OFFICE MEMORANDUM

Sub:- Grant of Dearness Relief in the 5th CPC series effective from 01.07.2018 to CPF beneficiaries in receipt of ex-gratia payment-reg

In continuation of this Department’s OM No. 42/06/2018-P&PW(G) dated 19.04.2018 the President is pleased to decide that the Deamess Relief w.e.f 01 .07.2018 to the CPF beneficiaries in receipt of ex-gratia payment shall be paid in the following manner:-

(i) The surviving CPF beneficiaries who have retired from service between the period 18.11.1960 and 31.12.1985. and were sanctioned ex-gratia @ Rs. 600/ p.m. w.e.f. 01.11.1997 under this Department’s OM No. 45/52/97-P&PW(E) dated 16.12.1997 and revised to Rs.3000, Rs.1000. Rs.750 & Rs.650 for Group A, B, C & D respectively w.e.f 4th June.2013 vide OM No. 1/10/2012-P&PW(E) dtd. 27th June 2013 shall be entitled to enhanced Dearness Relief from 274% to 284% w.e.f 01.07.2018.

(ii) The following categories of CPF beneficiaries who are in receipt of ex-gratia payment in terms of this Department’s OM No. 45/52/97-P&PW(E) dated 16.12.1997 shall be entitled to enhanced Dearness Relief from 266% to 276% w.e.f. 01.07.2018.

(a) The widows and eligible children of the deceased CPF beneficiary who had retired from service prior to 01.1.1986 or who had died while in service prior to 1.1.1986 and were sanctioned ex-gratia payment of Rs. 605/- p.m. and revised to Rs.645/-p.m w.e.f  4th June, 2013 vide OM No 1/10/2012-P&PW(E) dated 27th June 2013.

(b) Central Government employees who had retired on CPF benefits before 18.11.1960 and in receipt of Ex-gratia payment of Rs.654/-, Rs. 659/-, Rs.703/- and Rs. 965/-

2. Payment of DR involving a fraction of a rupee shall be rounded off to the next higher rupee.

3. It will be the responsibility of the pension disbursing authorities, including the nationalized bank etc. to calculate the quantum of DR payable in each individual case.

4. In their application to the Indian Audit and Accounts Department, these orders issue after the concurrence of O/o C&AG.

5. This issues in pursuance of Ministry of Finance, Department of Expenditure OM No. IG/2008-E(B) dated 11th Sept, 2018.

Sub :- Grant of Dearness Relief in the 5th CPC series effective from 01.01.2018 to CPF beneficiaries in receipt of ex-gratia payment – reg

In continuation of this Department’s OM No.42/15/2016-P&PW(G) dated 13.10.2017, the President is pleased to decide that the Dearness Relief w.e.f 01.01.2018 to the CPF beneficiaries in receipt of ex-gratia payment shall be paid in the following manner

(i) The surviving CPF beneficiaries who have retired from service between the period 18.11.1960 and 31.12.1985, and were sanctioned ex-gratia @ Rs. 600/ p.m. w.e.f. 1.11.1997 under this Department’s OM No. 45/52/97-P&PW(E) dated 16.12.1997 and revised to Rs.3000, Rs.1000, Rs.750 & Rs.650 for Group A, B, C & D respectively w.e.f 4th June,2013 vide OM No. 1/10/2012-P&PW(E) dtd. 27th June, 2013 shall be entitled to enhanced Dearness Relief from 268% to 274% w.e.f 01.01.2018.

(ii) The following categories of CPF beneficiaries who are in receipt of ex-gratia payment in terms of this Department’s OM No. 45/52/97-P&PW(E) dated 16.12.1997 shall be entitled to enhanced Dearness Relief from 260% to 266% w.e.f 01.01.2018.

(a) The widows and eligible children of the deceased CPF beneficiary who had retired from service prior to 1.1.1986 or who had died while in service prior to 1.1.1986 and were sanctioned ex-gratia payment of Rs. 605/- p.m. and revised to Rs.645/-p.m w.e.f 04 June, 2013 vide OM No 1/10/2012-P&PW(E) dated 27th June,2013.

(b) Central Government employees who had retired on CPF benefits before 18.11.1960 and are in receipt of Ex-gratia payment of Rs. 654/-, Rs.659/-, Rs.703/- and Rs.965/-

2. Payment of DR involving a fraction of a rupee shall be rounded off to the next higher rupee.

3. It will be the responsibility of the pension disbursing authorities, including the nationalized banks, etc. to calculate the quantum of DR payable in each individual case.

Current Pension rate of Contributory Provident Fund (CPF) pensioners

The Central Government employees who are covered by CPF Rules (India) 1962 and who retired on or after 01.01.1986 are not entitled to any monthly pension/ex-gratia amount. However, the Government employees under CPF who retired between 18.11.1960 and 31.12.1985 are entitled to monthly ex-gratia amount of the following rates:

Dearness ex-gratia equal to 50% of the amount of ex-gratia and Dearness Relief, as notified from time to time as per 5th Central Pay Commission series, on the sums of amount of ex-gratia and dearness ex-gratia is being paid to them. There is no proposal to increase the aforesaid rates.

This was stated by Shri Shiv Pratap Shukla, Minister of State for Finance in a written reply to a question in Lok Sabha today.

In continuation of this Department’s OM No. 42/15/2016-P&PW(G) dated 12.05.2017, the President is pleased to decide that the Dearness Relief @ 5th CPC w.e.f 01.07.2017 to the following categories :-

(i) The surviving CPF beneficiaries who have retired from service between the period 18.11.1960 and 31.12.1985, and are in receipt of ex-gratia @ Rs. 600/ p.m. w.e.f. 1.11.1997 under this Department’s OM No. 45/52/97-P&PW(E) dated 16.12.1997 & revised to Rs.3000, Rs.I000, Rs.750 & Rs.650 for Group A, B, C & D respectively w.e.f 4th June,2013 vide OM No. 1/10/2012-P&PW(E) dtd. 27th June, 2013 shall be entitled to enhanced Dearness Relief from 264% to 268% w.e.f 01.07.2017.

In continuation of this Department’s OM No. 42/10/2014-P&PW(G) dated 28th Oct, 2015, the President is pleased to grant the Dearness Relief at the rate of 5th CPC w.e.f. 1.1.2016 to the following :

 

The surviving CPF beneficiaries who have retired from service between the period 18.11.1960 to 31.12.1985 and are in receipt of ex-gratia @ Rs.600/-p.m. w.e.f. 01.11.1997 under this Department’s OM No. 45/52/97-P&PW(E) dated 16.12.1997 & revised to Rs.3000, Rs.1000, Rs.750 & Rs.650 for Group A, B, C & D respectively w.e.f 4th June,2013 vide OM No. 1/10/2012-P&PW(E) dtd. 27th June, 2013 are entitled to Dearness Relief @ 245% w.e.f. 01.01.2016.

 

(ii) The following categories of CPF beneficiaries who are in receipt of ex-gratia payment in terms of this Department’s OM No. 45/52/97-P&PW(E) dated 16.12.1997 are entitled to DR ©237 % w.e.f. 01.01.2016.

 

(a) The widows and dependent children of the deceased CPF beneficiary who had retired from service prior to 1.1.1986 or who had died while in service prior to 1.1.1986 and are in receipt of Ex-gratia payment of Rs. 605/- p.m. & revised to Rs 645/-p.m with effect from 04th June ,2013 vide OM No. 1/10/2012-P&PW(E) dated 27th June,2013.

 

(b) Central Government employees who had retired on CPF benefits before 18.11.1960 and are in receipt of Ex-gratia payment of Rs. 654/-, Rs. 659/-, Rs. 703/- and Rs. 965/-.

(i) The surviving CPF beneficiaries who have retired from service between the period 18.11.1960 to 31.12.1985 and are in receipt of ex-gratia @ RS.600/-p.m. w.e.f. 01.11.1997 under this Department’s OM No.45/52/97-P&PW(E) dated 16.12.1997 & revised to Rs.3000, Rs.1000,Rs.750 & Rs.650 for Group A, B, C & D respectively w.e.f 4th June,2013 vide OM No. 1/10/2012-P&PW(E) dtd.27th June, 2013 are entitled to Dearness Relief @ 234% w.e.f. 1.7.2015.

(ii) The following categories of CPF beneficiaries who are in receipt of ex-gratia payment in terms of this Department’s OM No. 45/52/97-P&PW(E) dated 16.12.1997 are entitled to DR @ 226% w.e.f. 1.7.2015.

(a) The widows and dependent children of the deceased CPF beneficiary who had retired from service prior to 1.1.1986 or who had died while in service prior to 1.1.1986 and are in receipt of Ex-gratia payment of Rs. 605/- p.m. & revised to Rs 645 p.m w.e.f 04th June ,2013 vide OM No.1/10/2012-P&PW(E) dated 27th June,2013.

Sir,

I am to refer to your letter no. KVS/2013-2015 dated 29.04.2015 addressed to the Secretary, MHRD on the captioned subject and to inform you that the matter regarding one time permission for change over from CPF to GPF Scheme for teaching and non-teaching staff of KVS was considered by MHRD in consultation with Department of Expenditure. The Ministry of HRD vide their letter No. F.3-14/2012-UT-2 dated 7th April, 2015 has informed that the Department of Expenditure after examining the proposal has inter-alia observed as under:

“The employees of Kendirya Vidyalaya Sasngathan who were in service as on 1.1.1986 and decided to opt for CPF made a conscious decision knowing well that the option once exercised is final. Grant of one more option to such CPF subscribers in KVS could have repercussion elsewhere with such an option having to be extended to all other CPF beneficiaries as well whose number is quite substantial.

In view of the above position, the proposal for grant of one time permission for changing from CPF to GPF cum Pension Scheme for teaching and non-teaching staff of KVS is not agreed to.”

Hence, it is not possible to accept your request accordingly.

CCS (Pension)Rules 1972

The Central Civil Services (Pension) Rules 1972 shall apply to Central Government Servants including civilian Government servants in the Defence Services, appointed substantively to civil services and posts in connection with the affairs of the Union which are borne on pensionable establishments, but shall not apply to:

  •     Railway servants;
  •     Persons in CCS, casual and daily rated employment
  •     Paid from contingencies
  •     CPF beneficiaries
  •     Members of All India services
  •     Locally recruited diplomatic, Counsular or other Indian establishments in foreign    countries
  •    Persons whose terms and conditions of service are regulated by or under the provisions of the Constitution or any other law for the time being in force.

These rules regulate the grant of pension, family pension, commutation of pension, payment of gratuity etc.

CCS (Commutation of Pension) Rules, 1981

These rules regulate commutation of pension and other related matters to Government Servants who may be entitled or have been authorised any class of pension referred to in the CCS (Pension) Rules, 1972.

CCS (Extraordinary Pension) Rules.

These rules shall apply to all persons paid from Civil Estimates other than those to whom the workmen’s Compensation Act, 1923 applies and regulate grant of disability pension, extra-ordinary family pension.

General Provident Fund (Central Services) Rules 1960

All Temporary Government servants after a continuous service of one year all re-employed pensioners (other than those eligible for admission to the Contributory Provident Fund ) and all permanent government servants are eligible to subscribe to the Fund. A subscriber, at the time of joining the Fund is required to make a nomination, in the prescribed form, conferring on one or more persons the right to receive the amount that may stand to his credit in the Fund in the event of his death, before that amount has become payable or having become payable has not been paid.

A subscriber shall subscribe monthly to the Fund except during the period when he is under suspension. Subscription to Provident Fund are stopped three months prior to the date of superannuation. Rates of subscription shall not be less than 6% of subscriber’s emoluments and not more than his total emoluments. Rate of interest on GPF accumulations at present is 12% compounded annually. The Rules provide for drawal of advances /withdrawals from the Fund for specific purposes.

Deposit Linked Insurance Revised Scheme

On the death of a subscriber, the person entitled to receive the amount standing to the credit of the subscriber shall be paid an additional amount equal to the average balance in the account during the three years immediately preceding the death of the subscriber subject to certain conditions provided in the relevant rule. The additional amount payable under that rule shall not exceed Rs. 60,000. To get this benefit, the subscriber should have put in at least 5 years service at the time of his / her death.

Contributory Provident Fund Rules (India ), 1962

The CPF Rules are applicable to every non-pensionable servant of the Government belonging to any of the services under the control of the President. A subscriber, at the time of joining the Fund is required to make a nomination in the prescribed form conferring on one or more persons the right to receive the amount that may stand to his credit in the Fund in the event of his death, before that amount has become payable or having become payable has not been paid.

A subscriber shall subscribe monthly to the Fund when on duty or foreign service but not during a period of suspension. Rates of subscription shall not be less than 10% of the emoluments and not more than his emoluments. The employer’s contribution at that percentage prescribed by the Government will be credited to the subscriber’s account and this is presently 10%. Rate of interest, at present, is 12% compounded annually. The Rules provide for drawal of advances / withdrawals from the CPF for specific purposes. As in GPF Rules, the CPF Rules also provide for Deposit linked Insurance Revised Scheme.

Earlier, the Government was giving option to CPF subscribers to switch over from CPF Scheme to GPF Scheme (Pension Scheme). The last such option was allowed based on the recommendations of Fourth CPC. As a number of options have already been allowed as and when substantial improvement were made in the pension scheme and the practical difficulties involved in retrieval of records and adjustments to be made, demand for further option was not recommended by the 5th CPC and there is no proposal with the Government to consider any further change in options.
