing pre -appointment formalities. In the offer it may be stated in clear terms, inter alia, the mandatory nature of Foundation Course and its direct linkage to their probation period and their subsequent confirmation.

4. The Cadre Units will immediately inform the CS.I Division about the nominated candidates who join the allocated Cadre Units. On their appointment the Cadre Units should immediately enter their complete data in the web based Cadre Management System. The appointed Assistants will be nominated by CS.I Division in batches to the Foundation Course programme at ISTM for a period of 12 weeks Once CS I Division nominates DR Assistants for the training, they shall stand relieved from the concerned Cadre Units. No formal relieving order would be required to be issued by the concerned Cadre Units. It is once again reiterated that the Cadre Units shall indicate in unambiguous terms in the offer of appointment that successful
completion of training is mandatory for completing the probation by the DR Assistants and their confirmation
.
5. In terms of this Departments OM. No.16/11/1993 dated 26/11/993 if offer of appointment is issued after completion of pre-appointment formalities, the time period allowed to join the post should in no case exceed three months. This condition should also be incorporated in the offer of appointment. After receiving verification and medical reports, the Cadre Units may issue the offer of appointment immediately to the candidates Cadre Units may also pursue the matter with the concerned District Authorities to expedite the matter so as to ensure that the candidates are appointed at the earliest.

6. The original certificates with reference to date of birth and educational qualification etc. shall be verified before appointments are made by the Cadre authorities. Copies of certificates submitted by candidates claiming to belong to the SC/ST/OBCs etc, may also be verified by the Cadre Units concerned.

7. In case of any doubt or suspicion as regards the eligibility or otherwise in respect of any of the recommended / appointed candidates, concerned administrative Ministry/ Department may correspond with the Staff Selection Commission giving therein complete details for getting such case(s) enquired through appropriate Government Agency.

“B.Sc. with Bio-chemistry/Micro-Biology/Life Science or equivalent plus Diploma in Technology (DMLT) or equivalent OR B.Sc. in Medical Technology (Laboratory) from institutions.”

2. A question has arisen whether a candidate with qualification of B.Sc. (Chemistry) Honors with Botany & Zoology as subsidiary subject can be considered for the post of Lab. Supdt., Gr.III in Pay Band of Rs.9300-34800 (Grade Pay: Rs.4200) where qualification was notified as stated in para 1 above.

3. The matter has been examined in consultation with Health Directorate of this Ministry and it is clarified that if the candidate has studied during his Graduation both Chemistry and Biology whether as main or as optional/subsidiary subject and is in possession of DMLT or equivalent will be treated as eligible for consideration for employment to the posts cited in the captioned subject.
